Request The City of Elk River is requesting consideration of the following applications: Ao Land Use Plan Amendment of approximately 70 acres of property located along Burlington Northern Railroad Tracks between 177th Avenue and 173rd Avenue, from MR (Medium Density Residential) to LI (Light Industrial) (Area #7). Bo Rezoning of approximately 70 acres as described above from Rle (Single Family Residential) to BP (Business Park) (Area #7). Attachments · Ordinance No. 98-__ · Resolution No. 98-__ · Land use plan map · Zoning map Background These two applications were presented to the City Council on March 16, 1998, and at the request of the property owner, tabled to the May 18th City Council meeting. ZC 98-1 (Area #7) The City Council of the City of Elk River does hereby ordain as follows: Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described as: See Attached Exhibit A Section 2. findings: The rezoning is being approved based on the following THE LAND USE PLAN AMENDMENT AND REZONING WILL BE CONSISTENT WITH THE COMPREHENSIVE AND ECONOMIC DEVELOPMENT STRATEGIC PLANS TO EXPAND THE INDUSTRIAL TAX BASE IN THE CITY. WITH THE REALIGNMENT OF COUNTY ROAD NO. 13, CONDITIONS HAVE CHANGED TO WARRANT A CHANGE IN THE LAND USE AND ZONING DESIGNATIONS. THE PROPERTY SUBJECT TO THE PROPOSED REZONING IS PLANNED TO HAVE ACCESS TO A ROADWDAY CONSTRUCTED TO ACCOMMODATE THE EXPECTED TRAFFIC WHICH ACCOMPANIES INDUSTRIAL DEVELOPMENT. THE AREA IS INCLUDED IN THE URBAN SERVICE BOUNDARY WHICH IS A MAJOR CRITERIA FOR IDENTIFYING AVAILABLE INDUSTRIAL OPPORTUNITIES. THE PROPERTIES TO BE REZONED ARE BORDERED BY EITHER A STATE HIGHWAY, COUNTY ROAD OR BURLINGTON NORTHERN RAILROAD TRACKS. Section 3. That this Ordinance shall take effect and be in full force from and after the date of its pubhcation. LU 98-1 (Area #7) WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure for amending the Comprehensive Plan, and WHEREAS, the Planning Commission held a public hearing February 24, 1998, and recommended approval regarding the Comprehensive Plan amendment request for the property generally described as: The area lying southwesterly of the new north/south road corridor in east Elk River, east of Burlington Northern Railway, north of 173rd Avenue and south of the 177th Avenue alignment and, WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request and finds the change to be in general conformance to the adopted Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that the Land Use Plan be amended to change the property as described above from MR (Medium Density Residential) to LI (Light Industrial). Steve Ach stated that the request before the Council pertains to rezoning certain areas marked as Area 5, Area 6, and Area 7 to industrial or business park uses, consistent with the city's Strategic Plan. Steve Ach indicated that it has recently been suggested that consideration also be given to light industrial zoning in these areas. Mayor Duitsman opened the public hearing. Craig House, counsel for Mr. and Mrs. Brown, 10815 175th Avenue (Area #7), indicated that the Brown's have a desire to look at the impact a business park would have on their property. He stated that the Brown's have requested to postpone this issue to May 18, 1998, so as to study the impact this rezoning would have on their property. 6.8. 6.9. There being no comments, Mayor Duitsman closed the public hearing. COUNCILMEMBER HOLMGREN MOVED TO POSTPONE THE CITY OF ELK RIVER'S REQUEST FOR LAND USE PLAN AMENDMENT FROM MR TO LI AND REQUEST FOR REZONING FROM R1E TO BP FOR AREA#7 TO MAY 18, 1998. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. City of Elk River Request for Land Use Plan Amendment from MR to LI (Area #6) COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 98-25 AMENDING THE LAND USE PLAN FOR AREA #6 FROM MR (MEDIUM RESIDENTIAL) TO LI (LIGHT INDUSTRIAL). COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 6.11. City of Elk River Request for Rezonin,q from PUD to BP (Area #6) COUNCILMEMBER HOLMGREN MOVED TO ADOPT ORDINANCE 98-7 REZONING AREA #6 FROM SINGLE FAMILY RESIDENTIAL TO BUSINESS PARK.
