Issue
At its meeting on Monday, January 12, 1998, the EDA unanimously
supported a motion recommending that the City Council call a public hearing
regarding the establishment of Tax Increment Financing District No. 19
(Hohlen Project). The purpose of this action is to set in motion a schedule
which can be followed to identify and resolve the variety of issues associated
with this development project. The EDA discussed specifically that the
purpose of their action was to set in motion this schedule, but that final
decisions on whether to provide tax increment to this project has yet to be
decided.
Staff indicated that there is flexibility in the schedule to allow worksessions
to be held with Associated Builders to discuss the details of public dollars
being used and the issue of the industrial component of this project. Staff
also indicated that at any time the EDA/Councfl was uncomfortable with the
scheduled public hearing date, that such date can easily be adjusted.
Recommendation
Staff recommends that the Council adopt Resolution 97-__ cMling for a
public hearing to be held by the City Council on June 1, 1998, at
approximately 6 p.m. on the modification of Development District No. I and
the establishment of Tax Increment Financing District No. 19 (Hohlen
Project).

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION CALLING FOR A PUBLIC HEARING
BY THE CITY COUNCIL ON THE MODIFICATION OF
DEVELOPMENT DISTRICT NO. 1 AND THE ESTABLISHMENT OF TAX
INCREMENT FINANCING DISTRICT NO. 19
BE IT RESOLVED by the City Council (the "Council") for the City of Elk River,
Minnesota (the "City"), as follows:
Section 1. Public Hearing. This Council shall meet on Monday, June 1, 1998,
at approximately 6 p.m., to hold a pubhc hearing on the proposed
modification of Development District No. i and the establishment of Tax
Increment Financing District No. 19 (a Redevelopment Tax Increment
Financing District), all pursuant to and in accordance with Minnesota
Statutes, Sections 469.090 through 469.1081, inclusive, as amended, and
Minnesota Statutes, Section 469.174 through 469.179, inclusive, as amended,
in an effort to encourage the development and redevelopment of certain
designated areas within the City; and,
Section 2. Notice of Public Hearing, Fihng of Program and Plan. Staff is
authorized and directed to prepare the Development Program and the Tax
Increment Financing Plan (the "Program and Plan") and to forward
documents to the appropriate taxing jurisdictions including Sherburne
County and Independent School District No. 728. The City Administrator is
authorized and directed to cause notice of the hearing, together with an
appropriate map as required by law, to be published at least once in the
official newspaper of the City not later than 10 nor more than 30 days prior
to June 1, 1998, and to place a copy of the Program and Plan on file in the
City Administrator's office at City Hall and to make such copy available for
inspection by the pubhc.
Passed and adopted by the City Council of the City of Elk River this 20th day of
January, 1998.
