Staff recommends the Parks and Recreation Commission support the acquisition of Bailey Point
through a DNR grant and a Mimiesota Land Trust conservation easement.
BACKGROUND/DISCUSSION
The City held a public information update meeting on Bailey Point December 7. Over 25 people
attended the meeting to discuss the land acquisition process involving both the DNR grant and the
Minnesota Land Trust. Most of the people in attendance were in support of the Baily Point
acquisition. The DNR already approved a grant to the Ciryto acquire the Bailey Point property.
Part of the value of this acquisition ($20,592) will be reserved to mitigate the loss of a similar value
of the parkland at Lions Park due to the construction of the Boys & Girls Club building.
City Council approved at the August 1, 2011 City Council meeting the funding for the city portion
of the Bailey Point acquisition should the City receive the grant award from the DNR. The City has
unti12013 to accept and proceed with the grant agreement. This acceptance includes the mitigation
of the issue of Lions Park which allows the city to be eligible for future DNR funding programs.

The Minnesota Land Trust is currently working with the city and the owner of the property to
convey a conservation easement to the Land Trust. The propertywill become a perpetual easement
with restrictions placed upon it that are common for a passive parkin the floodplain such as limited
parking, accessible trails and park benches. The conservation easement restrictions and agreement
will be reviewed by the City Attorney once they are completed.
Sarah Strommen from the Minnesota Land Trust will provide a presentation at the Parks and
Recreation Commission meeting to discuss the Trust and conservation easements.

The Minnesota I~storical Society has contacted the City to require that an archeological survey of
the site be conducted (as outlined in the DNR grant agreement). We are currently working with an
approved archeologist to sluveythe site this spring. The survey needs to be completed prior to any
final reimblusement of DNR grant monies. Staff is working on acquiring funding for this
archeological survey through various state/university grant funds.
The cost to the City for the development of the site is m;t,;mal as according to the concept plan
submitted for the grant. This includes the cost of a gate, parking area and trails. The cost to the city
for the acquisition of Baily Point for the DNR grant is $39,558 plus the $20,952 for the Lions Park
mitigation. This is s total expense of $60,150 for the City to acquire the BailyPoint property.
Proposed funding soun;e for this project has been determined and will be recommended to City
Council.
Staff is recommending that the Parks and Recreation Commission approve the acquisition of Baily
Point
