SUBJECT: Environmental & Code Enforcement Update
SCORE Grant Update
The City of Elk River was awarded $8,282.50 in SCORE Grants, for the funding of two
projects in 1998. The first project consists of constructing a self serve compost site, and
is eligible to receive $6,756.25 in reimbursements. The site will be located between
Public Works and Oak Knoll Park. This facility will also be designed to receive wood
waste drop-off and wood chip pick-up for future residential service.
The second project consists of building refuse and recycling corrals at Orono Park. This
proposal was awarded $1,526.25 in SCORE funds. The corrals will house the refuse &
recycling carts purchased last year for the Park Recycling Program. In addition, post
consumer plastic timbers will be used to construct the corral enclosures.
Sprinl! Clean UP Day
The 1998 Spring Clean Up Day has once again proved to be a successful event. A total of
426 residents were served the event. A SCORE reimbursement in the amount of $5,000
has been designated for clean up day. This amount is based upon population. Additional
information relating to the tonnage collected and total expenses will be computed once
final figures are received.
Code Enforcement Update
Attached for your review, is a copy of the current complaint log. This year 42 complaint
cases have been registered. Of these cases, 16 have been resolved and 26 remain on-
going. Below is a breakdown of the issues surrounding each of the cases. However, it is
difficult to categorize a nuisance case into a broad category since a single case often
involves multiple code violations.

Reoccurrinl! Nuisance Cases
Residents' names that appear bolded in the complaint log involve multiple or reoccurring
nuisance cases. This equates to over 37 cases since 1995. As a result, it often appears to
neighbors that the Nuisance Code is not being enforced. All the while the City has sent
letters, telephoned or made personal visits. When a site is corrected it is frequently a
short period of time before it returns to its previous state. Many property owners in
violation, have told me, among other things to "take them to court." Knowing full well
the legal expenses and time involved in moving a few junk cars or other infractions will
be extremely costly for the City.
With your permission I would like the opportunity to research other communities'
nuisance codes and enforcement policies. Presently, many metro area communities have
adopted a method to remove and abate a nuisance once proper notice has been given and
compliance is not achieved. Costs associated with abatement are then assessed against
the property. Violations dealing with junk vehicles, noxious weeds, uncut lawn and the
removal of junk and debris are resolved in a relatively short period of time. This type of
program provides relief to neighboring property owners, as well as accountability for the
violator.
Please let me know if you feel our code enforcement program should be reviewed and

Three unlicensed and inop. vehicles, vehicles on
landscaped area, misc, junk & debris
Previous complaint concerning uncut lawn. Owner
may grow wild flowers to reduce lawn work.
Complaints date back to 1995, dealing with idling truck
for long periods of time, (Longstanding neighborhood
dispute,)
Two standing dead trees located on large corner lot.
Neighbor was concerned with the shedding problem
caused by a stand of large cotton wood trees.
several unlicensed and inoperative vehicles, and
vehicles parked on landscaped areas & with 5 ft of rear
or side property line,
Noted a large pile of construction materials, wood
debris at!d miscellaneous junk,
Noted tires, inoperative vehicles, junk & debris, junk
lawn mowers, wood waste, auto parts, bob cat etc,
This property owner is very hard to deal with,
Neighbors are complaining about the number of
vehicles stored outdoors and where they are parked,
Reoccu~ring problem concerning a treellandscaping
home business operating w/o a permit.
Ms. Fairfield's boyfriend has moved out. It appears the
auto repair business has shut down. Neighbors are
still complaining about the half built privacy fence.
Letters sent, but no response or action has resulted.
