SUBJECT: Easement Vacation Request by
Beaudry Oil, Case No. EV 97-4
Last Tuesday, Bruce West and I met with Ken Beaudry to discuss his
easement vacation request, as well as some of the other fire code issues
relating to the Beaudry Oil petroleum facility. Based on our meeting, Mr.
Beaudry will performing the following:
Remove the above ground storage tanks out of the Quinn Avenue right of
way to another location on his property. These above ground storage
tanks will not be filled with any product until the appropriate permits are
obtained.
Continue to work with Bruce West on compliance with other fire code
related issues (see Bruce West's memo).
Upon obtaining ownership of the former railroad spur, Mr. Beaudry will
apply for a conditional use permit to install the above ground storage
tanks on his property.
· The only use of Quinn Avenue will be for parking purposes by Beaudry Oil
employees.
Based on these action steps, Mr. Beaudry has requested to withdraw his
application to vacate a portion of Quinn Avenue. All of the activity short of
vehicle parking will be located on the property that is currently owned by Mr.
Beaudry.
Requested Action
Accept the applicant's request to withdraw the application to vacate a portion
of Quinn Avenue.

Beaudry Oil Fire Code Issues
On Tuesday, October 14, Steve Ach and I met with Ken Beaudry to discuss
various issues relating to the Beaudry Oil bulk plant site. Various issues
were discussed in reference to the fire code violations at the Beaudry Oil
facility. As a result of our meeting, Mr. Beaudry has concurred that the
above ground storage tanks shall be removed immediately. Based on our
meeting, Mr. Beaudry shall perform the following:
· All propane tanks awaiting sale located on the west side of Quinn Avenue
shall be removed and placed within another location of the Beaudry Oil
facility.
· Before any construction or new or additional installation for the storage,
handling, or use of flammable liquids is undertaken in bulk plants,
drawings, or blueprints of them, made to scale shall be submitted to the
State Fire Marshal with an application, all in duplicate, for review.
Within a reasonable time, usually ten days after receipt of the application
with drawings or blueprints, the State Fire Marshal's office shall examine
them.
· Mr. Beaudry has agreed that with any and all expansion of the bulk oil
facility, all proposed drawings and blueprints shall be submitted to the
State Fire Marshal's office for approval and obtain the proper permits for
flammable and combustible liquids.
· With the approval of the State Fire Marshal's office, this will assure code
compliance in reference to the 1991 Uniform Fire Code.
The second issue of discussion at the Beaudry Oil facility was the concern in
reference to the storage of propane tanks awaiting sale which were located on
the west side of Quinn Avenue within the right-of-way. Mr. Beaudry has
removed the propane tanks from this area and is in the process of planning
the future storage location of the propane tanks awaiting sale. Once again,
Mr. Beaudry shall obtain the proper approval and permits from the State

Fire Marshal's office in reference to the propane tanks located at the Beaudry
Oil facility.
Conclusion
At this time Mr. Beaudry is in the process of, or has removed, the three above
ground storage tanks located within the right-of-way of Quinn Avenue. Mr.
Beaudry also has removed the propane tanks awaiting sale for compliance
with both the 1991 Uniform Fire Code relating to the above ground storage
tanks and NFPA 58 Standard for the Storage and Handling of Liquefied
Petroleum Gases for the propane tanks. Mr. Beaudry has agreed that any
and all future expansion of the Beaudry Oil facility will require approval of
the State Fire Marshal's office and proper permits shall be obtained.
