SUBJECT: Sidewalk Snow Plow Policy
At the Open Forum portion of the November 21 City Council meeting, resident Sue Farber approached
the Council regarding the city's snow removal policy. She specifically noted the challenges she and some
of her Highland Road neighbors face when the street plows clear the street, the snow they push is
deposited onto the sidewalk, which is directlybehind the curb.
Background
In January 2011, members of the City Council received complaints from a number of property owners
reacting to staff's enforcement of the sidewalk snow clearing nuisance ordinance. The ordinance identifies
snow and ice not removed from sidewalks within 24 hours of a snow event in residential areas and during
normal business hours in commercial/industrial areas as nuisances. The Council directed staff to enforce
the ordinances after complaints are received. By January 2011, many feet of snow had accumulated and
froze, making full removal from sidewalks very difficult. Some property owners were surprised about the
enforcement because either the city had done the work previously, or the city had not actively enforced the
ordinance before.
In response, the Council reviewed the policy and ordinance at their February 7, 2011, meeting. The
Council agreed to give the property owners 45 days to clear the sidewalk. Additionally, the Council agreed
to review the policy in May.
In May 2011, the Council again reviewed the policy, in particular the abatement process. Additional steps
were added, including the provision of a door hanger as an early warning notice. It is this notice that
alerted the resident of the policy in November 2011.
There are over 46 miles of sidewalks in Elk River and the city currently plows 44% of them. There are
only about 900 feet of sidewalks in the same configuration as the Farber's (immediately behind the curb,
across the street from a city plowed trail), and the city owns 600 of them.

City Expenditures
Currently, it takes staff about eight hours to remove snow from the 20 miles of sidewalks with a 1"
snowfall. With a 6" snow, it takes staff 16-24 hours.
If the city were to expand the number of sidewalks, additional equipment and staff time would be
necessary. Parks maintenance staff believes that a second sidewalk machine would be necessary to
efficiently remove snow from the additional areas. The machine and necessary attachments cost about
$165,000. Other methods are possible such as individuals with snow blowers or modified skid steers, but
these have not been evaluated in depth.
Options
The Council has a number of options.
1. Retain status quo: property owners remove snow from adjacent sidewalks, the city removes snow
from the 20 miles of sidewalk. The 18 additional miles of sidewalks were chosen in part to aid
children waking to school.
2. Require all property owners to remove snow from the sidewalk adjacent to their property. The city
removes snow from only the two miles adjacent to city land, parks, and the lake.
3. Streets where a sidewalk and a trail exist: the sidewalk does not need to be cleared. (ordinance
amendment).
4. Streets were two sidewalks are adjacent: only one side needs to be removed. (ordinance
amendment).
5. Property owners clear all snow, but adjust the time (ordinance amendment).
6. City does all snow removal for the 46 miles of sidewalks (ordinance amendment).
7. Residents do not have to remove snow when sidewalk is immediately adjacent to curb (5.99 miles
total, 3.16 privately owned) (ordinance amendment).
8. Properties within the school walk zones remove snow, properties outside of that zone do not
(ordinance amendment).

Analysis
From a fairness standpoint, the Council may wish to either require all property owners to remove snow
from their adjacent sidewalk, or require none of them to do it. Variations from this theme increase
confusion, and with confusion, an increase in educational and enforcement costs.
From a planning standpoint, and with goals to increase mobility options for the community, sidewalks are
an asset. Sidewalks represent a tangible investment by the city and individual properties. To not protect
the use of these for four months each year seems counterintuitive.
A review of area communities including Anoka, Big Lake, Blaine, Champlin, Maple Grove, Otsego,
Ramsey, Rogers, and Zimmerman, show that all have ordinances similar to Elk River's in the sense that
adjacent properties are responsible to remove snow and ice from sidewalks. The amount of time given to
complete this work ranges from 12 hours (Maple Grove, Otsego, Rogers) to 48 hours (Blaine, Champlin)
In Zimmerman, only parcels east of Highway 45 are required to remove snow. In Blaine, the city manager
may exempt certain properties from the requirement for certain reasons, such as size of boulevard, and
plowing of adjacent streets.
Recommendation
Of the identified options, staff recommends the Council retain the status quo. If the Council feels cuts to
service are necessary and appropriate, staff recommends eliminating some of the sidewalks it currently
removes snow from. Regardless, all sidewalks should be cleared to afford the residents the ability to use
the sidewalks throughout the year to get to school, parks, shopping, and between neighborhoods. Staff
recognizes the challenges some residents have with snow removal, however, these difficulties system-wide
do not outweigh the benefits of a comprehensive sidewalk system provides.

Snow abatement process update
At the May 16, 2011, City Council meeting, the Council approved a new snow abatement policy,
which staff has begun implementation.
1. In late October, the City will notify residents of the requirements to remove snow from
public sidewalks via the publication of a notice and maps in the newsletter, newspaper,
website, and social media Cable TV and all other methods.
(Staff has purchased door hangers, and the 11/5 edition of the Star News will include an
advertisement reminding property owners of the responsibility of snow removal. The
notice will also be posted to the city website.)
2. Snowfall. After the initial snow fall, door hangers will be posted in neighborhoods with
significant delinquency.
3. Complaint received for the specific parcel
4. Property inspected within 24 hours
5. A door hanger is provided to the property in question, and other properties on the block,
as a reminder of the need to remove snow. (Staff will NOT phone property owners on the
need to remove snow. Not only is this time consuming, this is not generally effective,
and a written notice still needs to be provided.)
Do not use a colored paper, as the ink bleeds onto the door.
6. Certified notices sent to property in question and to other adjacent addresses in violation.
This is done to avoid enforcing one mid-block house, and ignoring the next door
neighbor, knowing that a cleared sidewalk does no good unless it is block wide at
minimum. A certified notice is sent out as required by law.
7. Wait 14 days
8. On the 15t1i day, an inspection is completed.
9. If the sidewalk is not cleared, the address is sent to our contractor, who must clear the
driveway within 48 hours.

7.5. Notice of Sportsman Club Meeting •
Mayor Dietz noted there may be three Councilmembers attending the Sportsman Club tour
and requested staff to notice this meeting.
Mayor Dietz recessed the meeting at 7:50 p.m. in order for Council to move to worksession.
The Council reconvened at 8:00 p.m.
Mayor Dietz questioned if the Volunteer of the Month information was on the website pet.
Ms. Allard noted she would check into it.
8.1. 2011 VisionYAction Steps. and Tasks
Mr. Barnhart presented the staff report. He asked Council to adopt the 2011 goals, identify
any priorities they have and to own them once adopted.
Councilmember Motin questioned how departments not listed on the 2011 goals would be
involved in the process.
Mr. Barnhart explained that even though the Parks Department is not listed as a lead on a
goal, d~ey would still be involved with the process and he further explained how what they
do would relate to the beautification goals.
Councilmember Zerwas noted the theme that jumps out as a priority consistently is
communication.

Spey as Described.
Mr. Barnhart presented the staff report. He recommends the funds come from Council
Contingenry.

Mayor Dietz stated he still has issues with the sidewalks that abut to the curb and. felt it
• wasn't fair to those property owners when the snowplows are dumping on the sidewalk.
Councilmember Westgaard expressed concern with the timeline and those property owners
who may take a vacation only to come back to violation notices.
Mayor Dietz stated it was important to have a way to notify residents and let them know
they are expected to keep their sidewalks clean.
Mr. Barnhart stated they could do a door hanger notice in October and also put some
information on the website and through social media tools. He stated staff could come back
with a cost estimate for the door hangers or identify other possible less expensive options
for a direct notification.
Council was amendable to this suggestion.
It was the consensus of the Council to approve the changes outlined in the staff
report.
8.3. Financial Model
Mr. Simon presented the financial model and reviewed the 2010 General Fund-fund balance
classifications and amounts. He noted this is an important tool for long-range planning and
decisions. The model is updated and will include the 2012 preliminary budget when
available.

Council consensus was to accept the budget timeline outlined in the memo.
8.6. Discussion on Economic Development Director Position
Councilmember Zerwas stated he would like to offer the open position to Annie Deckert
Councilmember Gumphrey concurred.
Councilmember Westgaard stated he is not opposed to this but questioned if she is qualified
as he hasn't seen her qualifications.
Mayor Dietz stated he wasn't ready to vote on this tonight as he would like to know Ms.
Deckert's qualification and have a chance to interview her.
Councilmember Motin stated he has spent quite a bit of time with her and is okay with
offering the position. He questioned if the position description should be changed to
manager versus a director as they have discussed in the past.
Mayor Dietz questioned what to do with Ms. Deckert's current position and whether it
should be changed back to Economic Development Assistant at a lower pay scale.
Councilmember Gumphrey suggested letting Ms. Deckert make the evaluation and to come
• back to Council with a recommendation.

$ACKGROUND/DISCUSSION
Last winter, members of the City Council received some complaints regarding several issues relating to the
City's practice of addressing the nuisance associated with snow removal, including:
A. The notification process
B. Removing snow when alternative routes are nearby
C. Removing snow when the sidewalk backs to the curb
D. Applying the policy to snowbirds
The City Code, section 46-34, Public NuisancesA~ectzng Peace and Safety (8) identifies "Sidewalks that are not
kept free of snow and ice during normal business hours in commercial and industrial zoned districts and
within 24 hours. after a snowfall within residential districts" as nuisances affecting peace and safety. 'T'his
section was part of the 1982 City Ordinance.
In response to the notification, staff has developed an alternative, while being sensitive to the users of the
sidewalk system and to those that, at minimum, follow City ordinances:
The minimum amount of time that can transpire between a snowfall and the city clearing the
sidewalk is 17 days, if somebody complains the day after the snow fall event. That is 17 days that
people cannot use the sidewalk, and are often forced into the street.
Typically, the time is closer to 28 days, as a complainant typically calls after several weeks have
passed. -
The process, currently:
1. Snowfall:
Ordinance requires removal within 24 hours (residential) and during normal business hours
(commercial).
2. Complaint received for the specific parcel.

This recommended process .change only affects the notification process. Staff is not recommending
changes to the policy as it relates to snowbirds, directly behind curb sidewalks, or sidewalks :adjacent to
other transportation routes-(B, C, and D above).
B. Other routes: It was discussed last winter to not require properties with. a sidewalk across. the
street from a city plowed trail to remove snow. Staff does not think this is in the. best interest of
the community, long term. If the mobility of all residents is important, and the cost to install
these improvements was a necessary expense, it is hard to argue that these improvements should
not be used for up to 5 months of the year. Further, it's very difficult for the Council to require
developers to pay for sidewalks and trails in the future.

C. Sidewalk behind curbs: Of course, ideally, a sidewalk is located 10 feet or so behind the curb,
leaving plenty of space for snow storage. In reality, in some cases, the sidewalk is placed directly
behind the curb, often to avoid additional costs, private improvements, or existing vegetation.
Staff suggests that future sidewalks be located as close to ten feet back of curb: For those
existing, staff believes these property owners should be responsible for the snow. Like property
owners in a cul-de-sac, there is `extra' snow they must deal with. (An argument that those
property owners pay a premium for cul-de-sac lots also holds to those lots where the property
owner received the benefit-of a sidewalk was placed near the curb, to avoid vegetation, private
improvements, etc.)
D. Snowbirds:. Staff does not recommend any changes to the process as they relaae to snowbirds,
or those that leave for extended periods of time. Not only it is impossible to know when
property owners leave far the winter or extended periods of time, the obligation still exist when
the owner leaves. Snow piles up, grass grows. These issues are part of the things that must. be
addressed prior to leaving, like stopping the. newspaper, forwarding the mail, and emptying the
refrigerator.
Clearly, there will be opposition to the proposal staff suggests, in part because the. alternative
requires: less work on the part of some of the property. owners. Regardless of the opposition, staff
believes strongly that the solutions suggested balances the needs of all, including users of the.
sidewalk system, property owners that clear a sidewalk because it is an obligation of being a part of a
community, property owners that clear a sidewalk because it's a requirement, and the City that must
enforce consistently the rules and regulations.
FINANCIAL IMPACT
Costs .for additional press releases, door hangers, and additional staff time have not been calculated.

6.2. Consider Changing Neon-Ma, oar Appointment Term Expirations •
Mayor Dietz questioned if the Council is interested in changing the non-Mayoral
appointment term expirations from the last`day of February to the last day of December.
Council consensus was to leave the term expirations as is.
6.3. Review Sidewalk Snowplowing Ordinance
Mr. Barnhart presented the staff report.
Discussion took place regarding the current polity on sidewalk plowing. Mr. Barnhart stated
that it would be challenging to change the sidewalk snowplowing ordinance at this point in
the year and is not recommended.
Larry Farber, 19404 Norfolk Street NW -stated that he lives in the Highland
neighborhood. He explained that the sidewalks in his neighborhood have never been plowed
and expressed concern over receiving a certified letter so far into the snow season. He stated
that a plowed walking trail exists on the other side of the road and one cleared side should
be sufficient. He also asked that the city address lots with no area for snow storage between
the sidewalk and the road.
Council consensus was to discuss amending the sidewalk snowplowing policy in May.
Suggested changes include the schedule on which letters are sent out. It was suggested that
staff send the first letter regular mail with a seven day deadline and if no compliance, send
the next letter via certified mail with an additional seven days to comply. Another suggestion •
was to discuss a better way to notify residents of the sidewalk snowplowing requirements
(newsletter, postcard, etc.)

Other Business
Mayor Dietz explained that the city recently passed an ordinance that prohibits commercial
buildings from putting in private wells. He stated that the well drillers have approached the
Legislature asking them to overturn similar city ordinances. Council consensus was to
approve Mayor Dietz's request to lobby at the Legislative level on behalf of the city.
8. Council Updates
8.1. Employee Meeting~Ugdate -Mayor Dietz
Mayor Dietz indicated he has met with several city employees and department heads over
the past few weeks. He reviewed some of the items that were discussed including employee
promotions, pay, compensatory time, and furloughs. The Council asked that compensatory
time, in particular as it relates to the street department, be discussed at a future meeting.

SUBJECT: Sidewalk Snowplowing Ordinance
Mayor Dietz requested the City Council review the sidewalk snowplowing ordinance.
City Code X46-34, addresses Public Nuisances Affecting Peace and Safety-The following shall be
declared to be nuisances affecting public peace and safety:
Section (a)(8) "Sidewalks that are not kept free of snow and ice during normal
business hours in commercial and industrial zoned districts and within 24 hours after
a snowfall within residential districts"
History
This section was part of the 1982 City Code. In 2008 Council directed staff to enforce the
abatement ordinances based on complaints. In winter 2008 the city started enforcing the
sidewalk ordinance, but because the code enforcement process was developing, zero
complaints were received. In 2009, with greater awareness of the ordinance, the city received
additional complaints:

On January 19, 2011 staff received a complaint regarding the sidewalk on the north side of
Highland Avenue. Code enforcement staff investigated and found that the sidewalk had not
been cleared. As is practice, staff sent letters to other properties on the same block,
recognizing that enforcing a snow removal requirement on one parcel, but not addressing it
at their neighbors, is a waste of resources and time and does not address the original
complaint Seven notices were sent. On January 22, 2011 a property owner received the
letter and contacted the Mayor. A request to appeal has not been received by staff from the
property owner.

Along the north side of Highland Avenue there are 19 properties. Six have cleared their
sidewalks while the other 13 have not.
Abatement Procedure
Because snow removal has been deemed a nuisance and staff has been directed to abate
nuisances, the city follows the nuisance abatement. procedure as required by ordinance. The
nuisance abatement procedure includes:
Sending a certified letter outlining the violation and the amount of time they have to
complete the work on their own (ordinance allows 14 days).
o The letter includes a copy of the City Code which details the abatement and
appeals process.
o The letter includes a statement that the work will be done and costs incurred
will be assessed by the city to the property owner if the property owner
doesn't complete the work by the required date.
Council may recall that the city recently accepted the bid from Greenscape Companies for
sidewalk plowing abatement. Their costs are a flat $70 for a lot with 0 - 100 feet of sidewalk
and $200 for a lot with 101 - 200 feet of sidewalk. We found with prior contracts there was
little control over the amount of time a contractor would spend on a given lot and since the
fee was based on the amount of time there was a large discrepancy in the amount charged.
To address this we went with a flat rate.
Discussions with Property Owners
In response to the concerns of the property owner, staff met with the individual who
contacted the Mayor. During our conversation three areas of concern were discussed
1. The property owner objected to the receipt of a certified letter as first notice.
2. Snow storage: Some lots may have little space to store snow between the curb and
sidewalk from the street.
3. If the property owners had known about the requirement, they may have been able
to keep ahead of the snow.
It is staff's opinion that changing the nuisance ordinance will not satisfy the primary
concerns. However, the city could and should take a more aggressive approach in educating
the public and working on our process to find ways to better affect compliance.
Options
Understanding that there may be some desire to alter the code enforcement practice in
response to comments received, staff has identified options:
1. Amend the nuisance ordinance to state that if the city removes snow from one side
of the street, the property owners on the other side do not need to remove snow
from their sidewalk.
2. Amend the ordinance to remove uncleared sidewalks as a defined nuisance. Staff
does not recommend this option as mobility is as important in the winter as it is in
the summer.

3. Amend the city's sidewalk plowing policy to clear more or different sidewalks
throughout the city. This will impact city financial resources and may require a tax
increase depending on the amount of change made. Staff supports this if maintaining
sidewalks is deemed a high priority.
4. Amend the abatement procedure. As noted above, the current abatement procedure
requires 14 days for the property owner to complete the work from the date of a
certified notice before the city may take action. Staff has struggled with this because
by the time a resident complains .their frustration has reached a high level. And
forcing them to wait another 14 days just adds to that level. On the other side, a
complaint we frequently receive is that they first heard of their potential violation via
a `harsh' certified letter. A solution to both problems is to amend the process, giving
people 7-10 days after the certified letter, but a certified letter is the second letter
sent, after a friendlier warning letter is sent. It should be noted that in all cases,
except nuisance abatement cases, two letters are sent.
5. Maintain the current nuisance abatement process.
Impact to the Vision
One of the components identified by the Visioning Committee was the question of
consistent application of code enforcement. This should not be interpreted to never change
policy or ordinance, but rather, very carefully consider the "why" in amending the policy or
ordinance.
The city is in the third year of code enforcement and in that time the vast majority of
residents have completed the work. Predominantly, the properties that were abated were
vacant. This point was added because it seems to point out that the system generally works
toward compliance.
Further, staff s professional recommendation has been to avoid major departures from
established policies or ordinances based on relatively minor (in number) complaints. If
changes to policy are appropriate, it is suggested further study .precede an amendment.
Staff does not suggest any changes to the nuisance ordinance but is seeking further direction
from Council on reviewing changes to the code enforcement process.
