6.3. SR 05-18-1998ity of River FROM: DATE: SUBJECT: Item # 6.3 MEMORANDUM City Council Stephen Wensman, Planning Intern May 18, 1998 Request by Teresa Dejarlais for a Conditional Use Permit, Public Hearing Case No. CU 98-13 Request Consider a request by Teresa Dejarlais for a conditional use permit to operate an art studio from her home. Location 227 Morton Avenue (south of Main Street and west of Morton Avenue) The legal description is ½ of lot 5, and all of lot 6, Hastings First Addition, Sherburn County, MN. Zoning/Land Use Rlc (Single Family Residential) / MR (Medium Density Residential) Attachments Location map Site plan · Letter from Teresa Dejarlais Background Teresa Dejarlais and Pat Egan propose opening a workshop studio (hobby) business out of their home. A conditional use permit is required as the workshop studio will at times: · Exceed more than two (2) guests at one time. · Create parking demand in excess of that which can be accommodated in the existing driveway, where no vehicle is parked closer than fifteen(15) feet from the curb line or edge of pavement. 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · TDD & Phone: (612) 441-7420 · Fax: (612) 441-7425 Operations The proposed workshop studio will be a hobby business to be operated from the home including the porch, garden and potting shed. The operations can be characterized by the following: A mostly female clientele of 5- 8 people · Open on Saturdays between the hours of 11 a.m. and 5 p.m., and by appointment, and with seasonal open houses. · Projects likely to include the making of linens, candies, soaps, and other hand made comforts. · Any sales would be incidental to the operations of the business. Comments The staff views this business to be more aligned with a social gathering than a business as it is described by Teresa Dejarlais. A few more cars on the weekend should not adversely effect parking or become a nuisance to the neighbors. Planning Commission On April 28th, 1998, the Planning Commission met and recommended approval of a request by Teresa Dejarlais for a conditional use permit to operate an art studio from her home. No one spoke at the public hearing. Recommendation It is recommended that the City Council recommend approval of this request with the following conditions: 1. NO MORE THAN 8 CLIENTS BE ADMITTED AT ONE TIME. 2. RETAIL SALES SHOULD NOT OCCUR ON A DAILY BASIS GIVING THE IMPRESSION OF A "RETAIL ENVIRONMENT." LOCATION City of iver 13065 Orono Parkway · P.O. My sister, Pat Egan, and I are working on plans to open a workshop stuelio. Pat and I have a reputation among friends and family in matters of art, decoration and comforts of the home. We'd like to expand what we enjoy into a family venture, and share our ideas in a workshop setting with neighbors and friends. Both Pat and I are employed in fulltime careers, and therefore, this venture is an extension of the hobbies and things that we enjoy. This is the type of business to be operated from home because it expands on what is here - the porch, garden, potting shed. To characterize "The Porch", we have noted some ideas for its operation: We see our clientele as largely female; they will come to relax, enjoy the setting, and involve themselves in projects. Projects could include items for the home: linens, candles, soaps - handmade comforts. Any sales would be incidental to the operation of the business. Days and hours of operation: Saturdays, year-round (may close January/February); 1 l:00am-5:00pm, and by appointment; seasonal open houses. Thank you for the opportunity to present this request to you. We intend to comply with the home occupation criteria as stated in City ordinances, and are willing and available to provide all information that you require to make a decision. Please feel free to contact me at any time. Respectfully yours, Teresa DeJarlais
