ACTION REQUESTED
Mayor Dietz to open and close the public hearing. If Council wants to review the fee schedule again, this
item will be added to a future agenda. Otherwise the following action is requested:
1. Council motion to adopt the 2012 master fee schedule ordinance..
2. Council motion to adopt the resolution for summary publication of the ordinance. A foux-
fifth's vote is required.
BACKGROUND/DISCUSSION
Annually, the Council reviews proposed fees fox the upcoming new year. Proposed changes axe noted in
red in the attached fee schedule ordinance. Fees are adjusted in order to cover the cost of providing
services to customers.
Items to note include:
Billiard Hall
Fee has been in place but was not listed in fee schedule.
Commercial Plan Review
The .5% plan check fee is not a new fee. It is a part of the existing permit fee that will be
collected at time of permit application. It will only be collected on new and remodel
commercial, industrial, and institutional building permit applications. It would be a non-
refundable fee that will be applied to the total building permit fee. If an applicant chose not
to proceed with the project that was applied for, this .5% would be retained by the city to
offset costs incurred in both time and material.
Map Copies
Fee increased to more accurately reflect actual costs.
Park Dedication Fees
This fee is proposed to change by 2% and was discussed by Council during the five-year
review of the Park Dedication Fund.

Sanitary Sewer User Fee and the Sewer Access Charge (SAC)
These fees were reviewed by Council during the budget review of the Sanitary Sewer Fund
on October 11, 2011. The Sanitary Sewer User fee is proposed to increase by 1.5% and the
Sewer Access Charge is proposed to increase by 2%.
Water Access Charge
This fee was approved by the Elk River Municipal Utilities Commission on October 11,
2011. It increased by 2% to be consistent with the city's SAC rate.
Development Fees
Planning Manager Jeremy Barnhart analyzed development fees and has made various
changes as explained in his attached memo.
Escrow for Dangerous Dog Hearing
This fee was increased in order to capture actual costs.
Parking Fines
Fees have been in place but haven't been listed in the previous fee schedule. These fees are
required to be listed per city ordinance. Some of the fees have changed because they were
listed incorrectly in the last fee schedule. The winter parking fee was reduced to match the
other parking violation fees. The prosecuting attorney has reviewed these fees with the
judges, who have approved them.
The Elk River Municipal Utilities Commission approved their fees on October 11, 201.1. The city
attorney had recommended these fees be listed in the master fee schedule ordinance.

A RESOLUTION APPROVING NOTICE OF
SUMMARY PUBLICATION OF ORDINANCE #I I-
AN ORDINANCE ADOPTING THE 2012 MASTER FEE SCHEDULE
WHEREAS, on December 19, 2011 the Elk River City Council adopted Ordinance 11-
_ approving the 2012 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the
Ciry Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2012 Master Fee Schedule lists fees and charges for Administrative,
Financial, Environmental, Planning, Development, Building, Parks and
Recreation, Fire, Police, and Elk River Municipal Utility services along with
code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any
person at the office of the Elk River Ciry Clerk, 13065 Orono Parkway,
during regular business hours - 8:00 a.m. to 4:30 p.m., Monday through
Friday; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council, by at least four-fifths
vote, authorizes the publication of the title and summary of Ordinance 11-
_and that Ordinance 11-_ shall become effective on January 1, 2012.

AN ORDINANCE OF THE CITY OF ELK RIVER ADOPTING
THE 2012 MASTER FEE SCHEDULE
The City Council of the City of Elk River does hereby ordain as follows:
Section 1.
1. Policy and Purpose: By the enactment of this Ordinance, the City Council
intends to establish fees and charges required by the City Code for the year 2012
and to comply with Minnesota Statutes, 462.353, sub. 4.
2. Fees and Charges: The fees and charges for the city far the year 2012 are as set
forth on the attached Exhibit A.
3. Application: Where a direct conflict exists between the amount of a fee or charge
set by any provision of the City Code and a fee or charge set by this Ordinance,
the fee or charge set by this Ordinance applies.
Section 2. This ordinance shall become effective January 1, 2011.
Passed and adopted by the City Council of the City of Elk River this 19th day of
December, 2011.

SUBJECT: Development Fees
After careful review of the development fees imposed by the city to offset costs incurred by
the review of development applications, I feel a shift in how these fees are applied is
necessary. Currently, a fee is applied based on the application, with an escrow set up for
legal, engineering, and recording fees, if anticipated.
This process is acceptable if similar projects require the same amount of time and resources.
In the past several years, however, staff has noted that projects require a great deal of
additional time and effort. For instance, this year alone, Pizza Ranch, Crossing Church, and
Ashley Furniture have required more staff time after approval than before, with their
concerns related to what was approved and desiring changes to landscaping, phasing, etc.
This staff time spent after approval is not reimbursed; the taxpayer foots the bill for these
changes.
The attached spreadsheet highlights the expected charges for applications that require a
public hearing, which amount to about $275, and includes actual costs and clerical staff
costs.
The application fee (for conditional use permits/interim use permits, plats, variances, land
use applications, zoning amendments, and other applications requiring a public hearing)
would be $275 plus the escrow. Staff hours would be billed monthly at $50 per hour and
applied to the escrow. The Council has given staff the authority to reduce the escrow, staff
will continue to do this on certain projects. The escrow fee is not new but has been
highlighted to show the inclusion of staff time. On projects requiring multiple land use
applications (conditional use permit and zone change, for example) only one escrow would
be collected, though actual staff hours would be billed for the project. Applications without
a public hearing are about $100.
In an era where tax dollars spent are being scrutinized, it is prudent to charge the users for
the time they require.
