A variance is obtained from the Shore land regulations. 2. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all require permits. 3. The development shall meet all applicable fire codes. 4. All signage must receive a permit prior to construction and installation. 5. A 12 foot easement for trail purposes shall be provided immediately south of the existing curb line on the south side of the site. Applicant Vanman Architects and Builders, on behalf of Elk River Lutheran Church and the ELCA Address 729 Main Street 60 Day Rule The City must take action by March 30, 2012 OVERVIEW The applicant is requesting Conditional Use Permit approval to operate an institutional use in the Downtown District (DD) zoning district. BACKGROUND/PRECEDENT Churches are classified as an institutional use in the Elk River Zoning Code; institutional uses are a conditional use in most Elk River Zoning districts, including the Downtown District. Elk River Lutheran Church formed in 2010 and they moved into a temporary space in Northbound Crossing late that year. They received an interim use permit for that location, which is to expire in December 2015. These requests include: four expansions, three new locations, and one interim use permit for a new location. Funeral Old Town Downtown Home District/ Shore land Overla APPLICABLE REGULATIONS Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with tra~c on adjacent and neighboring public thoroughfares. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for CUP as outlined, it appears that the request is consistent with all of these standards. ANALYSIS Elk River Lutheran Church is proposing using the former First National Bank building at 729 Main Street for their church. Improvements to the site include the removal of the drive-through lanes in the front of the building, including the decorative structures and adding approximately 3,000 sq ft to the north and northeast corner of the building. Interior modifications. The interior of the structure will be remodeled, and on the main floor, a 365 seat sanctuary will be located in the new addition area and the northern portion of the original building. Also on this level will be the fellowship lobby, kitchen/coffee area, offices and a nursery. The existing deck on the south side of the building will be modified and enlarged. Upstairs will be a children's worship area, with 6 classrooms, storage and an office. Downstairs from the main level (and level with the lower parking lot) will be rooms for storage, music,. youth a kitchen, and a community room. The narrative suggests that the community room would be a place for community use for events and larger meetings. In summary, the church would provide seating for 365 in the sanctuary, 6 classrooms, and 3 offices. Exterior modifications. The Downtown District has developed some detailed design requirements for improvements in the area. There are three goals with these requirements: 1) to promote and create high standards of creative, traditionally based architectural design, 2) to reestablish the `historical' architecture found along the south side of Main Street and the west side of Jackson, and 3) to bring the structure back to its original appearance. Based on the elevations provided and the materials listed, it appears that the church intends to model the Bank of Elk River building, completed in 2006. The addition will include limestone stone as prominent features; brick to match the brick existing on the structure. The roof will be shingled, with laminated wood beams visible. Non brick and limestone areas will be stucco, painted beige. The structure uses required materials (limestone, brink, stucco) in the new addition, and materials consistent (wood) with other Downtown Districts parcels. The church is also proposing a small children's play area in the rear of the building, in space currently occupied by parking and a generator. Public space. The applicant proposes asemi-public labyrinth on the north side of the building, as another gathering space for the public. Further information may be found in the applicant's narrative. Access. Access to the site will be via an existing curb cut onto Main Street. The curb cut onto King Avenue will be removed. An easement is provided through portions of the upper and lower parking lot, providing the city portions of those lots with access rights. Typically, the biggest concern with regard to placement of a church in an existing neighborhood is the issue of parking and traffic. An inadequate supply of parking or traffic routes increases impacts on the adjacent properties, often residential parcels. Parking for a church use is based on the design capacity of the main area. The church seats 365 persons. The parking requirement is 1 space per three seats. For this church, the requirement is 122 parking spaces. There are not 122 parking spaces on site. It is not unusual fox a church moving into an existing neighborhood to fail to meet the parking demand. A recent example, in 2007, Holy Trinity did not meet the requirement. The Council accepted over flow parking among the neighboring streets. The other 8 churches in the last five years met the parking requirement, including Wat Thai and the Crossing Church. To satisfy the parking requirements, the church proposes: 22 parking spaces more or less on the subject parcel 45 parking spaces by written agreement with Dare Funeral Home. This lot is immediately to the west. 37 parking spaces by agreement with 1st National Bank at their main office. (Northwest of the site.) 24 parking spaces 15` National Bank owns as part of the King Avenue parking lot. 128 parking spaces It should be noted that the spaces on the 15t National Bank site are northwest of that building, and likely not visible from the proposed church. Parking spaces are more likely to be used if they are visible to the destination, although in a downtown environment this perceptual requirement decreases. The peak time for the church is typically Sunday mornings and Wednesday evenings, although this varies based on the individual programs offered by the use. The peak times for the church are expected to differ from the peak times of 1st National Bank and Dares. In addition to the spaces identified by agreement, there are 196 public parking spaces in the King Avenue lot and the riverfront lot. This does not include a number of on-street spaces. The church believes that their peak time will not conflict with the peak time of the adjacent businesses. The number of handicapped spaces is based on the total number of spaces required, for the church is it 5 handicapped spaces. Three are shown on site, the church requests that the City designate two parking stalls on Main street for mobility impaired parking. This would create 5 spaces. This would require the modification of the curb on main street. Staff recommends that the additional spaces be provided in the back of the building. This will result in the loss of one space, for a access ramp. Si~nage. The church proposes two signs, plus two crosses. The signs are proposed for the northeast side of the new addition (capturing west bound Main Street traffic) and the east side of the existing building (facing the existing public parking lot.) Due to the density of the downtown area and visual overload, signage requirements in the downtown are not the same as in highway business areas. Though no revised plans have been submitted, the applicant proposes a 22 sq ft sign and a 10 sq ft sign. These signs meet the requirements. The strict application of the sign definition could include classifying the crosses as signs, although in the past, the City has not done so. Sidewalks/ Trails. The City has requested a river trail along the back of the curb to facilitate the `riverside' trail found on the comprehensive trail plan. The applicant has agreed to work with the City on this; staff suggests a condition to that effect. The amount of impervious surface area is reduced with this project, although the building foot print is getting larger. Staff suggests a condition that should the project be approved, it be subject to the approval of a variance. Lot Trees -The applicant has developed a landscaping plan, and provides for landscaping improvements in line with the scale of their development. The majority of the larger existing trees on site will remain, and some foundation plantings will be added in the front of the building. Engineering 1) The disturbance on Main Street shall be limited to a pit to connect a directionally drilled service line to the watermain. The disturbance pit shall be diamond shaped and be limited to 10'x10'. The surface shall be restored to match the existing typical section of Main Street. Main Street is a recently constructed road, and reducing the impact is vital. THE WATER SERVICE HAS BEEN REVISED TO INDICATE INSTALLATION BY DIRECTIONAL DRILLING. NOTES DETAILING THE REQUIREMENTS FOR THE STREET DISTURBANCE AND RESTORATION HAVE BEEN ADDED TO THE PLANS. SEE REVISED SHEET C-2. Wild and Scenic and Shoreland Regulations 3) This project is located adjacent to wild and scenic designated lands. I note that no changes to these areas are proposed. 4) This property is within the jurisdiction of the Shoreland overlay district, which addresses impervious surface and setbacks to the river. There are no increases to the setbacks proposed, however, there is proposed and increase to the pervious surface. Please provide calculations of the impervious surface of the lot, pre and post construction. If the amount is greater than 25% of the lot area, which appears likely, a stormwater drainage plan will need to be prepared, to restrict the developed five year frequency discharge to a rage not greater than the discharge with no development. City Staff can help you with development of this plan. Please contact Nicki Blake-Bradley for assistance. CALCULATIONS OF THE IMPERVIOUS SURFACE PRE AND POST CONSTRUCTION HAVE BEEN MADE AND WILL BE SUBMITTED. THE SITE IS OVER 25 PERCENT IMPERVIOUS, SO A STORMWATER PLAN WILL BE REQUIRED TO ADDRESS THE POST DEVELOPMENT 5 YEAR RUNOFF. THE APPLICANT WILL WORK WITH CITY STAFF TO DEVELOP THIS PLAN. Historic Preservation 5) Most properties adjacent to the Mississippi River have greater than normal potential for the finding of artifacts relating to the history and prehistory of the area. It is common that the Council adds a condition to the effect that a developer finding any evidence of these artifacts during construction will report such findings to the City immediately. ANY AND ALL DISCOVERED ARTIFACTS RELATING TO THE HISTORY AND PREHISTORY OF THE AREA WILL BE REPORTED TO THE CITY IMMEDIATELY. The subject lot requires 23 trees. The ordinance does provide for credits for the installation of larger trees, and for existing trees remaining. In both cases, the tree requirements may not be reduced by more than half. With these credits, the number of trees can be reduced to 12. Further, Section 30-934 (e) of the code does allow for the Council to approve and exception due "to unique topographic landform, irregular lot shape, or historic features worthy of preservation", following receipt of an alternative landscape plan. A site inspection conducted on February 14t" noted a number of trees on the property, including some that were not enumerated in the landscaping sheet, sheet CUP-2. Please verify the limits of impact to the existing trees, including those along the west side of the building and the three large trees in the front yard. Staff recognizes the uniqueness of the property, and can support the waiver generally, but a more detailed landscape plan, completed by a registered landscape architect must be completed. SEE ATTACHED REVISED LANDSCAPE PLAN PROVIDED BY CIVILSITE GROUP LANDSCAPE ARCHITECTS. Trails /Sidewalks 7) As part of a planned trail along the river, the City requests an easement for trail purposes along the south side of the parking lot. THE LEADERS OF THE CHURCH HAVE DISCUSSED THIS ISSUE AND ARE EAGER TO WORK WITH THE CITY ON PLANS TO CONNECT VALUABLE SPACES ALONG THE RIVER AND .MAKE THESE AMMENITIES ACCESSIBLE TO THE COMMUNITY. 8) The water connection in Main Street as proposed appears to require the removal of the existing paver sidewalk. Replacement will be your responsibility. ANY DISTURBED PORTIONS OF PAVER SIDEWALK WILL BE RESTORED TO THEIR ORIGINAL CONDITION. Fire Chief 10) Any comments generated following review by the Fire and Police departments will be forwarded under separate cover. NO RESPONSE REQUIRED. Downtown District Design 11) This project is located within the downtown district, and one of the goals of that district is stated: to the maximum extent possible, bring exterior facades back to the appearance they had when they were originally constructed, or comply to the extent possible. I note that the building as proposed is consistent with the height and building finishes. The proposed construction is inconsistent in that it doesn't support the `historic' character previously established. I mention this as some time should be spent to prepare a response to this, in the event this is a concern of the Council's. THERE IS NO HISTORICAL RECORD OF HOW THE SITE WAS DEVELOPED PRIOR TO THE EXISTING BUILDING CONSTRUCTED IN THE 1950'S. THE PROPOSED BUIDING ADDITION INCORPORATES THE ARCHITECTURE OF THE EXISTING BUILDING, COMPLIMENTS THE MATERIALS AND VOCABULARY OF THE NEIGHBORING BUILDINGS ON MAIN STREET, AND PROVIDES ACCESSIBLE GREEN SPACE THAT SOFTENS THE ARCHITECTURAL LINE ALONG THE SOUTH OF MAIN STREET. THIS DESIGN APPROACH ALSO ALLOWS FOR THE PRESERVATION OF THE THREE EXISTING MAPLE TREES ALONG THE STREET WHICH ANCHORS THE CORNER OF KING AVENUE AND MAIN STREET. 12) Any mechanical units mounted to the roof, or otherwise visible from a public place will need to be screened. Maximum sign area may note exceed 32 square feet (b-3). The existing monument sign may remain, but may not be enlarged (b-12). Please verify the size of the proposed signage; my calculations suggest that they are 24 square feet each, would exceed the limits imposed by section 30-872 B-3. THE PROPOSED SIGNAGE FOR THE PRIMARY FACADE WILL BE 22 SQUARE FEET, AND THE PROPOSED SIGNAGE FOR THE EAST FACADE FACING THE PARKING LOT WILL BE 10 SQUARE FEET. Their purchase is contingent on the approval by the City of a Conditional Use Permit for the reuse of the former bank building and site as a church facility. This is allowable as a conditional use in the Downtown District. The Evangelical Lutheran Church in America (ELCA) is very excited about Elk River Lutheran Church establishing its new home in downtown Elk River. The ELCA is providing the financial resources for the purchase and initial remodeling for this project. The ELCA is the largest Lutheran Church Organization in the United States. Elk River Lutheran Church sees a great opportunity at the former bank site to meet their needs and enhance the downtown experience. With this dual goal, they began their Master Planning process. The reconfigurations to the site and the building in their Master Plan reflect a stated effort to be a "good neighbor". Several of these "good neighbor" desires that the church asked their architects to express in the Master Plan include: " • Bea "Green Neighbor" The adaptive reuse and improvement of an existing building and site is one of the highest forms of "going green". Even though the Master Plan calls for an addition to the building, the site will have more permeable surface than currently exists. This is due to the removal of the hard surface space used for drive-through tellers. These would be replaced with a plaza where the public could sit, rest and reflect. Grass would be highlighted with brick pavers to match the downtown sidewalks. The existing trees on Main Street would be retained and incorporated into this new plaza. • Complement and enhance the downtown experience The addition of the church's restful plaza is intended to complement the more active public plaza on the east end of the block. It also creates a transition to sites and buildings to the west on Main Street. Stone work, similar to that used as a highlight for the building, would be used to reinforce and enhance the church's plaza creating a unique downtown feature. To that end, they are striving to create a gathering space that can be used for multiple purposes. These could include indoor music recitals and choral events as well as community theater productions. Their hope is to expand the summer season. music events into a year round activity to draw people to the downtown. • Bring back the "community room" When the bank was first constructed in the early 1970's a community room was included on the walk-out or lower level (river side). Many of the older members of the church remember with fondness attending meetings for organizations such as the United Way in the community room. They felt that reestablishing a community space would be a great benefit not only to the downtown neighborhood, but also to the Elk River community. They wanted this space to serve a dual purpose in supporting church or funeral luncheons (possibly catered by downtown restaurants) and creating a downtown meeting space for community organizations. The church wants their facility to function both as worship place and a resource to the community. The bank building and site are unique to the downtown district. In the Master Planning process there was a desire for the building to look like a church, while respecting the existing site, building and downtown district. The Master Plan has attempted to do this in several areas: • The fagade will utilize the existing building's theme of brick and accent stucco. • They will use a brick matching the existing building's brick in size and color. • To complement the brick and other downtown materials the existing white stucco surfaces will be softened by painting them abeige/tan color. • The incorporation of stonework is intended to complement and tie into the church's public plaza space. In the reuse of the bank site as a church facility City Ordinances require more parking than is possible on the site. There is however, ample private and public parking adjacent to the site. The Master Plan for the church shows a design for a 365 capacity main seating area. City Ordinance requires one (1) parking space for every three (3) seats in the main seating area. Thus 122 parking spaces are required to meet the City Ordinances. The Master .Plan shows approximately 22 spaces available on site, leaving the need for an additional 100 parking spaces. The primary time for the majority of the church's parking needs will be on Sunday morning. The downtown commercial parking needs are typically at their lowest when the church's needs are highest. The church has contacted Dare's Funeral Home regarding the use of their parking lot on Sunday mornings which has approximately 45 parking spaces. The bank has approximately 37 parking spaces at the bank building. Additionally, the bank owns another 24 spaces in the parking lot east of the bank and immediately north across Main Street from the proposed church facility. They have agreed to allow the church to use these spaces. On-site and adjacent private parking lot spaces amount to 128 parking spaces, which meets City Ordinance parking requirements, if the Conditional Use Permit is passed allowing adjacent spaces in the count. In addition to the on-site and private parking there are. approximately 290 public spaces available as follows: • The public parking lot directly north of the site across Main Street has approximately 130 parking spaces. • The former parking lot for the bank that is now public parking (on Main Street level) to the east of the bank has approximately 43 parking spaces. • The lower level public parking lot .has approximately 34 parking spaces. • On street public parking along Main Street between Lowell and Jackson Avenues have approximately 53 parking spaces. There are approximately 381 parking spaces on site, private and public parking spaces adjacent to the site. ADA requirements for the church indicate a need for five (5) designated parking spaces. Three of these spaces are shown on-site on the Master Plan, two on the east side of the building, one on the south. To account for the remaining two spaces., the church would like the City to consider identifying two ADA designated spaces on Main Street immediately in front of the site. They feel this would be advantageous to those in need of designated space attending functions at the facility. Additional accessible spaces are also provided in the parking lots of Dare's and the bank. In summary, the church is asking that an allowable conditional use permit be granted for the use of the former bank building and site to be used as a church facility using adjacent private and some public parking to meet ordinance parking requirements. City ordinance would require 122 spaces. Of the 30 existing on-site parking spaces, eight spaces would be eliminated to provide adrop-off and pick-up lane as well as a play area for children. The purpose of the drop-off lane is to create a safer parking program for visitors to the site. It also addresses ADA loading zone requirements. The Master Plan shows approximately 22 spaces available on site, leaving the need for an additional 100 parking spaces. The primary time for the majority of the church's parking needs will be on Sunday morning. The downtown commercial parking needs are typically at their lowest when the church's needs are highest. The church has contacted Dare's Funeral Home regarding the use of their lot on Sunday mornings which has approximately 45 parking spaces. Dare's and the church are working on a document to finalize this agreement. The church has also contacted the 1St National Bank regarding the use of their lot on Sunday mornings which has approximately 30 parking spaces. The bank and the church are working on a document to finalize this agreement. Is there proposed screening of the site? Existing parking is being utilized and no screening is planned. Proposed building materials How do they comply with applicable design standards? The master plan would utilize a brick matching the existing building's brick in size and color. To complement the brick and other downtown materials the existing white stucco surfaces will be softened by painting abeige/tan color. The incorporation of stonework is .intended to complement and tie into the plaza space. Signage The Master Plan shows the church name on the two walls facing Main Street. The signage would be in the form of individual letters attached to the brick surfaces. The size would comply with City Ordinance. A secondary individual letter sign of a smaller size is shown on the east wall facing the public parking lot. Is there outdoor storage The Master Plan calls only for the reuse of the existing recycle center located on the lower level.
