MEMORANDUM TO: FROM: DATE: SUBJECT: Mayor and City Council Michele McPhersoh~Director of Planning October 20, 2003 Case No. P 03-08 Request by Ravia Real Estate Plat Approval LLC for Preliminary and Final Request Ravia Real Estate LLC, the applicant, requests that Lots 1 through 5, Block 2, the Pines Town Office Park First Addition be platted into one lot. Attachments Location Map · September 8, 2003 Memo from the City Engineer · Plat - The Pines Town Office Plat - The Pines Town Office 2nd Addition · Resolution No 03- __ Granting Final Plat Approval Location The site is located north of 3ra Street in the northeast comer of the intersection of Line Avenue and County Road 12 (Main Street). Zoning/Land Use/Zoning BP, Business Park ? LI, Light Industrial Memo to Mayor and City Council/P 03-08 October 20, 2003 Page 2 Analysis The applicant processed a preliminary and final plat to subdivide two lots in Mulvany Point into individual lots for office townhomes in 2002. The applicant has since decided that they would prefer to "condominiumize" the building as opposed to selling the offices as townhomes, which would have included a small portion of the land surrounding the individual townhome unit. In order to accomplish a condomim'um plat of only the building, the existing townhome lots must be eliminated and a separate condominium plat filed over the building. In order to eliminate the lot lines, a simple combination of paperwork filed at the County will not suffice. The plats must be replatted back into one lot to accommodate the condominium plat. Planning Commission Action At its September 23, 2003 meeting, no one spoke for or against the request. The Planning Commission voted unanimously to recommend approval of the request to the City Council Recommendation Staff recommends that the City Council approve the preliminary and final plat of the Pines Town Office 2nd Addition. It is the replat of one of the five lot blocks on the north side of Third Street. It is being replatted into just Lot 1, Block 1 for the purposes of creating a condominium building. There is a ten-foot wide drainage and utility easement, which runs the full length of all of the five underlying lots. There is also a triangular drainage and utility easement in the northeast comer of the existing Lot 5. It is unclear from the line weights used on the final plat of the 2nd Addition whether or not these drainage and utility easements will still be in effect with the replatting into Lot 1, Block 1. The drainage and utility easements should remain in effect with the replatting into Lot 1, Block 1. With this comment, we would recommend approval of The Pines Town Office Park 2nd Addition. If you have any questions regarding this proposed final plat, please call. Sincerely, Howard R. Green Company T e~~P.
