ACT DECISION (WINDSOR
WOODS)
Marly Glines of Dynamics Design & Land Co. has made application to fill 6,900 sq. ft. of
Type 2 wetland to accommodate the plat of Windsor Woods. The wetland area proposed
to be filled is located in the Northwest Quarter of the Northeast Quarter, Section 17,
Township 33, Range 26, Sherburne County, Minnesota (see attached map).
FINDINGS
1. The original delineation was completed by Mary West on 12/5/97 and the
replacement plan was provided by John Oliver & Associates on 12/23/97.
The Technical Evaluation Panel reviewed the proposal on January 6, 1998. It was the
finding of the technical panel that the area proposed to be filled was unavoidable due
to lack of access to the property. The area impacted by the road access was reduce,
however, by increasing the adjacent side slopes and making the low point of the
proposed road be centered in the wetland.
On January 8, 1998 the city sent out combined notification of the proposed filling and
replacement plan to the appropriate parties and did not receive any negative
comments on the proposal.
RECOMMENDATION
Staff recommends approval of both the proposed filling and mitigation plan for this
project with the following stipulations:
1. That only the run-off from the proposed road and not overflow from the
adjacent wetland be filtered through the proposed sedimentation ponds.
2. That the cost of the proposed mitigation plan be covered by a letter of credit in
favor of the city for a period of one year after completion.
3. That a restrictive covenant be recorded on the mitigation areas.
4. That Sherburne County approves the plat's drainage plan.
5. That the developer submits a report on the wetlands to the city one year after
their construction.
