BACKGROUND/DISCUSSION In November 2008, the Council approved Sections 50-91 through 50-97 of the City Code. These sections were enacted to deal with the issue of excessive false alarms. The ordinance refers to excessive false alarms being tracked in a permityear, which has been found to be confusing for staff and alarm permit holders. It is proposed to have the language changed to calendaryear, thus making it easier for staff to accurately track false alarms and making it simpler for alarm permit holders to keep track of any violations. This also brings the language in line with Section 50-97 of the Code, which states that false fire alarms axe tracked by the calendaryear. Section 50-91 titled, Defuutions, of the City of Elk River Code of Ordinances shall be amended to change the following: ~~ Calenda ;yearmeans a T2-month period beginning on January 1St and ending on December 31St fide-day ~. Section 50-96, titled, Enforcement of Alarm Ordinance, of the City of Elk River Code of Ordinances shall be amended to change the following: Excessive false alarms/failure to register. It is hereby found and determined that three or more false alarms within a p~ calendar year is excessive, constitutes a public nuisance, and shall be unlawful. Civil penalties for false alarms and for failure to obtain an alarm permit for an alarm system may be assessed against an alarm user, as provided in the city's current fee schedule. Section 2.
