Special Assessment Reapportionments
and Special Assessment Resolutions
There are several special assessment items which need Council approval at
Monday's meeting so that the assessments may be certified to the county for
collection in 1998. The first item is simply a reapportionment of assessments
which have already been levied. The remaining items are assessment
resolutions which require Council approval, but do not require a public
hearing because the developers have initiated the improvements and have
waived their rights to a public hearing and to object to the assessment
amounts. These items simply require Council adoption of the attached
resolutions.
Country Cross 4th Special Assessment Reapportionment - Earlier this year the
Riverview and Macon improvements were assessed to two outlots in Country
Crossing 3ra Addition. These outlots have since been platted into Country
Crossing 4th Addition. According to Minnesota Statute, the City Council
must approve the reapportionment of the assessments to the new lots in
Country Crossing 4th Addition. Assessments totaling $235,300 against
Outlots A and B of Country Crossing 3ra will be assessed to Lots 1-8, Block 1
and Lots 1-16, Block 2 of Country Crossing 4th.
Approve Special Assessment Resolutions

Cherrywood Hills has not been assessed for trunk water and sewer.
Attached is a resolution to approve trunk water and sewer
assessments of $3,800 per acre to the 46 lots in Cherrywood Hills.

Trunk water and sewer assessments of $3,800 per acre also need to be
assessed to Elk Run (Cottages of Elk River development).

Additionally, lateral water improvements are to be assessed as part of
the Highland Road water improvements.

Water and sewer lateral connection - One property owner on Orono
Road opted to connect into city water and sewer in 1997. Since this
property had not been assessed for lateral benefit, the property owner
has signed a waiver authorizing the city to levy assessments for the
lateral water and sewer improvements allowing him to connect to city
utilities.

1997 Garbage Assessments - Attached is a schedule of the 1997
garbage assessments. These assessments are for property owners who
had delinquent balances as of September 1. The total amount assessed
is approximately $30 less than the amount assessed in 1996. Many of
the property owners being assessed have been on the assessment roll
for unpaid garbage services in past years.
South Joplin Street Improvements - The developer of Country Crossing
3ra and 4th Additions was required to pay one half of the street
improvement cost for Joplin, south of Mississippi Road. The
developer's share of the cost of this improvement is $97,178.38.
Action Requested
The City Council is asked to approve the special assessment reapportionment
for Country Crossing 4th Addition and to approve the attached resolutions
levying special assessments as outlined above.

A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
FOR CHERRYWOOD HILLS TRUNK WATER AND SEWER
WHEREAS, upon due notice properly made as required by law, the Elk River City
Council has met and heard and passed upon all objections to the
proposed assessment for the 1997 Cherrywood Hills Trunk Water and
Sewer improvement and has determined the amount to be assessed
against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota:
Final assessment roll, a copy of which is attached hereto and
incorporated herein by this reference, is hereby accepted and adopted
and shall constitute the special assessment against the lands therein
named. Each such tract of land in the assessment roll is hereby found
to be benefited by the improvement in an amount not less than the
amount of the assessment levied against it.

Such assessment shall be payable in equal annual installments,
including both principal and interest, amortized in such amount
annually as is required to pay the principal with interest as 7.0% over
a period of three years.
The owner of any property so assessed, may, at any time prior to
certification to the County Auditor of the assessment or the first
installment thereof, pay to the City Treasurer the whole of the
assessment on such property, with interest accrued to the date of
payment; except that no interest shall be charged if the entire
assessment is paid within 30 days after the adoption of this
Resolution. Prepayment may also be made after the certification of
the assessment or first installment thereof by paying to the City
Treasurer/Auditor the entire amount of the assessment remaining
unpaid with interest. In the case of a payment made before
November 15, interest will be calculated through December 31 of the
next succeeding year.
The City Administrator shall transmit to the County Auditor a
certified duplicate of the attached assessment roll to be extended on
the property tax lists of the County. Such assessment shall be
collected and paid over in the same manner as other municipal taxes.

RESOLUTION 97-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS
FOR UNPAID GARBAGE COLLECTION SERVICES
AS OF SEPTEMBER 1, 1997
WHEREAS,
Minnesota Statutes Section 433.015 authorizes the City
to annually levy an assessment equal to such unpaid cost
as of September 1 of each year for garbage collection
services at an interest rate not to exceed 6% and a penalty
not to exceed 10%; and,
WHEREAS,
the City's ordinance Section 602.12 Subdivision 3,
authorizes the City to levy an assessment against
property for garbage collection equal to the unpaid
charges as of September 1; and,
WHEREAS,
all customers and property owners with delinquent
balances as of September 1, 1997, have been given
adequate notice of this pending assessment and have
been given opportunities to pay prior to this assessment
being levied; and,
WHEREAS,
State law does not require a public hearing or notice
before levying such assessments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Elk River that the parcels and amounts listed on Exhibit
A, attached hereto are correct and made a part hereof, are
to be levied at an interest rate of 6% per annum with a
10% penalty, and certified to the Sherburne County
Auditor.
Passed and adopted by the City Council of the City of Elk River this 27th day
of October, 1997.
