Sec. 22.31. Department continued; member-
ship.
There is hereby continued as heretofore estab-
lished in the city a volunteer fire department
consisting of a chief, three assistant chiefs, a
secretary/treasurer, and so many firefighters as
deemed appropriate by the fire chief and the
council; provided, however, that the total mem-
bership of the department shall not exceed 35
persons.

Sec. 22.32. Appointment or election of mem-
bers and officers.
The fire chief shall be appointed by the council
taking into consideration the recommendation of
the members of the fire depaztment. All other
officers shall be elected by the department.
Firefighters shall be appointed by the members of
the department in accordance with qualifications
and other requirements set forth in the fire de-
partment bylaws and this article.

Sec. 22-33. Duties of fire chief.
(al Ge~aer¢lly. The fire chief shall have control
of all the firefighting apparatus and shall be
solely responsible for its care and condition. The
fire chief shall make an annual report to the
council by June on the condition of the equipment
and needs of the fire department. The fire chief
shall be responsible for the proper training and
discipline of the members of the fire department,
and may suspend any member for refusal or
neglect to obey orders pending final action by the
fire department members on his discharge or
retention.

Sec. 22-34. Records of fires.
The fire chief shall keep in convenient form a
complete record of all fires. Such a record shall
include the lime of the alarm, the location of the
fire, the cause of the fire, if known, the type of
building, the name of the owner and tenant, the
purpose for which the building was occupied, and
the value of the building and contents, the name
of the members of the depaztment responding to
the alarm, and such other information as may be
deemed advisable or as may be required from
time to time by the council or the state insurance
department.

Sec. 22-35. Meetings.
The fire department shall meet at least once
each month. Pursuant to the provisions of its
bylaws, the department shall meet annually to
elect officers.

Sec. 22-36. Practice drills.
The fire chief shall hold as many practice drills
as necessary to instruct firefighters in approved
methods of firefighting and fire prevention.

Sec. 22-37. Assistant chiefs.
In the absence or disability of the fire chief, the
functions and authority of the fire chief shall be
performed by the assistant chiefs, in the order of
rank.

Sec. 22-38. Qualifications of firefighters.
Any ablebndied person 13 years of age or older
may be eligible to become a firefighter. Each

candidate, before becoming a firefighter, must
satisfy certain physical agility requirements and
satisfactorily pass a physical examination.

Sec. 22-39. Compensation of members and
officers.
The compensation of members and officers of
the fire department shall be determined by reso-
lution of the council.

Sec. 22-40. Response to fire calls outside city
limits.
The fire department is hereby authorized to
respond to fire calls outside city limits in accor-
dance with policies and rules established by coun-
cil resolution. The council shall, by resolution,
prescribe charges to be made by the department
for such calls and shall approve any agreements
made with other governmental body for fire pro-
~ection.

Sec. 22-41. Firefighter's relief association.
The members and officers of the fire depart-
ment may organize themselves into a firefighter's
relief association in accordance with law.

ARTICLE III. FIRE PREVENTION

Sec. 22-71. Minnesota State Fire Code
adopted.
The Minnesota State Fire Code, promulgated
pursuant to Minn. Stats. § 299F.011 and Minne-
sota Rules ch. 7510, is hereby adopted by the city
for the purpose of prescribing regulations govern-
ing conditions hazazdous to life and property from
fire and explosion, except those portions that- are

deleted or amended by section 22-78. All future
editions of the '.Minnesota State Fire Code shall
automatically be adopted by the city as they are
approved by the state, except those portions That
may be deleted or amended by section 22-73. One
copy of the ?t4innesoia State Fire Code in effect
within the city shall be on file in the office of the
city clerk.

Sec. 22-72. Definitions of terms used in Min-
nesota State Fire Code.
(a) Wherever the words "chief of the bureau of
fire prevention" are used in the Minnesota State
Fire Code, they shall be held to mean the fire
chief.
(b) Wherever the word "jurisdiction' is used in
the Minnesota State Fire Code, it shall be held to
mean the City of Elk River.

Sec. 22-73. Amendments to Minnesota State
Fire Code.
The 1VIinnesota State Fire Code is amended
and changed in the following respects:
(1) Parking in or obstructing fre l¢ne. It is
unlawful to park any vehicle or to locate
any obstruction in an area designated as
a fire lane, whether the fire lane is adja-
cent to a public or private structure or
property.
(2) Reuieto of building plans. The chief of the
fire department or his representative shall
review all building plans, except plans for
single-family or two-family residences, to
ensure compliance with the provisions of
the Minnesota State Fire Code, and he/
she shall note any violations discovered in
connection with the proposed structures
to such persons as shall be charged with
the responsibility for review of such plans.
