ACTION REQUESTED
Staff and the Planning Commission recommend approval of the Conditional Use Permit, subject to the.
following conditions:
1. It must be demonstrated that the Fire Department can turn north onto the eastern most drive.
2. A landscaping plan must be approved by staff that includes species, size, and planting details.
3. Alighting plan must be provided that demonstrates that a minimum 3-fc average can be
provided on the subject parcel.
4. Details of the dumpster enclosure must be provided and approved by staff prior to
construction.
5. Handicapped stalls -Two handicapped parking spaces should be provided.
BACKGROUND/DISCUSSION
The Elk River Housing and Redevelopment Authority (HRA) is proposing to construct a parking lot at
the site of the former HRA buildings at 716 and 720 Main Street. These buildings were demolished
earlier this year.
Parking lots as a principle use of a lot are a listed conditional use in the downtown area.
The HRA proposes constructing a 25-stall parking lot, closing the access off of Main Street, and
introducing a more formal pedestrian access to the balance of the King Avenue parking lot. Other
planning improvements include a number of trees and plantings, seating areas, lighting, a dumpster
enclosure, and future informational kiosks and signage.

No comments in support or opposition to the request have been received
Planning Commission Comment
The Planning Commission had no concerns with the proposal, although there were some questions about
the condition referencing fire department access.

OVERVIEW
With the recent demolition of the former O'Reilly's Auto Parts building, the HRA desires to improve the
parcel with a 28-space surface parking lot. It is anticipated that this parking lot will not be a permanent
fixture; the HRA may choose to redevelop the parcel for a building or other structure in the future.
Commercial lots are a conditional use in the DD zoning district. The intent behind this is that lots were
the primary use is parking should receive some formal review.
BACKGROUND/PRECEDENT
The Site plan review committee reviewed this project at their meeting on April 4`h. Following that
meeting, a number of comments were generated, and summarized below.

Fire access. Main issues included the ability of the fire department to navigate King Avenue's internal
parking lanes. While the Fire Department does not need to access the new parking lot, they will lose the
ability to access the rear of the buildings via the existing one way drive lane. The Fire Department wants
to ensure that they can turn north onto the drive aisle, which may require some modification of the
existing parking lot island.
Kiosk. The plan includes an information/business directory kiosk. Due to costs, this may be constructed
in a future phase.
Handicapped parking. State Code requires a certain ration of handicapped parking spaces, based on the
total number of spaces provided. For 26-50 spaces (the size of the proposed parking lot), 2 handicapped
spaces would be required. Although the staff comment letter incorrectly recommended 1 space, 2 should
be added. This will reduce the number of spaces to 27 off street spaces.
Lighting. Parking lot lighting will need to be provided that ensures that the lighting not drop below 3 fc
average.
Storm water. There is no requirement to retain storm water on this site, in the opinion of the City
Engineer, because this parking lot represents no change from the previous, 100% impervious surface.
This parking lot is outside the 300 foot shoreland boundary.
Landscaping. The plan shows additional trees and an enhanced pedestrian way. Further details are
required, and will be approved. by staff.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in
the immediate vicinity or the public health, safety, morals, comfort, convenience or general
welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding
vacant property.
4. Will be served adequately by and will not adversely affect essential public facilities and
services including streets, police and fire protection, drainage, refuse disposal, water and
sewer systems, parks and schools; and will not, in particular, create traffic congestion or
interference with traffic on adjacent and neighboring public thoroughfares.
S. Will not involve uses, activities, processes, materials, equipment and conditions of operation
that will be detrimental to any persons or property because of excessive traffic, noise, smoke,
fumes, glare, odors, dust or vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of
major importance.
7. Will fully comply with all other requirements of this Code, including any applicable
requirements and standards for the issuance of a license or permit to establish and operate
the proposed use in the city.
(j If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.
