Issue
Consider granting a general planning permit for Living Waters Church for
temporary use of the former Video Update space at the Elk River Mall.

Overview
In 1995, Living Waters Church had a similar request to have a two-week
crusade from August 18th through September Ist. At that time, they used the
former County Market space at Elk River Mall. The meetings occurred
between 7 p.m. and 11 p.m. each evening and was set up to accommodate
approximately 1,500 people.
The current request by Living Waters Church is very similar, however, the
space they will be using is only 6,000 sq. ft. in area and will permit
approximately 300 chairs as opposed to the 1,500 used 2-1/2 years ago.
Living Waters Church's specific request is outlined in the attached letter
from Pastor Bob Pullar. Initially, the meetings are scheduled for a 2-week
period starting the Ist of February. If these meetings prove to successful, the
church would like to continue these for another 2-month period. If these
meetings continue to be successful, the church will apply for a conditional use
permit and operate the space on a more permanent basis.

As in the past, the three issues staff has raised relate to:
parking
hours of operation
making sure the building and fire codes are met based on the
occupancy of the available space.
Given the temporary nature of the request, staff will have an opportunity to
monitor the parking situation and identify any possible problems that may
arise. These issues can then be discussed if Living Waters Church pursue
the conditional use permit for a more permanent use of the space.
Recommendation
It is recommended the City Council approve Living Waters Church request to
conduct a 2-month evangelistic crusade beginning February 1st with the
following conditions:
The building official and fire chief shall inspect the space to be utilized
and approve all public safety issues prior to occupancy.
2. Dates of the crusade be from February I to March 15, 1998.
3. The nightly meetings shall not extend past 11 p.m.

Any parking problems that may arise as a result of the nightly
meetings shall be a basis for Council review of the general planning
permit.

Dear Steve,
I want to make a formal request for temporary use of the former Video
Update space at the Elk River Mall, The owners have agreed to allow us to
