SUBJECT: Consider a Special Joint Meeting with
the County Board on March 30, 1998
The City Council is requested to call a special meeting for 6:00 p.m. on the
fifth Monday of March. This will be on March 30, 1998, at the County
Government Center for a joint meeting with the Sherburne County Board. It
is anticipated that this will be about a two hour meeting. Attached for your
review are the minutes from the last joint meeting with the County Board
from January, 1997. I will be visiting with Dave Loch in February regarding
the agenda for the joint meeting. Some agenda items are obvious and relate
to transportation issues such as:
· County and City long-range transportation plans
· Cost sharing policy for County road projects
· County Road 1project
· County Road 12 project
· ISTEA application for County Road 13
· Possible County Road 33 and 77 project
Some non-transportation issues include:
· Lake Orono Project
· Waste management issues
· Energy City
· County Park Plan
· County Government building expansion project

Housing and Redevelopment Authority has approved the modifications to the
Development Program for Development District No. 1 and Plan for Tax Increment
District No. 16. Paul Steinman fudher indicated that Sherburne County and
School District No. 728 have reviewed the TIF proposal.
Mayor Duitsman opened the public hearing. There being no one for or against
the matter, Mayor Duitsman closed the public hearing.
COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 97-12, A RESOLUTION
FOR THE CITY OF ELK RIVER RELATING TO MODIFICATION OF THE DEVELOPMENT
PROGRAM FOR DEVELOPMENT DISTRICT NO. 1 AND THE TAX INCREMENT FINANCING
PLAN FOR TAX INCREMENT FINANCING DISTRICT NO. 16. COUNCILMEMBER DIETZ
SECONDED THE MOTION. THE MOTION CARRIED 5-0.
10. Other Business
10.1. Mayor Duitsman
Mayor Duitsman indicated that he has received some comments regarding the
Roger Derrick development. He indicated that he felt the neighboring residents
were under the impression that the development would be limited to people 55
years of age and over. Mayor Duitsman indicated that he has been informed by
Roger Derrick that he would like to change this requirement. Mayor Duitsman
requested input from the City Council as to whether the developer should be
required to hold another public hearing to inform the residents that development
would not be limited to a certain age bracket. It was the consensus of the City
Council to hold a public hearing.
City Attorney Peter Beck indicated that the city should consider amending the
PUD if the 55 year or over age requirement is not adhered to as originally agreed
upon.
10.2. Elk Terrace Mobile Home Park
City Administrator Pat Klaers indicated that staff is requesting the City Council to
continue the public hearing that was scheduled for February 3, 1997, until
February 18, 1997. It was the consensus of the Council to continue the public
hearing for the Elk Terrace Mobile Home Park until February 18, 1997. The City
Administrator informed the Council that this would have to be done by motion on
February 3. He further indicated that the residents of the mobile home park
would be informed of this action prior to the February 3rd City Council meeting.

9. Joint Meetinq with Sherburne County Board of Commissioners and City Council
The City Council reconvened at 7:00 p.m. for a joint meeting with the Sherburne
County Board of Commissioners.

The following County Commissioners were present: Arne Engstrom; Terry Nagorski;
and Betsy Wergin.
The following county staff were present: Dave Loch, County Administrator; Dave
Schwarting, County Engineer.
Transportation Issues - Mayor Duitsman indicated his concern about the timetable
for the proposed improvements to County Road 1. County Engineer Dave
Schwading indicated that County Road 1 is scheduled for improvements,
however, the trail design needs to be incorporated into the plan. The timeframe
for the improvements depends on who will update the plan to incorporate the
trail. Dave Schwarting further indicated that the upgrade of County Road 1 has
never been a high priority for the county. He further stated that the cour~ty is
conforming to the city's request for the upgrade of County Road 1. Dave
Schwarting indicated that the Sherburne County Board has recently committed
to spending some funds for trails.
Discussion was held regarding reconfigurcJtion and improvements at the County
Road 1 and Highway 10 intersection. The City Council indicated that the city is
willing to move forward with this improvement.
It was the consensus of the city and the county to have the County Board make
a formal request to have the city take the lead on the design and construction of
the trail along County Road 1 which would include redesign of the current plans
to include the trail. It was fudher the consensus that the county staff should
request that the County Board make a formal request to have the City of Elk River
tak~ the lead on the redesign of the intersection of County Road 1 and Highway
10.
The City Engineer reviewed the city's plans regarding County Roads 12 and 13.
He informed the county that the city is considering the eastern part of Elk River
along the County Road 12 corridor as the next area to be opened for sewer and
water. He indicated that the extension of these services revolves around the
realignment of County Road 13 so the intersection of County Road 12 and 13 is
further to the east. Dave Schwarting indicated that the county has applied for
and received ISTEA funds for the improvement of County Road 12. He indicated
that they have plans ready to go for the improvement, but have not
incorporated the city's plans into the county's plans. Discussion was held
regarding the county requesting a one year delay for using the ISTEA funds so that
the city and county can coordinate their plans.
Long Ranqe Plan - Dave Schwarting indicated that Sherburne County has
scheduled a meeting for February 19'h to get all cities in the county together to
discuss the long range transportation plan. Commissioner Engstrom indicated
that the issue of city/county jurisdictional study included in the transportation
plan.
Councilmember Dietz questioned why the section of County Road 33 between
Proctor Avenue and Highway 169 had not been resurfaced when the rest of
County Road 33 was resurfaced. Dave Schwarting indicated that this section has
not been resu~ faced because the road needs more than resurfacing. He

indicated that some of the issues that need to be dealt with concern drainage,
funding, and access. He indicated that the county is working on a solution to this
problem.
Alcohol Compliance - Discussion was held regarding the Sherburne County
alcohol compliance check. It was noted that 47 percent of the establishments in
Elk River sold alcohol to underage youth. Dave Loch indicated that the County
Board has requested staff to consider contacting cities within the county to see if
an ordinance can be adopted to try to curb the sale of alcohol to minors. It was
indicated that the development of an ordinance consistent with other cities in
the county would be appropriate. It was the consensus of the city and the
county to work together on this effort.
County Park Plan - Chair Betsy Wergin indicated that Sherburne County held a
public hearing on its proposed park plan. She indicated that the main focus of
the plan is trails and providing safety. She indicated that the plan will be back on
the County Board agenda in February for county action.
Ditches - City Building and Zoning Administrator Steve Rohlf indicated that the
most critical area in Elk River is Ditch 28. Steve Rohlf discussed a possible plan for
correcting Ditch 28 problems, however he indicated that it is not feasible for the
city to correct the problems in 1997 due to a lack of funds. He indicated that the
city will be evaluating the repairs and maintenance that will be necessary for
Ditch 28 and that the city will be asking the county to abandon a section of Ditch
28 in the future.
Commissioner Engstrom indicated that the landowners affected by Ditch 28
problems have indicated that they would like to get the ditch taken care of
because they bare the financial burden each time the ditch is broken down.
Commissioner Engstrom indicated that there will be problems with the ditch this
year.
Ditch 10 - Steve Rohlf indicated that the City of Elk River is continuing its work on
Ditch 10.
Miscellaneous Updates - Chair Betsy Wergin distributed an agreement for the joint
exercise in powers for the coordination of land use planning in Benton, Sherburne,
and Stearns counties. She explained the purpose of the agreement is to
coordinate the exercise of powers in issues such as coordinating comprehensive
plans, zoning, and subdivision ordinances, etc.
Dave Loch updated the Council on the status of the fairgrounds. He indicated
that for the foreseeable future the fairgrounds will be in the City of Elk River.
Dave Loch updated the Council on the status of the government center
expansion.
Mayor Duitsman updated the County Board on the status of the Energy City
program. He indicated that anything the county could do with its expansion to fit
into the energy efficiency model would be appreciated. He indicated that the
City of Elk River has made a commitment to energy efficiency. Steve Rohlf
updated the county on energy city programs.

The City Administrator updated the County Board on the status of the Business
Incubator locating within the City of Elk River.
Government Center Drive - The City Administrator updated the County Board on
the status of Government Center Drive. Dave Loch !r~dicated concerns the
county had regarding drainage south of the county building.
Lake Orono - Steve Rohlf indicated that the MPCA has recently completed a
study on Lake Orono and the study has indicated that the water quality is very
poor. Mayor Duitsman indicated that the water quality of Lake Orono will
probably not be able to be corrected until the water shed district is corrected.
Steve Rohlf encouraged the County Board to think about assisting the city in its
efforts to correct this matter.
Youth Buildinq - Commissioner Engstrom indicated that the County Fair Board has
indicated that it has a building available that could be used for youth programs.
He indicated that the only problem with the building is that it is not winterized and
does not have restroom facilities in the winter.
No further issues were discussed between the county and the city at this time.
