4.2. PCAG 10-09-2012 City El REQUEST FOR ACTION River TO ITEM NUMBER Planning Commission 4.2 AGENDA SECTION MEETING DATE PREPARED BY Planning October 9, 2012 Jeremy Barnhart,Planning Manager ITEM DESCRIPTION REVIEWED By Request by Alliance Machine/Bryan Provo for Conditional Use Jeremy Barnhart,Planning Manager Permit for Outdoor Storage in the Business Park Zoning REVIEWED BY 17District,Pubic Hearing—Case No. CU 12-17 ACTION REQUESTED Staff recommends approval of the conditional use permit, subject to the following conditions: 1. The Business Park zoning districts shall be amended to allow outdoor storage as a permitted use. 2. The outdoor storage yard shall meet the requirements outlined in the ordinance, including screening, fence material, and location. Applicant Bryan Provo,Alliance Machine Location/ Address 17520 Tyler Street 60 Day Rule The City must take action by December 7,2012 OVERVIEW Alliance Machine had submitted an application to partition a portion of his lot for outdoor storage. Because this is not permitted, an ordinance amendment is required, and is being considered concurrent with this review. Affiance requires a secure location for his trailer as it has been stolen from his lot in the past. Their original plans included a 30 foot by 30 foot area immediately adjacent to their accessory structure. An 8 foot high, chain link fence was proposed, with privacy slats inserted. APPLICABLE REGULATIONS Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other proper in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant propero. P-QMIERER BY NATURE Case File:CU 12-17 Alliance Machine outside storage Page 2 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer ystems, parks and schools;and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. 5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. ANALYSIS Because the final ordinance has not been adopted allowing outdoor storage,it is not known what the Council feels as acceptable levels of screening,if any Staffs comments below are based on the draft ordinance as proposed. The use of chain link and vinyl slats does not meet the design requirements outlined. Chain link with slats is a concern because weeds and other unintentional vines grow through the chain link Additionally, the height of individual sections of the vinyl slats tends to move over time, creating a lower quality look. Staff believes a truly maintenance free solution is better for the long term. A few years ago we had our trailer parked here over night and it was stolen. We never recovered it but purchased another. This one is parked out of town and we currently run and get it when we need it.This option came to an end in August 2012 when the land owner moved. We are working hard to keep our site looking good, safe and secure. We at Alliance feel that a locked security fence on site is the most logical sensible answer to our solution. We will make it look nice and match it to the look of our building. We at Alliance Machine very much appreciate your help. Thanks, Bryan Provo • I III IIIIIIIII I III IIIII III III ( 111 _ I III IIIIIIIII II I I III IIIII IIIII The Fence would be Black painted steel with black privacy slates • • • i`
