BACKGROUND In 2006, the HRA purchased 716 and 720 Main Street in Elk River with the intent to expand downtown surface parking. The buildings were demolished and removed in late 2011. Construction of a parking plaza will begin May 14 and is anticipated to be complete by June 28. DISCUSSION With the construction of the new parking plaza, there will be ongoing operational and maintenance needs. Staff recommends transferring operations and maintenance to the respective city departments to provide the service through a Memorandum of Understanding (NIOU). The installation and maintenance of the street lights are already covered by an MOU between the city and Elk River Municipal Utilities. The attached MOU outlines the landscaping, snowplowing, and other ongoing maintenance items that would be completed by the Administration, Streets, and Parks & Recreation Departments. The MOU outlines the maintenance and management of the Main Street Parking Plaza. Special event requests require a permit which is reviewed by staff and approved by City Council. Staff recommends all lot use requests go through this process. The HRA will continue to own the lot, and has the ability to cancel the MOU at any time should the HRA wish to change the use of the lot. FINANCIAL IMPACT Estimated costs of the management and maintenance of Main Street Parking Plaza are $2,850. A transfer of funds from the HRA budget to the General Fund will be executed annually. The cost breakdown is as follows: Irrigation, repairs, water consumption (Park & Rec Dept.) $1,800 Snow removal paint striping sweeping, cracksealing $1,050 TOTAL $2,850 t0l~EREII BT AU ATTACHMENTS • Memorandum of Understanding between Elk River Housing Redevelopment Authority and City of Elk River Action Motion by Second by Vote FOllow Up N:\Public Bodies\Ciry Council\Council RCA\Agenda Packet\05-07-2012\IIltt1 MOU.docx MEMORANDUM OF UNDERSTANDING REGARDING MANAGEMENT AND MAINTENANCE BETWEEN ELK RIVER HOUSING AND REDEVELOPMENT AUTHORITY AND THE CITY OF ELK RIVER, MINNESOTA This MEMORANDUM OF UNDERSTANDING, hereinafter referred to as "MOU", is hereby made and entered into on this 7th day of May, 2012, by and between the City of Elk River, Minnesota, hereinafter referred to as the "City" and the Housing and Redevelopment Authority in and for the City of Elk River, hereinafter referred to as the "HRA". 1.0 Purpose The purpose of this MOU is to address the management and maintenance of the HRA owned Main Street Parking Plaza, hereinafter referred to as the "Lot", located at 716 and 720 Main Street within the City of Elk River, Minnesota. 2.0 Review and processing of special event permits The City will review, process and act on all applications for special event permits for use of the Lot in the same manner as applications for the use of City owned property. 3:0 Management and Maintenance of Lot The City will manage and maintain the Lot in the same manner as City owned parking lots and landscaping. The HRA will reimburse the City for all material costs and labor associated with management and maintenance of the Lot in an amount the HRA and City will agree to annually. In addition, if the City determines that the Lot requires sealcoating, the cost of seal coating will be billed to the HRA. The following maintenance/labor will be the responsibility of the Parks and Recreation Department: irrigation, repairs and water consumption. The following maintenance/labor will be the responsibility of the Streets Department: snow removal, paint striping, sweeping and cracksealing. 4.0 Termination of MOU This MOU may be cancelled or terminated without cause by either party by giving (30) calendar days advance written notice to the other party. Such notification shall state the effective date of termination or cancellation. Any and all amendments must be made in writing and must be agreed to and executed by the parties before becoming effective.
