The site is located north of 3ra Street in the northeast comer of the intersection of Line
Avenue and County Road 12 (Main Street).

Analysis
The applicant processed a preliminary and final plat to subdivide two lots in Mulvany Point
into individual lots for office townhomes in 2002. The applicant has since decided that they
would prefer to "condominiumize" the building as opposed to selling the offices as
townhomes, which would have included a small portion of the land surrounding the
individual townhome unit. In order to accomplish a condomim'um plat of only the building,
the existing townhome lots must be eliminated and a separate condominium plat filed over
the building. In order to eliminate the lot lines, a simple combination of paperwork filed at
the County will not suffice. The plats must be replatted back into one lot to accommodate
the condominium plat.
Planning Commission Action
At its September 23, 2003 meeting, no one spoke for or against the request. The Planning
Commission voted unanimously to recommend approval of the request to the City Council
Recommendation
Staff recommends that the City Council approve the preliminary and final plat of the Pines
Town Office 2nd Addition.

Dear Ms. McPherson:
As requested, we have reviewed the proposed final plat of The Pines Town Office Park 2"d Addition.
It is the replat of one of the five lot blocks on the north side of Third Street. It is being replatted into
just Lot 1, Block 1 for the purposes of creating a condominium building. There is a ten-foot wide
drainage and utility easement, which runs the full length of all of the five underlying lots. There is also
a triangular drainage and utility easement in the northeast comer of the existing Lot 5. It is unclear
from the line weights used on the final plat of the 2nd Addition whether or not these drainage and utility
easements will still be in effect with the replatting into Lot 1, Block 1. The drainage and utility
easements should remain in effect with the replatting into Lot 1, Block 1.
With this comment, we would recommend approval of The Pines Town Office Park 2nd Addition.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
The Pines Town Office Park 2nd Addition
Case No. P 03-08
WHEREAS, application has been made for final plat approval, pursuant to Section
1008.08 (1) (c) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the application for preliminary' plat approval has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
WHEREAS, a prel/minary plat of the Property was approved by the City Council on
October 20, 2003; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as
approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth
by the City Council in its approval of the prelim/nary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
specialized city, county, and regional plans including, but not limited to,
Comprehensive Development Plan.

C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and sikation, susceptibility
to flooding, and drainage are suitable for the type and density of development and
uses contemplated.
D. The proposed subdivision makes adequate provision for water
storm drainage, sewage transportation, erosion control and all other
facilities and improvements otherwise required herein.

E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member and
