Staff and the Planning Commission recommend adoption of the attached ordinance.
BACKGROUND/DISCUSSION
The applicant wishes to rezone the 6.02 acre parcel, which includes an existing 50,000 square foot
building from the Elk River Crossing Planned Unit Development (PUD) to Business Park (BP). The
applicant will use the property and building for light manufacturing and warehouse.
The southern 60% of the subject lot was originally zoned BP, but was rezoned in 2004 to accommodate
the retail sales associated with Maxsun Furniture, the former occupant of the lot.
The Comprehensive Plan shows a portion of the lot guided for Highway Business, and the southern 60%
guided for Light Industrial. This is one of four lots within the city that have two land use designations.
Public Comment
Staff received a phone call from the property owner to the west. After discussion, lie had no concerns
with the proposal.
Planning Commission Comment
The Planning Commission had no concern with the proposed change.

CITY OF ELK RIVER
AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTY
FROM PUD (PLANNED UNIT DEVELOPMENT) TO BP (BUSINESS PARK)
CASE NO. ZC 12-01
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That the duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the property described on attached Exhibit A from PUD Planned Unit
Development to BP Business Park.
Section 2. That the rezoning approved by this Ordinance is based on the following
findings:
1. THE REZONING IS CONSISTENT WTH THE CITY OF ELK RIVER
LAND USE PLAN ADOPTED AS PART OF THE CITY OF ELK RIVER
COMPREHENSIVE PLAN.
Section 3. That this Ordinance shall take effect and be in full force from and after the
date of its publication.
Passed and adopted this 16`'' day of April, 2012 by the City Council of the City of Elk
River.

OVERVIEW
The applicant wishes to rezone the 6.02 acre parcel from PUD to Business Park. Currently, the parcel is
governed by the Elk River Crossing PUD agreement, and the buildings previous use was commercial.
The applicant plans to use the property for manufacturing, which is a use consistent with Business Park
zoning.
BACKGROUND/PRECEDENT
The subject parcel was added to the Elk River Crossing PUD in 2004. The original PUD agreement was
dated 1999.
Initial Use
The applicant wishes to convert the 50,000 square foot building into a light manufacturing/warehouse
space, consistent with the uses allowed in the Business Park zoning district.
No changes are proposed to the exterior of the building, although prior to occupancy, the applicant will
be required to furnish a proof of parking plan, as the building does not meet the parking required of an
industrial property. Proof of parking for industrial uses is not uncommon, especially for large buildings.
The proof of parking plan will be reviewed by the internal site plan review committee.

Rezoning
In reviewing a proposed amendment, consideration shall be given to existing conditions within the
area directly and indirectly affected by the proposal, the conservation of property values, the use to
which. the property affected is being devoted at the time, and relevant provisions, if any, in the land
use plan.
ANALYSIS
The addition of industrial property within the City has been a goal for some time. Converting this lot to
industrial is consistent with this goal, and generally consistent with the comprehensive plan.
Comprehensive Plan
This parcel is unique in that roughly the northern half of the lot is Highway Business, and the
southern half is guided Light Industrial. Light Industrial is an appropriate land use fox business
park.
The adjacent Tractor Supply retail store to the west is guided HB/LI as well.

Project Scope:
Additional production and warehousing requirements are necessary to support continued growth at
Sportech. The needs of the organization have changed due to increased production volumes requiring
additional facility needs. The existing facility located at 11074179th Avenue NW is an ideal location for
Sportech expansion as it is in close proximity to the existing facility at 10800175th Avenue NW.
To prepare the facility for use, building improvements and interior alterations will be made to
accommodate roughly 40 production workers, 4 shipping & receiving clerks, and 5 administrative
personnel. One CNC routers, one CNC brake press, and two forklifts will be operating within the facility.
Reason for Zone Change:
A zone change is respectfully requested to allow the structure to be used as a manufacturing and
warehouse facility to conduct the business activities of Sportech, Inc.
Compatibility to Surrounding Properties:
The project and intended use of the property will be consistent with the other business establishments
surrounding the property. There will be employee and business related traffic utilizing the front
entrance and parking area adjacent to 179th Avenue NW. Additionally, incoming and outgoing delivery
vehicles will frequent Industrial Circle to the rear of the building. In either instance, the established
transportation infrastructure will be adequate and does not conflict with the current activities of
neighboring property owners.
Benefits to the City:
Sportech continues to attract a talented employee base strengthening the labor force within Elk River.
The outlook continues to be very strong requiring the company to hire additional staff to meet demand.
Sportech now employs 110 full-time employees with continuing recruiting efforts to locate and hire
exceptional employees that conduct business using our core values of integrity, excellence, passion,
innovation, and collaboration.
