Request
Gene Thompson is requesting an administrative subdivision to subdivide
40.28 acres into a 2.5 acre lot and a 37.78 acre lot.
Location
The property is located at the northeast corner of County Road #1 and 217th
Avenue.

Overview
Mr. Thompson is proposing to subdivide approximately 40 acres into 2 lots.
The property is a 40 acres of farm fields and woodlands. The 2.5 acre lot is
undeveloped and will be accessed from 217th Avenue. The remaining 37 acres
are farm fields and woods with access from both County Road #1 and 217th
Avenue; no additional driveways are proposed for the remaining parcel.
There are no wetlands on the proposed 2.5 acre parcel.
If the applicant wished to develop this property to its full potential, because
of the provision of 4 lots per 40 acres with a minimum lot size of 2.5 acres, it

might be possible to subdivide into 4 lots. However, at this time the applicant
is proposing to subdivide the property into 2 lots. Future subdivision will be
limited to 2 lots for a total of 4.
Both of the lots comply with the dimensional requirements of the A-1 district.
Streets and Easements
217th Avenue
217th is a gravel road in relatively poor condition. The existing right-of-way
for 217th is 60 feet wide. As part of the approval of the subdivision River of
Life, which is located on the south side of 217th, 43.5 feet of right-of-way was
dedicated along the south side of the road. There is 16.5 feet of existing right-
of-way along the north side of 217t~ for a total of 60 feet. Therefore, no
additional right-of-way is needed along 217t~ Avenue.
County Road #1
Sherburne County Engineering Department was contacted regarding
additional right-of-way along County Road #1. They indicated the existing
100 foot right-of-way is sufficient and no additional right-of-way will need to
be dedicated.
Easements
Drainage and utility easements will need to be provided along the property
lines of the 2.5 acre parcel.
Park and Recreation Commission Recommendation
The Park and Recreation Commission has recommended a cash dedication in
lieu of land to satisfy the park dedication requirements for the one new lot
being created.
Recommendation
It is recommended the City Council approve the request by Gene Thompson
for and an administrative subdivision to subdivide 40 acres into two lots with
the following conditions:
Drainage and utility easements be granted to the City along the
property lines of the proposed 2.5 acre parcel.

2. Payment of park dedication fee in the amount of $650 for the new lot
being created to be paid prior to recording the administrative
subdivision.
Payment of surface water management fee in the amount of $61.80 for
the new lot being created to be paid prior to recording the
administrative subdivision.
Further subdivision of the 37 acre parcel is limited to 2 lots for a total
of 4 lots and a deed restriction be recorded that restricts further
subdivision to 2 lots.
