BACKGROUND/DISCUSSION No objections were received during the final advertised 10-day comment period for the 1715[ Area AUAR. The attached memorandum prepared by WSB & Associates summarizes the process to arrive at the final approval of the AUAR document. Staff is recommending adoption of the final AUAR document which will be kept on file at the city offices. Adoption of this final AUAR completes the environmental approvals needed to begin development of the 1715` Avenue Area. I I - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING THE FINAL ALTERNATIVE URBAN AREAWIDE REVIEW (AUAR) FOR THE 1715L AVENUE AREA STUDY AREA WHEREAS, an AUAR has been completed fox the project pursuant to Minnesota Rules 4410 and identifies and assesses the environmental impacts and mitigation measures associated with the 1715` Avenue development area. WHEREAS, the 1715` Avenue development area is located on approximately 253 acres in southern Elk River in Sherburne County as shown in the AUAR; WHEREAS, three proposed development scenarios were evaluated as part of the AUAR process and one is in conformance with the Comprehensive Plan; WHEREAS, the 17150 Avenue development area AUAR was distributed for one 30-day and one 10-day comment period; WHEREAS, comments received on the AUAR have generated information adequate to determine mitigation measures associated with the potential development ul this area; WHEREAS, the comments received are included in the public record for the AUAR; WHEREAS, no objections were received to the AUAR; WHEREAS, development in the 1715f Avenue area is expected to comply with all the city and review agency standards as well as the mitigation measures outlined in the AUAR. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ELK RIVER, MN: The Ciry of Elk River adopts the Final 1715` Avenue Alternative Urban Areawide Review dated November 18, 2011. This resolution was adopted by the City Council of the City of Elk River on the 19`'' day of December 2011, by a vote of Ayes and Nays. John J. The Final AUAR evaluates potential environmental impacts associated with development of the 253 acre study area. Three different development scenarios were evaluated for potential environmental impacts within the AUAR. The scenarios evaluate differing amounts of commercial, light-industrial, and residential land uses. As part of the AUAR development process, the Draft 171St Avenue Area AUAR was submitted fora 30-day public comment period, which ended on October 19, 2011. One public meeting was held during this time to inform the public of the process, to answer questions, and to obtain public input. Comments were received from various agencies and members of the public. Responses to the comments were prepared and included in the Final AUAR. The Final AUAR and the responses to comments were then submitted for the required 10-day comment period. This second, 10-day comment period ended December 9, 2011. The Department of Natural Resources and the Minnesota Pollution Control agency sent correspondence stating that they had no further comments. No objections to the Final AUAR were received by the City. Therefore, the City can move forward and consider adoption of the Final AUAR. The item before the City Council is to consider adopting the Final AUAR. By adopting the Final AUAR, any redevelopment that is proposed within the study area will need to meet the mitigation measures outlined in the document as well as be within the density analyzed in the k:101992-p001adminldocslgeneral documentslmemo - 121311 - jfemrite.doc December 13, 2011 Page 2 of 2 AUAR. If the density is exceeded or mitigation measures are not met, the AUAR will need to be updated. Further, Minnesota Rules requires that the AUAR be updated every five years until redevelopment within the study area is approved. It should be noted that adopting the Final AUAR does not authorize any redevelopment nor does it indicate the City is selecting a specific development scenario.
