Request by Cargill, Inc. to Appeal
a Zoning Determination, Public
Hearing Case No. GP 98-1
Issue
Cargill, Inc. is requesting to appeal a decision by staff not to issue a building
permit for new construction of a research facility within the urban service
district prior to the availability of sewer and water. This issue is specifically
referenced in Section 900.20(16) of the Elk River Code of Ordinances.
Overview
Since the time this item was presented to the Board of Adjustments on March
24, 1998, staff has been in contact with Cargill to discuss the current
application along with other outstanding issues. In light of these
conversations, which may result in some solution that will benefit both
Cargill and the City, Cargill is asking to postpone action on their request to
appeal a zoning determination for one month. The city attorney and I will be
meeting with Cargill and their representatives to hopefully work through the
issues and come back to the City Council with a resolution to the outstanding
issues.
Recommendation
It is recommended the City Council postpone action on the request by Cargill,
Inc. until the May 18, 1998, City Council meeting.
