As a conditional use permit is not a building permit,the applicant shall apply for all required permits. 2. The building shall meet all building codes. 3. The building shall meet all fire codes. 4. Parking on 193'd Avenue shall be prohibited. 5. Exterior signage shall not exceed six (6) square feet. BACKGROUND/DISCUSSION The applicant proposes opening a hair salon in her existing home. The applicant states that the salon will be open by appointment only. Typical hours will be 10:00 a.m. —9:00 p.m. There will be no exterior modifications and the space inside is currently separate from the main house. PLANNING COMMISSION Public Hearing One neighbor spoke during the public hearing indicating she lives next door to the subject property. She stated the applicant was a good neighbor and that she herself was a beautician. She questioned how many chairs would be in the salon (the applicant said two) and questioned what the re-sale of her property would be with a salon next door. She discussed the sidewalk the applicant is installing alongside her house and voiced concern of additional traffic. She was generally supportive of the request. It was noted that the re-sale value of any property cannot be determined based on an approval of a home occupation. The applicant noted what was happening with the sidewalk along the house was to address an ongoing soil erosion issue,but the design and placement of the sidewalk is irrelevant to the request. Planning Commission The hours of operation were clarified and the number of vehicles the applicant would possibly park on the driveway was questioned. The applicant indicated the most they would have is three. The applicant said she planned on it being permanent. The Planning Commission unanimously recommended approval of the request. The applicant states that • the salon will be open by appointment only. Typical hours will be 10:00 am- 8:00 pm. There will be no exterior modifications and the space inside is currently separate from the main house. The driveway can accommodate five vehicles and with only appointments for one client at a time and the possible overlap of two appointments there is ample parking. There currently is no parking allowed on 193` Avenue in front of the subject property. The applicant is proposing one non-illuminated wood sign in the front yard. Staff is recommending the sign not exceed six square feet in size as staff believes anything larger than that would impact the character of the neighborhood. The applicant has provided a short narrative of her request for further information. Home Occupations are regulated by section 30-801 of the Elk River Code. To paraphrase,Home Occupations are generally permitted,provided there is no visual,odor,noise,or traffic impact on adjacent properties and meet eleven criteria. The Conditional Use permit is necessary because the applicant is exceeding the permitted home occupation criteria which is the business will include the use of equipment not generally found in the P :® 11IREI IT N:\Departments\CommunityDevelopment\Planning\Case Files\CUP\CU 12-19 Wieber Hair Guru\CU 12-19 PCdocg NATURE home. The equipment used, (specialty chairs,dryers,specialty sinks, etc.) while not commonly found in a home, is not likely to be detrimental to surrounding properties. However, all building codes must be addressed through the permitting process. The proposed home occupation is consistent with the employment,hours of operation, and all other aspects of the home occupation criteria. U1 O._-1 i � Z 71411 • rii►i•:Alla --mu ift To Whom This May Concern: Please consider this proposal for Hair Guru, the salon that I wish to open and operate from my home at 11260 193rd Avenue NW, Elk River 55330. The purpose of the salon is to provide licensed,professional beautification services to patrons, in a one on one, relaxed atmosphere. Services including: hair cutting, hair coloring,hair extending, hair styling,hair removal (by waxing), and the up keep of finger nails and toe nails, will be provided. The space for this salon is located in my home, and needs minimal customization. It was/is a separate space from our regular living area since we moved in; adjoined by a door. It has plumbing access, electrical outlets, a separate entrance from the outside, and any additional needs are only limited to paint and furnishings. The hours of operation will be Tuesdays l0am-9pm, Wednesdays 10am-9pm, Thursdays 10am-8pm, and Sundays 10am-8pm. Because of the nature of the business, clientele will build over time, and be scarce in the beginning, so operations will be on a"by appointment only"basis during those hours. There will be only one employee,myself. Our driveway has 5 parking stalls, and I will only be servicing one person at a time. Were there ever to be a slight overlap in two appointments, there would still be enough parking in our driveway for each person. I anticipate the neighborhood would have zero negative impact whatsoever. Would it be necessary for a screening of the salon, it could be arranged by contacting me, but a formal screening has not been scheduled. The only"building material"needed would be a shampoo bowl/cabinet/sink that would be connected to existing plumbing. That equipment would be in accordance with Minnesota cosmetology laws and rules, as would any other furnishings. I would like to have permanent signage in the front yard. The sign would be singular, and would meet city limitations for permanent signs. It would be constructed of wood, and would bear no lighting. No outdoor storage is needed for this type business. Once a permit for this business is granted, I will proceed with the Salon licensure through the Minnesota Board of Cosmetologist Examiners department. Any and all business and services will be conducted in accordance with Minnesota Cosmetology laws and rules. The salon will remain licensed as long as it is operational, and will be inspected by the state as they see fit. Thank you very much for your time in this matter.
