Staff recommends that the Planning Commission recommend approval of the Conditional Use Permit (CUP) request to amend the PUD agreement to allow the rental of trucks as a conditional use at the Elk River Crossing planned unit development. 2. Staff recommends the Planning Commission recommend approval of the Conditional use Permit request to allow Penske truck rental with the following conditions: 1. The PUD agreement shall be amended to include language allowing the leasing of moving/delivery trucks. Trucks not to exceed 26 feet. 2. Six dedicated parking stalls shall be provided at the south end of the westerly outermost parking, as show on the site plan shown as exhibit A. 3. No more than six rental trucks shall be on site at any given time. No drive area may be obstructed. BACKGROUND/DISCUSSION. The applicant is requesting to operate a Home Depot/Penske Truck Rental Program at the Home Depot store. The property is part of the Elk River Crossing Planned Unit Development (PUD) and the sale/rental of vehicles is currently not allowed as part of the PUD agreement. The following uses are currently allowed as permitted uses within the project: • Governmental, business and professional offices • Retail shops and stores • Personal service establishments • Financial institutions • Non-profit clubs, lodges or halls • Veterinary clinics P ®^ E i E® R N:\Dcpartments\Community Development\Planning\Case Files\CUP\CU 11-17 Home Dcpot\CU 11-17_PC.doc • Garden centers, which may include outdoor display The following uses currently are allowed as conditional uses within the Project: • Amusement and recreation uses • Hotel and motels • Licensed day caxe facilities • Educational uses • Motor vehicle service stations • Motor vehicle specialty shops • Car washes • Restaurants (Class I and I1) • On-sale liquor establishments • Retail sale of gasoline • Zero lot line development In order to proceed with this CUP request, the applicant will have to amend the Elk River Crossing PUD. Staff is recommending that the Elk River Crossing PUD agreement be amended to include language allowing the leasing of moving/delivery trucks. Although the applicant has not requested signage. Staff would not be opposed to adding the following language to the Elk River Crossing PUD agreement: Accessory to major tenant signage. One wall sign not to exceed 150 square feet. RENTAL PROGRAM The program is designed so a customer can rent a truck on-line or in the store. The truck will be brought in from off site on the day of renter pick-up. The trucks can be returned to any participating Home Depot or Penske location. Trucks will be taken away in a reasonable time frame upon drop off. The applicant anticipates 2-6 trucks will be on site at any given time. They axe proposing parking stalls for the 6 trucks in two different locations. One location would be for two trucks by the west entrance to the property. The second location would be for four trucks near the north entrance into the building. Staff has a concern with the two trucks parked by the entrance. Trucks parked there will act as signage, especially at an entrance to a property. The city ordinance does not allow trucks to be utilized for the sole purpose of advertising. Obviously the sole purpose of the trucks is not to advertise and they need to be parked somewhere on site. Staff is recommending that all six trucks be located where they will not compete with the parking for the main entrances to Home Depot, the retail building to the northwest, Home Depot garden center, and where they will not be interpreted as signage. Staff is recommended the six dedicated stalls be at the south end of the westerly outermost parking, as show on the site plan (Exhibit A). As presented, Elk River has been selected as one of the regional locations to provide these services. The program is designed so that customers can sign up to rent a truck on-line or in-store. The trucks then can be returned to any Home Depot participating in the Penske truck-rental program, as well as to any of Penske's several hundred U.S. locations. It is Home Depot's intention to have the trucks brought in from off-site and delivered on the day of renter pick up. The trucks will then be taken away within a reasonable time frame upon drop off at the end of the rental period. We anticipate that Home Depot could have between two (2) and six (6) trucks on-site at any given time. Home Depot proposes to place the trucks in the areas designated on the attached Site Plan, dated 9/19/11. The plan presently has 584 spaces indicated which is in excess of 150 cars for a Home Depot store of this size in this market. As discussed, this store presently has an approved truck rental program referred to the "Load'nGo" program from which we feel the proposed Penske program is compatible. The Penske program has been established to assist Home Depot customers in streamlining moves by eliminating separate trips to pick up and return the trucks, plus it allows the customers to couple the truck rental with trips to Home Depot to purchase the items they'll need before, during and after the moving process. Thus, it makes very good business sense for Home Depot to form this partnership with Penske. Customers who sign up for the "Mover Program" receive moving tips, exclusive offers and services. The Home Depot spotlights articles for all stages of the moving process -- from preparing for a home inspection or creating curbside appeal, to packing moving boxes and mapping rooms for your new residence.
