Issue.
Country Ridge, Inc., is requesting the following:
A preliminary plat to subdivide approximately 20 acres into one

Bachground
The Economic Development Authority (EDA) recently approved utilizing
$195,000 of excess TIF funds from District No. 5 to purchase property in
Country Crossing Business Center. Based on the available funds a parcel of
approximately 4.5 acres can be purchased.

Overview
The proposed plat involves creating approximately a 4.4 acre industrial lot
along with a large outlot that will be platted at a later date. The minimum
lot size in the business park zoning district is 11/2 acres. The proposed parcel
of approximately 4.4 acres exceeds the minimum lot size requirements.
As discussed in the past development of the Business Park would be oriented
away from the residential to the south. Therefore, this parcel would be
developed with access onto Jophn Street with no access occurring onto 183rd
Avenue. At the time the parcel is developed an appropriate buffer along
183rd Avenue and the residential area to the south will be estabhshed.
Depending upon the specific use of the property, a conditional use permit
may be required which involves the Planning Commission and City Council
review. However, ff the business is considered a permitted use, the
development plans will be reviewed by staff through the site plan review
process.
The proposed location for the 4.4 acre parcel was chosen because this area
appears to have fewer subdivision alternatives. On the other hand, the
outlot immediately to the west is left with a variety of options depending
upon the end user of the property. At one time a plat was submitted (never
recorded) and approved by the City Council to extend a cul-de-sac south off
Business Center Drive. Again, by platting the 4.4 acre parcel, a cul-de-sac
could still occur ff the market demands such a subdivision.
Drainage~Utilities
A complete drainage plan will be submitted when the property is developed.
Utilities are currently available to serve the property on Joplin Street and
183~a Avenue.
Recommendation
It is recommended the City Council approve the following:
Prehminary Plat to subdivide approximately 20 acres into one
industrial lot and one outlot.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
COUNTRY CROSSING BUSINESS CENTER 2"D ADDITION
Case No. P 97-18
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on December 15, 1997; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
Bo
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
Co
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
Do
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
Eo
The proposed subdivision will not cause substantial environmental
damage.
Fo
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.

The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.

This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
