Approve the administrative subdivision as presented.
BACKGROUND/DISCUSSION
The Elk River Economic Development Authority (EDA) owns lot 1, block 1 of Northstar Business Park.
An adjacent business has expressed interest in obtaining a portion of the lot, as they do not require the
entire parcel for their expansion needs. At the January 9, 2012, meeting, the EDA directed staff to
process the split.
The administrative lot split, authorized by section 30-391, results in a certificate of survey and allows for
the subdivision of land that was not the result of a previous administrative subdivision, creates four or
less lots, and does not require right-of--way.
The EDA proposes the creation of two parcels. Parcel A, the northernmost of the two, is 7.33 acres.
Parcel B is 4.8 acres. Both lots maintain frontage on a public street and include the minimum size (one
acre).
Access
Access to both sites will be via Tyler Street. An ingress and egress easement is proposed along the
northern 66-feet of Parcel B to the benefit of Parcel A. Staff recommends access control from Twin
Lakes Road, as that road was not designed nor intended for direct access.
Easements
It is customary that a utility and drainage easement be provided over a shared property line. Additionally,
a utility easement will be needed to protect the proposed relocated storm sewer that currently runs along
the southern boundary of the project (To facilitate the expansion of the building on the adjacent lot.)
These two easements can be recorded together when the lot is sold.
Park Dedication
Section 30-327 (d) does not require additional park dedication where park dedication has been previously
paid.
