BACKGROUND/DISCUSSION Minnesota Statute requires each city designate a Responsible Authority to administer the collection, storage, use, and dissemination of data on individuals, government data, or summary data within the city. The duties of the Responsible Authority have in the .past been performed by the city administrator. ATTACHMENTS ^ Resolution Action Motion by Second by Vote Follow Up PONEAEA 11 N:\Publie Bodies\Ci[y Council\Council RCA\Data Practices\Action Requested Resolution.doex ~~~~ RESOLUTION NO. 12- RESOLUTION APPOINTING RESPONSIBLE AUTHORITY FOR PURPOSES OF THE MINNESOTA GOVERNMENT DATA PRACTICES ACT WHEREAS, Minnesota Statutes, section 13.02, subdivision 16, requires that the City of Elk River appoint one person as the Responsible Authority to administer the requirements of the collection, storage, use, and dissemination of data on individuals within the city; and WHEREAS, the City of Elk River shares the concern expressed by the legislature on the responsible use of all city data and wishes to satisfy this concern by appointing an administratively qualified Responsible Authority as required under the statute; and WHEREAS, the duties of Responsible Authority have in the past been performed by the city administrator; and WHEREAS, Calvin Fortner has been appointed as the city administrator of the City of Elk River. NOW, THEREFORE, BE IT RESOLVED: 1. The City Council of the City of Elk River appoints Calvin Fortner as Responsible Authority for the purposes of meeting all requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13, as amended, and the rules lawfully promulgated by the Commissioner of Administration at Minnesota Rules, Chapter 1205. 2. Mr. Fortner is authorized to delegate the duties of Responsible Authority to other city employees as Mr. Fortner, in his discretion, determines to be necessary in order to satisfy the requirements of the Minnesota Government Data Practices Act and at the same time continue to effectively and efficiently provide other city services. 3.
