Council motion to adopt an ordinance amending Chapter 38, Attide XI of the City Code regarding
special events.
BACKGROUND/DISCUSSION
At the April 16, 2012, meeting, the City Council discussed and directed staff to amend the special event
ordinance in order to allow private events to be held on city property. The changes have been
incorporated into the attached draft ordinance. Events held on park pxoperry have been listed as an
exemption because the Pazks and Recreation Department already issues permits fox events on pazk
pxopexry.
Council Concerns from the April 16, 2012 Meeting
I. Days/times city property could be used
Current language in the special events ordinance allows Council flexibility in regulating time,
manner, and place in which city property can be used.
2. How other events or businesses may be affected
The ordinance allows CouncIl to impose reasonable conditions on an event. Such conditions may
include providing notice to surrounding businesses of an event ox providing for a location or
route change to an event.
3. Staff overtime/compensation time
As discussed at the April 16 meeting, seasonal part-time staff would be utilized when needed at a
cost to be charged to the applicant.
FINANCIAL IMPACT
As discussed at the ApxIl 16 meeting, fees for use of city pxopexry would be as follows for private events:
$150 fox the first two hours of the event
• $50 fox each additional hour
^ $250 damage deposit
These fees will be incorporated into the next fee schedule update.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
CHAPTER 38, ARTICLE XI, REGARDING SPECIAL EVENTS, OF THE ELK
RIVER, MINNESOTA, CITY CODE
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. 'That the definition of "Special F,aent" set forth in Section 38-512 of
the City of 1~,lk River Code of Ordinances shall be amended to read as follows:
Spe~zal event means an outdoor gathering, whether on public or private property, open to the
public where at least 50 individuals axe expected to, or do, assemble with a common purpose
fox a period of one hour ox longer. Special events include, but are not limited to, contexts,
fairs, carnivals, circuses, parades, flea markets, marathons, walkathons, festivals, races,
bicycle events, celebrations, or anv other gathering or events of similar nature. Special events
de-nat include private, noncommercial events such as graduation parties or social parties
held on city- property. regardless of the number of individuals in attendance but does not
include such events held on private pxopext~
Section 2. That Section 38-516 titled, Exceptions, of the Cite of Islk River Codc of
Ordinances shall be amended to add new Section i8-51 G (a) (7), as follows:
(7) Non-commercial events held on park property fox which a permit is required
through the Parks and Recreation Department
Section 3. That this ordinance shall take effect upon adoption as provided by law.
