The district was intended to allow certain light industrial, office and limited commercial uses based on the underlying land use classification. Office and light industrial uses would be allowed when the underlying land use is light industrial, and certain commercial uses would be allowed when the underlying land use classification is highway business. The current ordinance does not reflect that intent. The option that is recommended by the Commission and staff lists the uses allowed based on the underlying land uses as shown below: Permitted Uses Permitted uses allowed when the underlying land use is light industrial: 13065 Orono Parkway · P.O. Permitted uses allowed when the underlying land use is highway business: 1. Health athletic clubs 2. Personal service establishments 3. Financial institutions Conditional Uses Conditional uses allowed when the underlying land use is light industrial: 1. Any permitted use which involves more than 30 % warehouse space 2. Vocational, technical, and trade schools 3. Multiple buildings on a lot 4. Multiple tenant buildings 5. Above ground storage tanks ii. Conditional uses allowed when the underlying land use is highway business: 1. Hotels and motels 2. Licensed daycare facilities 3. Retail shops and stores which compliment and serve the Business Park subject to the standards set forth in 2(j) below 4. Motor vehicle specialty service stations 5. Multiple buildings on a lot 6. Multiple tenant buildings 7. Restaurants (Class I) The Statement of Purpose could also be amended to better reflect the original intent of the Business Park district. The following is a revised Statement of Purpose the accomplishes that: The Business Park district is established to encourage a planned, integrated environment for certain industrial, office and commercial uses which are compatible with and compliment each other as well as the surrounding land uses. The underlying land use designation will guide the type of uses allowed within the district. Development within the Business Park district will correspond with the land use designation. Industrial and office uses allowed where the land use designation is light industrial, and commercial uses allowed where the land use designation is highway business. It is the intent of this ordinance that development reflects common themes using compatible architectural design and consistency in signage, landscaping, and lighting. It is also the intent to encourage businesses which generate a high number of jobs per square foot rather that predominately warehouse types uses. With the proposed amendment, no changes are made to the types of uses allowed. The change involves organizing the current uses into categories based on the underlying land use classification. Recommendation The Planning Commission and staff recommend the City Council approve Ordinance 97- amending the Business Park district to specifically list the types of uses allowed when the underlying land use is highway business or light industrial; the ordinance also amends the Statement of Purpose to better reflect the original intent of the district. \\elkriver\sys\shrdoc\planning\scott\oa9712cc.doc ORDINANCE 97- CITY OF ELK RIVER AN ORDINANCE AMENDING SECTION 900.12 OF THE CITY OF ELK RIVER CODES OF ORDINANCE RELATING TO PERMITTED AND CONDITIONAL USES IN THE BUSINESS PARK ZONING DISTRICT CASE NO. OA 97-12 The City Council of the City of Elk River does hereby ordain as follows: Section 1. Section 900.12 (16) of the City of Elk River Code of Ordinance titled "Permitted, Accessory, and Conditional Uses" is hereby amended to delete the Statement of Purpose and replace it with the following: Statement of Purpose: The Business Park district is established to encourage a planned, integrated environment for certain industrial, office and commercial uses which are compatible with and compliment each other as well as the surrounding land uses. The underlying land use designation will guide the type of uses allowed within the district. The underlying land use designation within the district may vary, either light industrial or highway business. Development within the Business Park district will correspond with the land use designation. Industrial and office uses allowed where the land use designation is light industrial, and commercial uses allowed where the land use designation is highway business. Front Yard Thirty-five (35) feet, or one-half (1/2) the total building height whichever is greater. ii. Side Yard - Twenty (20) feet, or one-half (1/2) the total building height, whichever is greater. iii. Rear yard Twenty (20) feet, or one-half (1/2) the total building height, whichever is greater. iv. Ail setbacks shall be determined from the planned right-of-way (ROW), as designated in the City, County, or State Transportation Plan, and normally defined in the subdivision regulations.
