PRSR 11-09-2011TO: FROM: DATE: SUBJECT: MEMORANDUM Parks and Recreation Commission Chris Leeseberg, Parks Planner/Planner November 9, 201 I Item: 8.3 Ordinance Amendment -Alcohol in Rivers Edge Commons Park In July 2007, the Parks and Recreation Commission recommended making River's Edge Cotrunons Paxk alcohol free because the park has a water feature (classified as a pool) and is the site fox large family-oriented special events. As a housekeeping item, this policy will be brought to the City Counc$ as an ordinance amendment. IN GENERAL Secs. 54-1-64-30. Reserved. ARTICLE II. PUBLIC CONDUCT IN PARKS Sec. 54-31. Closing hours. No person shall enter or remain upon the grounds of any public park within the city after 10:00 p.m. or before 6:00 a.m. (Code 1982, § 408.00) Sec. 54.32. Consumption of alcoholic bever- ages on public beach. No person shall consume liquor on a public beach located in a city park. (Code 1982, § 405.02) Cross reFerence-Alcoholic beverages, ch. 6. Sec. 54-33. Disturbing the peace-Conduct. (a) No person or group of persons shall disturb the peace in any park by either words or acts. (b) No person or group of persons shall use threatening, abusive, insulting, obscene or inde- cent language in any park. (c) No person or group of persons shall commit, perform or engage in any lewd, lascivious, ob- scene or indecent actin any park. (d) No person or group of persons shall entice or attempt to entice another person to commit, perform or engage in, any lewd, lascivious, ob- scene or indecent act in any park. (e) Penalty. Any person violating this section shall be guilty of a misdemeanor. (Ord. Maextz shazed the first policy relating to alcohol. Currently, City policy allows alcohol for "personal consumption" in City parks. With this park having a water feature where glass is not allowed as well as being a site for large family-orientated special events, staff is xecotnmending the City implement an alcohol free policy fox this park. Mr. Maextz shared the second policy relating to use of the bulletin board and brochure holders located on the kiosk. To keep the site neat and free of outside advertisement, staff recommends only allowing City materials to be posted in this space. This would include information from all city departments. Cormmissioner Larson asked if the sign policy would allow sponsors to post information during their sponsored events. Mr. Maextz stated that event sponsors would be allowed to post inforrnadon during the sponsored event. Commissioner Paige asked if there will be smoking allowed. Mx. Maextz shazed that there is akeady a no smoking policy in city parks when within 50 feet of children playing. Commissioner Paige shared that the River's Edge Commons Pazk is a peaceful place with a lot of detailed architecture. It would be very difficult to manage regular cleanings of the park with this amount of detail. Commissioner Schuldt asked how difficult it would be to enforce the no smoking policy. Mx. Maextz stated that it can be challenging however with the State wide ban coming into effect soon and with two bars on either side of the park the policy could duplicate the states. Policy Issues - River's Edge Commons Park Policies Director of Parks and Recreation, Bill Maertz stated that in an effort to be proactive, and a significant amount of traffic each day, staff would like to set two policies for the downtown River's Edge Commons Park.
