Public Hearing to be Scheduled for
Creation of TIF District No. 19 (Earl
Hohlen Project)
Issue
The issue before the City Council at this time is to call for a public hearing to
be held on the Modification of Development District No. i and the
establishment of Tax Increment Financing District No. 19. A public hearing
on this issue was previously scheduled for June 1, 1998, but due to a variety
of timing issues it will no longer be possible to meet that date.
Background
The Earl Hohlen project is a mixed use redevelopment of the Elk Terrace
Mobile Home Park and Vandenberge property by Associated Builders of
Apple Valley. The current process involves a complete analysis of the
developer's tax increment application and request in addition to continuing
discussions of the Business Park component (Vandenberge property) of this
mixed use development. Due to the complexity of this process and some
difficulty receiving the proper information from the developer, the timeline is
proposed to be extended. Staff is requesting that the public hearing be
rescheduled from June 1, 1998, to July 13, 1998.
Recommendation
Staff recommends approving Resolution 98-__ calling for a public hearing by
the City Council on the Modification of Development District No. I and the
establishment of Tax Increment Financing District No. 19. This public
hearing shall be held on Monday, July 13, 1998, at approximately 6 p.m. in
the Council Chambers at City Hall.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION CALLING FOR A PUBLIC HEARING
BY THE CITY COUNCIL ON THE MODIFICATION OF
DEVELOPMENT DISTRICT NO. 1 AND THE ESTABLISHMENT OF TAX
INCREMENT FINANCING DISTRICT NO. 19
BE IT RESOLVED by the City Council (the "Council") for the City of Elk River,
Minnesota (the "City"), as follows:
Section 1. Public Hearing. This Council shall meet on Monday, July 13,
1998, at approximately 6 p.m., to hold a public hearing on the proposed
modification of Development District No. i and the proposed establishment of
Tax Increment Financing District No. 19 (a Redevelopment Tax Increment
Financing District), all pursuant to and in accordance with Minnesota
Statutes, Sections 469.090 through 469.1081, inclusive, as amended, and
Minnesota Statutes, Section 469.174 through 469.179, inclusive, as
amended, in an effort to encourage the development and redevelopment of
certain designated areas within the City; and,
Section 2. Notice of Public Hearing~ Filing of Program and Plan. Staff is
authorized and directed to prepare the Development Program and the Tax
Increment Financing Plan (the "Program and Plan") and to forward
documents to the appropriate taxing jurisdictions including Sherburne
County and Independent School District No. 728. The City Administrator is
authorized and directed to cause notice of the hearing, together with an
appropriate map as required by law, to be published at least once in the
official newspaper of the City not later than ten nor more than 30 days prior
to July 13, 1998, and to place a copy of the Program and Plan on file in the
City Administrator's office at City Hall and to make such copy available for
inspection by the public.
Passed and adopted by the City Council of the City of Elk River this 11th day of May,
1998.
