Location 1011 Manor Place Part of Lot 2 of Auditor's Subdivision No. 3 Zoning/Land Use R-lc (Single Family Residential) / MR (iVleditma Density Residential) Attachments · Location map · Memo from the City Engineer · Survey Analysis The subject property is located at the southwest corner of Manor Place and Morton Avenue. It is approximately a .91 acre lot with an existing single family home and two accessory buildings on the property. The proposed subdivision will create two parcels to allow a second buildable lot. The new lot will be .55-acres and will contain two accessory buildings and the lot with the existing house will be .36-acres. City Council AS 03-03 July 21, 2003 Page 2 The ordinance does not allow accessory buildings without a principle structure. Staff suggests that a condition of approval be that the property must have a house built on it within one year or the accessory buildings will be required to be removed. In the past for similar requests, an escrow of $1,000-2,000 has been required to ensure compliance with the condition. The two lots meet the minimum required lot size for the R-lc zoning district. The rear and side yard building setbacks are met for the existing building. Grading. Drainage and Utilities Grading, drainage and utility issues are addressed in the City Engineer's memo. Park and Recreation Commission The Park and Recreation Commission recommended park dedication in the form of cash for one lot. Recommendation Staff recommends that the City Council approve the Simple Plat request with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. 2. PARK DEDICATION FEES FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 3. A SINGLE FAMILY RESIDENCE SHALL BE BUILT ON PARCEL B WITHIN ONE YEAR OF PLAT APPROVAL OR THE ACCESSORY BUILDINGS WILL BE REQUIRED TO BE REMOVED. THE APPLICANT SHALL ESCROW $1,500 TO ENSURE COMPLIANCE WITH THIS CONDITION. 4. SURFACE WATER MANAGEMENT FEES FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 5. It consists of subdividing a parcel of land on the west side of Morton Avenue, just south of Manor Place, into two parcels. Parcel B, the newly created piece, is approximately .55 acres, and Parcel A, which has the existing home on it, is approximately .36 acres. As we discussed, the City ordinance requires that a simple plat be prepared instead of an administrative subdivision. Because of this requirement, we have not reviewed the parcel descriptions on the administrative subdivision. When a simple plat is prepared for this subdivision, the required drainage and utility easements should be provided around the perimeters of both Parcel A and Parcel B. The existing home is on Parcel A, and the existing garage is on Parcel B. The new home site will, therefore, be on Parcel B. There is no indication on the administrative subdivision how sanitary sewer and water service will be provided to Parcel B. According to City records, there is no sanitary sewer in Morton Avenue south of Manor Place and no water in Morton Avenue south of Angel Avenue. According to City ordinance, every individual residence must have its own sewer and water services. This issue needs to be resolved before final approval is granted. Based on our review of the administrative subdivision, once a simple plat is prepared in lieu of the administrative subdivision and the sewer and water issue is resolved, we will be prepared to recommend approval of this proposed lot split.
