Premises Permit for Eagles Club
The Eagles have requested to renew its Premises Permit to allow pull tab
sales at the Eagles Club located at 824 Railroad Drive. The City's ordinance
requires that 75% of lawful expenditures be spent in the Elk River trade area
which consists of the cities of Elk River, Otsego, Ramsey, Rogers and
Zimmerman.
The Eagles have consistently met the 75% requirement from June 1995
through June of 1997. If however, you take the entire year of 1997, there was
a shortage to the Elk River's trade area of about 16%. After speaking to the
Eagle's gambling manager, I was informed that the Eagles are committed to
a certain amount of money for Eagles charities. Due to the limited amount of
funds received in 1997, and the commitment to the national Eagles
organization, the Eagles were unable to meet the City's 75% requirement.
I believe it is the intent of the Eagles to meet the City's requirement of
spending 75% in the Elk River trade area. This can be proven by looking at
the period of June 95 - June 97 which shows 82.6% spent in the City's trade
area.
ACTION REQUIRED
Council motion approving the attached resolution authorizing premises
permit renewal for the Eagles.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING PREMISES PERMIT RENEWAL FOR THE
ELK RIVER-ROGERS VFW POST #5518
WHEREAS,
the Fraternal Order of Eagles Aerie 3264 have made application to
the State Control Gambling control Board for a Premises Permit
Renewal; and
WHEREAS, the Premises Permit will allow charitable gambling on the premises of
the Eagles Aerie #3264 located at 824 Railroad Drive; and
WHEREAS,
the Fraternal Order of Eagles Aerie 3264 has met the City's
requirement of spending 75% of its lawful expenditures within the
City's trade area during the period of June 95 - June 97.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota that a Premises Permit for Fraternal Order of
Eagles Aerie 3264 be granted to allow charitable gambling operations
at the Eagles Aerie #3264; 824 Railroad Drive.
Passed and adopted by the City Council of the City of Elk River this 6th day of
April, 1998.

Gentlemen:
Regarding City of Elk River Gambling Ordinance 91-716.06
and our Premise Permit Application.
Our organization was in violation of the this ordinance
for the Year 1997. According to our records our lawful
purpose expenditures that directly benefitted the local
trade are was 56.3% of our total expenditures. In Feb.
l~~?dona~ed $250.00 tO JerrY~iltner, son of a ~long
time Elk River native and in April 1997 we donated an
additional $200.00 to help defray transportation costs
for treatment of his severe medical'problem. Being
that he now lives outside the trade area, we did not
include these totals. Also in June 1997, we donated a
total of $600.00 to 17 national Grand Aerie Eagles spon-
sered charities, see attachment. At that time we would
have made these donations from our General Fund, if we
knew that we would be in violation at the end of the year..
In May 1997, we paid Sherburne County our Real Estate Tax
totaling $2,690.00. This expenditure qualifies as lawful
purpose by'the State Gambling Board. Do other organiza-
tions include their real estate tax payments as benefitting
the local trade area? If it so qualifies, we then would
not be in violation.
Hopefully you will approve our premise permit application.
We will closely monitor all future donations to insure that
we will not be in violation.
