BOSTON STREET IMPROVEMENTS
PUBLIC HEARING
Dear Council Members:
As you are aware, the public hearing for the Boston Street improvement is scheduled for the
evening of Monday, April 6, 1998. Please bring the green covered Feasibility Study dated
January 1998 with an amendment date of March 1998. If you need a new copy of the
Feasibility Study, please let City Hall know and we will make them available.
As you recall, this feasibility consists of extending sanitary sewer and water along Boston
Street north of Orono Road to three residential properties and Orono cemetery. The project
was petitioned for by the residential properties along Boston Street.
With regard to financing of the improvement, the feasibility recommends that two of the
residential properties can be further sub-divided, and that they be treated as two units with
regard to utility and street restoration assessments. The feasibility goes on further to
recommend that the sanitary sewer and water assessment for the potential second lot be
deferred until such time that the lot is split, but that the street restoration assessment be levied
at this time. This results in $12,300 of assessments being deferred. The other important point
to make is that Minnesota State Statute 306.14 Taxes; Road; Special Assessment, deals with
assessments against cemeteries. It appears from this state statute that if Orono cemetery
objects to their assessment of $5,325 for water improvements, the City may be unable to
assess them. This is a question that would need to be further investigated by the City
Attorney.
At the close of the public hearing, if the City Council desires to proceed with the project a
resolution is attached for your consideration. The resolution orders the improvement and the
preparation of plans and specifications.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT AND
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATTER OF THE BOSTON STREET IMPROVEMENT
OF 1998
WHEREAS,
WHEREAS,
a public hearing relating to the Boston Street improvement was held before the
Elk River City Council after ten days mailed notice and two weeks published
notice of the hearing was given; and
the City Council has duly considered the Feasibility Report and those matters
presented at the public hearing by those persons desiring to be heard on the
matter;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The Boston Street improvement is hereby ordered as recommended in the Feasibility
Report dated January 1998, amended March 1998.
Howard R. Green Company is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications for
the making of the improvement and the solicitation of competitive bids.
