SR 10-13-2003*Item 3.4.* MEMORANDUM TO: Mayor and City Council FROM: Joan Schmidt, City Clerk DATE: October 13, 2003 SUBJECT: Data Practices Compliance Official Minnesota Statute requires that each city designate a Data Practices Compliance Official to receive questions or concerns regarding problems in obtaining access to data or other data practices problems. City Administrator Pat I~aers was appointed the Data Practices Responsible Authority when the Data Practices Policy was adopted on June 30, 1997 and recommends that the position of City Clerk be appointed as the Compliance Official. ACTION REQUESTED Adoption of the attached resolution appointing a Data Practices Compliance Official. J':\ CO~ ~NCIL\San~y\Data Practice~:docs RESOLUTION 03 - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPOINTING A DATA PRACTICES COMPLIANCE OFFICIAL WHEREAS, Minnesota Statutes, Section 13.05 Subd. 13 requires the city appoint a city employee to act as its data practices compliance official to receive questions or concerns regarding problems in obtaining access to data or other data practices problems within the city; and WHEREAS, the City Council shares the concern expressed by the Legislature about access to city data and wishes to satisfy this concern by immediately appointing a qualified data practices compliance official as required under statute; NOW THEREFORE BE IT RESOLVED, that the City Council appoints City Clerk Joan Schmidt as the data practices compliance official to receive questions and concerns regarding problems in obtaining access to data or other data practices problems.
