Overview The conditional use permit request involves converting approximately 12,000 square feet at the south end of Elk River Mall into space for a health club. The space being converted was formally occupied by Pamida and is now being divided with a portion going to the Elk River Theaters and the balance being leased by "The Gym". The proposed health club will consist of a variety of free weight equipment, weight machines, cable machines, cardiovascular machines, and an aerobic dance area. Hours of Operation The following are the expected hours of operation: · Monday through Sunday - 5 a.m. to 11 p.m. The average number of customers frequenting the club in any one day will be approximately 150 to 175. The busiest times during the week will most likely be Monday and Tuesday from approximately 5 p.m. to 8 p.m. (Please refer to the attached letter from Ted Harrison) Parking As discussed with the movie theater expansion, required parking appears to be the most critical issue for the shopping center. As part of the report to the Planning Commission, site plans have been attached showing additional parking areas that could be developed just south of the mall and adjacent to the space proposed to be occupied by "The Gym." The owners of the mall did not foresee a problem given the theater and the gym having different peak hours for a majority of the week. According to Ted Harrison, owner of The Gym, 35 to 40 people will be in the club at any one time. Based on the parking ratios for required parking, this number is less than the possible number of customers if the same space was used for retail purposes. Twelve thousand square feet of retail space would require 60 parking spaces; 20 to 25 more than the proposed health club. The proposed use does a good job in trying to reduce the parking demands in diversifying the tenant mix allowing the peak traffic to occur at different times. Si~na~e The applicant has indicated that they would like to have signage at both the west and east elevations of the building. Signage will consist of individual letters identifying "The Gym." HOURS OF OPERATION WILL BE MONDAY THROUGH SUNDAY, 5 A.M. TO 11 P.M. SIGNAGE SHALL CONSIST OF INDIVIDUAL LETTERS ON BOTH THE EAST AND WEST ELEVATION OF THE BUILDING. o APPROPRIATE BUILDING PERMITS BE OBTAINED PRIOR TO STARTING ANY INTERIOR CONSTRUCTION. IF A PARKING PROBLEM ARISES IN THE FUTURE, THE PARKING AREA IMMEDIATELY SOUTH OF THE BUILDING SHALL BE IMPROVED. A DETAILED SITE PLAN MUST BE SUBMITTED FOR STAFF REVIEW PRIOR TO COMMENCING CONSTRUCTION. Location Lot 1, Block 1, Elk River Plaza Zoning/Land Use PUD (Planned Unit Development) / HB (Highway Business) Attachments · Location map · Site plan · Conditions of previous approval Background In November of 1993, Elk River Shopping Center requested a similar conditional use permit to expand the Elk River Theater from 5 to 10 screens. Along with that conditional use permit there was interior mall modifications to accommodate the new entry area into the theater. Besides the improvements to the building, the shopping center also made various parking lot improvements, converting what was once green space into additional parking stalls to accommodate future parking needs. 13065 Orono Parkway · P.O. Approximately 26,000 sq. ft. will be remodeled for the theater's purposes. The balance of the Pamida space will be leased to a fitness club (The Gym) which is the subject of another conditional use permit. All of the theater's expansion will involve interior remodeling with no exterior improvements. A majority of the issues associated with the expansion of the theater will involve the building official as it relates to proper exiting and other building code related matters. Parking Four years ago when the theater came before the Planning Commission and City Council to expand the theater from 5 to 10 screens, a complete parking analysis was done of the shopping center. With the additional parking stalls developed, the Elk River Shopping Center met the parking requirements with no stalls to spare. The ordinance requires movie theaters to have one parking stall for every four seats. Based on the 10 screens, seating capacity of 1,700 was planned for and parking requirements calculated based on these numbers. The additional 8 screens may bring on approximately 1,500 additional seats, requiring an additional 375 parking stalls. Subtracting the required parking for the 25,800 sq. ft. of retail space that will now be used by the theater, a total of 246 parking stalls would be required. As previously mentioned, there is no room left on site to provide additional parking. With the County Market space presently vacant, parking at the shopping center should not pose a problem at this time. However, as the mall begins to fill its vacant space, the management of parking amongst the tenants will become more critical. The key with developing the mall will be to introduce the appropriate mix of tenants whereby the parking demands for each of the tenants will be slightly different to balance the parking needs for the center. Siena~e The theater is proposing to add 2 to 3 additional signs on the building elevation facing Highway 169. These cabinet signs will be similar to those signs presently in place to advertise the movies that are showing at the theater.
