BACKGROUND /DISCUSSION On June 11, 2012, Mayor Dietz announced the city had received the designation of Yellow Ribbon Community and proposed the official announcement take place at one of the city Riverfront Concert Series events. The Council further discussed concerns about opening a free public event up for other promotions and programs and suggested a policy. City staff and officials from The Bank of Elk River, the principal funding partner for the Riverfront Concert Series, have reported numerous requests from residents and groups to advertise, provide information, or promote their activities at city- sponsored events such as the Riverfront Concert Series. The attached policy draft would apply to all city- sponsored events. This policy details when a non -city organization/ entity may provide such a presentation. Definitions City- sponsored Event — A free admission, planned, financed (in whole or in part), managed and marketed program paid for with public monies for the leisure and entertainment of the Elk River community. May take place on public or private property. Elk River Community — City of Elk River residents, businesses, employees and visitors who participate in local activities and functions. Public Presentation — An event, program, notice, advertisement, announcement, solicitation, or warning that takes place in communal areas where groups assemble or are expected to congregate. Policy City- sponsored Events are provided for the leisure and /or entertainment of the Elk River Community. Public Presentations or promotion of programs and /or activities before, during, after or in conjunction with City- sponsored Events are strictly prohibited, with the following exceptions: a) When the Public Presentation includes an announcement of a designation, bestowment of an honor, or a special notice that positively reflects or enhances the Elk River Community. Examples of allowable Public Presentations include, but are not limited to, Tree City, Star City, Energy City, Green City, Yellow Ribbon Community, National Recreation and Parks Association Gold Medal status achievement, etc.; and b) The Public Presentation is advertised and marketed independently in advance of the City- sponsored Event; and c) The Public Presentation precedes or follows the scheduled City- sponsored Event and does not run in conjunction with or during the City- sponsored Event; and d) The city administrator or designee has approved the Public Presentation; and e) The City Council has had prior notice of the Public Presentation.
