Minnesota Municipal Utilities Association Safety Management Program Contract Renewal
BACKGROUND:
Elk River Municipal Utilities (ERMU) contracts with Minnesota Municipal Utilities Association
(MMUA) to provide safety training through their Safety Management Program and Job Training
and Safety(JTS) Program. The Safety Management Program provides required trainings on
topics such as blood borne pathogens and right to know. The program also provides customer
and customer specific trainings like Pole Top Rescue training and OSHA compliance inspections
for water and electric facilities. Elk River Municipal Utilities is one of ten municipals in the
Central Group of the Safety Management Program. The JTS program provides training more
specific for the electric and technical service departments. Elk River Municipal Utilities is one
of one of five in our JTS group. The contract period runs October— September.
DISCUSSION:
In the 2011-2012 contract period for the MMUA Safety Management Program, ERMU's cost
was $16,950. For the 2012-2013 contract period, ERMU's cost would increase by$2,000 for a
total of$18,950.
The 2009-2010, the 2010-2011, and the 2011-2012 contract periods for the MMUA JTS
Program; ERMU's cost was $6000. For the 2012-2013 contract period ERMU's cost would
again remain the same.
ACTION REQUESTED:
Staff recommends approving the renewal of the MMUA Safety Management Program and JTS
Program for the 2012-2013 contract period for a total cost of$24,950.

Subject: 2012-13 Safety Management Program Contract
It is time to renew your safety management program contract. There should be no
change from the price notification letter sent out on July 25, 2012, unless we have
discussed and agreed to specific changes. The contract amendments will cover
October 1, 2012 through September 30, 2013, to coincide with MMUA's fiscal
year.
Two copies of your contract amendment are enclosed. Please sign both contracts
keeping one for your records and mailing the other to the address shown below.
Please do not send payment at this time. You will be billed October 1. Mail your
signed contract to:

AMENDMENT TO SERVICES AGREEMENT
Safety Management Program
Contract Date: August 27, 2012 Contract Number: 5-2013
The services agreement entered into between Minnesota Municipal Utilities Association
(MMUA) and Elk River Municipal Utilities (Elk River), dated August 30, 2011, contract
number 5-2012, is amended as follows:
PART II, Section 1.
1. DURATION: This Agreement shall remain in force from October 1, 2012 until
September 30, 2013 (the "expiration date").
PART III, Section 1.
1. COMPENSATION: For the services covered by this Agreement, Elk River
shall pay MMUA an annual fee of eighteen thousand nine hundred fifty dollars
and 00 cents ($ 18,950.00) for the 2012-13 annual period. Such compensation
shall be due and payable according to the selected payment terms below.
Payment terms for the fee agreed to above shall be based on one of the
following options (select one):
❑ Annual Payment ($18,950.00)
❑ Quarterly Payments ($ 4,737.50 each)
For any term of less than twelve full calendar months, the fee shall be a portion
of the annual fee, pro-rated based on the number of calendar months or partial
calendar months in which the services were provided as a percentage of twelve
(12).
The parties hereby accept the terms of the Agreement as modified.
