ACTION REQUESTED
Staff recommends that the Planning Commission recommend approval of the amendment to the
Barrington Square Planned Unit Development (PUD) to allow physical recreation and training uses.
BACKGROUND/DISCUSSION
The subject property is currently -zoned PUD. The Barrington Square PUD agreement was created in
1986 and physical recreation and training uses are not allowed by the PUD agreement. The term/use of
physical recreation and training is relatively new andhas only been incorporated into our ordinance
language for approximately five years. The. thought of including these uses was not even considered in
1.995.
Some examples of physical recreation and training uses are, but not limited to: dance studios, fitness
center, gymnastic studios and karate studios.
Land Use
The subject property has an underlying land use of Urban Residential which depicts the residential
development pattern within the Urban Service Area. The housing units consist of both single-family
detached and attached housing units. Attached unit types include duplexes and townhomes.
The subject property and other adjacent properties have been retail/commercial/office in nature since
1986.
Physical recreation and training uses can be placed in this area as conditional use with no negative impact.
Recommendation
Staff is recommending the Planning Commission recommend approval of the request because physical
recreation and training uses are consistent with the PUD.

Conditional Use Permit Narrative
. The proposed use for 251- 8~ St NW, is to be developed as P.S...Dance
Studio. P.S...Dance Studio was founded in 1996, in Elk River, with the
mission of creating a dance studio where fun and learning dance go
hand in hand. We offer a variety of dance programs with price options
for all levels of interests, for children ages 3 -Adult. Providing proper
knowledge and technique in a positive, fun, warm environment.
Moving to the 8~h Street location, will help the business maintain and
potentially grow due to, visiblity from Highway 101, closer to schools,
and visibity from McDonald's. This site will also be very convenient
for local residents.
. Hours of operation are Monday -Thursday 4:OOpm - 9:30pm, with
varied hours on weekends.
. Number of Employees: 9
. Parking. Stalls: currently there are 24 in front of building, with additonal
off street parking. No changes are necessary.

5.) Plan for Orderly Development -
(O1) On-Site Utilities - In order to promote the orderly
installation of on-site utilities within the Development,
Developers will prepare and submit to the City Engineer a
plan covering the installation of streets, curbs and gutters,
sidewalks and other public walkways, water, storm sewer and
sanitary sewers_ City Engineer will make such changes as he
believes are in the interest of the City and submit the final
plan to the City Council for its approval. No utility services
will be installed that are not in conformance with the
approved plan. Developers have installed all necessary on-site
utilities.
(02) Approval Prior to Construction - Prior to constructing
any phase of the Development, Developers shall submit plans to
the Planning Commission and Council for site and landscaping
plan_
6.) Uses - The uses of the Development shall be restricted to:
1. Retail establishments
2. Personal Service establishments
3. Professional and business offices
4. Financial institutions
5. Dental and Medical clinics
6_ Two-Family dwellings
7. Mortuaries
7.) Assessments - The parties mutually agree that all public
improvements installed by the City related to the Development shall
be assessed pursuant to Chapter 429 of Minnesota State Statutes.
Otherwise, the Developers shall be responsible for installation of
improvements in accordance with City standards.
S-.) Pond Easements - Developers have recorded the necessary
easements for storm water pcnds and drainage .over Outlots A and B
and Lot 1 of the Development..
9.) Li hts - Developers agree to provide and the City agrees
to accept a lighting system for the Development and in accordance
with the Special Conditions pursuant to the applicable ordinance in
effect at the time of the final plat approval. '
10.) Building Setbacks - Building setbacks shall be as shown
on individual site plans.
