Request Consider a request by Phoenix Enterprises for final plat approval of Woods at Hillside Fourth Addition. Location The property is located on the north side of 193ra Avenue east of Zane Street. The preliminary plat for the Woods at Hillside, approved on April 19, 1999, consisted of 61 single family lots on 43 acres. The final plat for the Woods at Hillside 1~ Addition included 15 single family lots and the final plat for the Woods at Hillside 2nd Addition included 15 single family lots. The final plat for the Woods at Hillside Third Addition includes 16 single family lots. The final plat for the Woods at Hillside Fourth Addition includes 17 single family lots. One Layout Lots Seventeen lots will be platted as part of Woods at Hillside Fourth Addition. The lots are consistent with what was approved on the preliminary plat. Streets Two ctd de sacs are proposed as part of this final plat, Xavier Street and 193rd Court. The streets are consistent with the approved preliminary plat. Gradinq, Draina.qe and Utilities Grading, drainage and utility issues are addressed in the City Engineer's memo. Landscapin.q Landscaping will have to be provided per the City Ordinance, which is two trees per lot and four trees on comer lots. Park and Recreation The Park and Recreation Commission recommended cash to meet the park dedication requirements. Recommendation Staff recommends that the City Council approve the final plat for Woods at Hillside Fourth Addition with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. 2. THE DEVELOPER SHALL ENTER INTO A DEVELOPER'S AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE DEVELOPMENT. 3. THAT THE MAILBOXES SHALL BE CLUSTERED. 4. A SEALCOAT FEE IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 5. AN ENGINEERING ESCROW IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 6. PARK DEDICATION FEES FOR 17 LOTS AT THE CURRENT RATE BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 7. STORM WATER MANAGEMENT FEES IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 8. THE DEVELOPER SHALL PROVIDE AT LETTER OF CREDIT FOR 100% OF THE COST OF THE IMPROVEMENTS. 10. A WARRANTY BOND SHALL BE PROVIDED AFTER THE IMPROVEMENTS ARE ACCEPTED BY THE CITY AND SHALL BE HELD FOR ONE YEAR. 11.ANY TREES OFF SITE OR ON SITE, NEAR THE LIMIT OF GRADING THAT ARE TO BE PRESERVED, SHALL BE FENCED WITH A SNOW FENCE AT THE DRIP LINE TO PREVENT GRADING, COMPACTION, OR STORAGE OF EQUIPMENT, DEBRIS OR MATERIALS. STAFF SHALL INSPECT FENCING PRIOR TO GRADING COMMENCING. 12. As you are aware, this is the last of the final plats in this area of the "Woods" in the Hillside Estates area. The plat consists of two cul-de-sacs and a total of 17 lots. The plat does follow the preliminary layout for the entire "Woods" area. There are two drainage and utility easement issues that should be revised on the final plat. There will need to be a watermain loop into each of these cul-de-sacs to comply with the Elk River Municipal Utilities policy that watermain is looped wherever possible. In fact, Xavier Street has a stub off of 193rd Avenue at the southwest comer of Lot 4 for the purposes of looping the watermain. The drainage and utility easements on the perimeter of Lot 4 should be revised to accommodate this looping. Currently, 193rd Avenue is not complete to the east plat line. Therefore, there is no watermain extension currently existing for the looping of 193rd Court. However, there should be an enlarged drainage and utility easement between Lots 14 and 15 to get watermain out of 193r~ Court to the park strip, where it could be ultimately extended and looped to 193rd Avenue. With these minor revisions, we would recommend approval of the final plat of The Woods at Hillside Fourth Addition. If you have any questions regarding these comments, please call. Section 30-374 of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Coundl; and WHEREAS, a preliminary plat of the Property was approved by the City Council on April 19, 1999; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCII.
