ACTION REQUESTED
Staff and the Planning Commission recommend denial of the Conditional Use Permit on the grounds
that the application is inconsistent with the requirements of outdoor storage in the Business Park.
The Council has a number of options:
1. The Council could accept modifications to the outdoor storage proposal made by the applicant to
conform to the requirements established by Ordinance.
2. The Council could return any modifications made by the applicant to the Planning Commission
for review and recommendation.
3. The Council could deny the application by directing staff to prepare a Findings of Fact for denial
for adoption at the November 19,2012, City Council meeting.
It is likely that the applicant will modify his proposal.
BACKGROUND/DISCUSSION
The development of an ordinance allowing outdoor storage is progressing though the review process
(OA 12-04). The applicant was not at the Planning Commission meeting to agree to the
recommendations made by the Commission; staff and the Commission felt it more appropriate to
recommend denial due to the gap between what is proposed for outdoor storage and what the
Commission recommends as ordinance language.
Proposal
The applicant proposed a 30 foot x 30 foot area enclosed by an 8 foot high black steel chain link fence.
Screening is proposed with vinyl slats inserted through the fence. The area would be located adjacent to
the accessory structure on the property and would house a trailer.
Planning Commission comments
The Planning Commission agreed with staff's recommendation that due to the inconsistencies with the
proposed ordinance,the application should be denied.
Public Hearing comments
No comments have been received for or against this proposal. There have been three public hearings.

2. The outdoor storage yard shall meet the requirements outlined in the ordinance,including
screening,fence material,and location.

OVERVIEW
Alliance Machine had submitted an application to partition a portion of his lot for outdoor storage.
Because this is not permitted, an ordinance amendment is required, and is being considered concurrent
with this review.
Alliance requires a secure location for his trailer as it has been stolen from his lot in the past. Their
original plans included a 30 foot by 30 foot area immediately adjacent to their accessory structure. An 8
foot high, chain link fence was proposed,with privacy slats inserted.
APPLICABLE REGULATIONS
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of other proper0 in the immediate vicinity
or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding vacant property.

4. Will be served adequately by and will not adversely affect essential public facilities and services including streets,
police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and will not, in
particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares.
5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be
detrimental to any persons orproper y because of excessive traffic, noise, smoke,fumes,glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards
for the issuance of a license or permit to establish and operate the proposed use in the city.
If denial of such a permit should occur,it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
ANALYSIS
Because the final ordinance has not been adopted allowing outdoor storage,it is not known what the
Council feels as acceptable levels of screening,if any. Staff's comments below are based on the draft
ordinance as proposed.
The use of chain link and vinyl slats does not meet the design requirements outlined. Chain link with
slats is a concern because weeds and other unintentional vines grow through the chain link. Additionally,
the height of individual sections of the vinyl slats tends to move over time,creating a lower quality look.
Staff believes a truly maintenance free solution is better for the long term.

Alliance Machine Fence Request
We have a need for an enclosed trailer to deliver parts to and from our suppliers and customers. A few
years ago we had our trailer parked here over night and it was stolen. We never recovered it but
purchased another. This one is parked out of town and we currently run and get it when we need it.This
option came to an end in August 2012 when the land owner moved. We are working hard to keep our
site looking good, safe and secure. We at Alliance feel that a locked security fence on site is the most
logical sensible answer to our solution. We will make it look nice and match it to the look of our building.
We at Alliance Machine very much appreciate your help.
