Ordinance Amendment to Housing
Maintenance Code, Section 1007.14-
Update on Housing Inspections
The current wording in Section 1007.14 of the Housing Code may cause the
city to require building owners to add foyers and communication systems to
buildings that were constructed prior to the adoption of the Housing Code.
Therefore, we would like to change the wording of that section by separating
out the requirement for a fire department key box, and by adding an
exception eliminating the locked building entry door and communication
system requirements for existing buildings.
The following are rationales for amending Section 1007.14 of the City of Elk
River Housing Ordinance.
The Housing Ordinance must comply with the State Building Code.
Under The State Building Code this department generally cannot require
an existing building to meet current standards without there having been
a change of occupancy or use. Section 1007.14 of the ordinance, as
written, would require that the existing buildings be brought to a
standard not in place at the time of its construction placing an undue
burden onto the owners of the property.

This matter could be corrected by separating from paragraph 2, the
requirement for a lock box containing certain keys, and by allowing an
exception to the requirement for locked foyer doors, and a communication
system for buildings butt before the adoption of the Housing Ordinance.
I will be available Monday evening to answer any questions you may have
regarding this issue. I would also like to present a verbal update on the
status of the housing maintenance inspections.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 1007.14 OF THE CITY CODE OF ORDINANCES
The City Council of the City of Elk River does hereby ordain as
follows:
Section 1. Section 1007.14(2) of the City of Elk River Code of
Ordinances shall be amended to read as follows:
2. Access - When access to a dwelling unit door is
gained through a common corridor or entrance in a dwelling
in which four (4) or more dwelling units share a common
entrance or corridor, an approved system of controlled
access shall be maintained for each multiple family
building to control access. The security system shall
consist of locked building entrance and foyer doors, and
locked doors leading from the hallways into individual
dwelling units. Dead-latch type door locks shall be
provided with releasable lever knobs -~e~----e~ee-~e~s-~- on the
inside of building entrance doors, with security strike
plate with three (3) inch screws, and with key cylinders
on the outside of the building doors. Building entrance
door-latches shall be of the type that are permanently

communication system or device such as an intercom,
telephone, audible bell or buzzer or other approved means
of making contact with the tenants must be provided.
Section 2. That Section 1007.14 be amended to add 2.1. Exception
2.1. Exception - All multiple family dwellinq in existence
at the time this chapter was adopted which were net
locked building entrance doors, shall not be subject to
the requirements of Section 1007.14.2
Section 3. That Section 1007.14 be amended to add 3. Lock Box
3. Lock Box. - An approved lock box with building entry
key, boiler room key, laundry and common area keys, all
marked individually, must be provided and accessible to

enumerated keys must be present in the lock box at all
times.
Section 4. - That Section 1007.14(3), Approved Lock, remain as is
except to be renumbered to (4).
~. A~roved Lock - Every door that provides ingress or
egress for a dwelling unit within a multiple family unit
shall be equipped with an approved lock that has a dead
locking bolt that cannot be retracted by end pressure,
security strike plate with minimum of three (3) inch
screws and door viewer; provided, however, that such doors
shall be openable from the inside without the use of a key
or any special knowledge or effort.
Section 5. - That Section 1007.14(4), Maintenance, remain as is
except to be renumbered to (5).
%5. Maintenance - Every window, exterior door and
hatchway shall be tight and shall be kept in repair.
Every other window other than a fixed window shall be
capable of being easily opened and shall be equipped with
screens between May 1 and September 30, inclusive, of each
year. Every window, door, and frame shall be constructed
and maintained in such relation to the adjacent wall
construction as to completely exclude rain, vermin,
rodents, and insects from entering the building. Ail
ingress, egress, and interior doors and windows shall be
kept free of holes and punctures. Sliding doors shall be
equipped with an anti-lift and removal lock. Ail windows
shall be provided with locks.
Section 6. That this ordinance shall take effect upon pubhcation as
provided by law.
Passed and adopted by the City Council of the City of Elk River this 2-d day
of February, 1998.
