4.5 PCSR 11-13-2012 Crty of Elk REQUEST FOR ACTION River To ITEM NUMBER Planning Commission 4.5 AGENDA SECTION MEETING DATE PREPARED BY Planning November 13, 2012 Jeremy Barnhart,Planning Manager ITEM DESCRIPTION REVIEWED By Request by Cornerstone Auto Resource for Conditional Use Jeremy Barnhart, Planning Manager Permit,Public Hearing—Case No. CU 12-20 REVIEWED BY ACTION REQUESTED Staff recommends that the Planning Commission recommend approval of the Conditional Use Permit request, as illustrated on the following drawings: • Building elevations dated October 25, 2012, sheet A4 • Overall site plan dated October 25,2012, sheet Al • Overall floor plan dated October 25, 2012, sheet A2 • Landscaping plan (to be distributed at Planning Commission meeting) with the following conditions: 1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all require permits. 2. The development shall meet all applicable fire codes. The Fire Chief shall verify the location of all fire hydrants, and may require additional hydrants necessary to preserve the health and safety. 3. Landscaping plan illustrated on plans dated (TBD) 4. The sign package is not approved 5. The plat shall be recorded and fees paid prior to release of the building permit. Applicant Cornerstone Auto Resource Location/Address 17219 Highway 10 60 Day Rule The City must take action by November 26, 2011 BACKGROUND/PRECEDENT Auto sales are a conditional use in the C-3 Zoning District. Expansion of the building requires a Conditional Use Permit. Case File:CU 12-20 Cornerstone Conditional Use Permit Page 2 The applicant received Conditional Use Permit approval in 2006. The development of the project was to occur in 6 phases;to date, the first two phases are complete. The approval documents in 2006 included a sunset date of 2010 for completion. Since that date has passed, a new Conditional Use Permit is required. OVERVIEW The applicant seeks Conditional Use Permit approval to add approximately 16,000 square feet of showroom and sales area to the on to the existing 38,400 square foot car dealership. This addition is the first of several planned, including expansions to the parts and service centers. The first two phases of the original 2006 expansion plan have been completed, including renovation of the then existing dealership, improvements to the parking lot, and construction of the car wash/ detail service. Although there is some minor increase of the square footage, the planned improvements are generally consistent with the original approval. Signage. The application proposes several wall signs. These signs exceed the amount of signage allowed by ordinance, and are the subject of a variance request (V12-02). The approval of the signage is not covered by this Conditional Use Permit. Building materials. The building materials consist of architectural metal panels (white for Kia,gray for Chrysler, silver for Ford),glass, and EIFS. The design of the buildings meets the intent of the design requirements. The exception is the east elevation;the applicant proposes EIFS,where two approved wall materials are required. It is recognized that much of this wall will be an interior wall in future phases and the additional materials can be absorbed at that time. APPLICABLE REGULATIONS Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of otherpropery in the immediate vicinity or the public health, safey, morals, comfort, convenience or general welfare of the neighborhood or the ciy. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant propery. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools;and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. S. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons orpropery because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. N:\Departments\Community Development\Planning\Case Files\CUP\CU 12-20 Cornerstone Auto\CU 12-21 ER Cornerstone SR to PC 11-13- 12.docx Case File:CU 12-20 Cornerstone Conditional Use Permit Page 3 If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for a CUP as outlined,it appears that the request is consistent with all of these standards. ANALYSIS Comprehensive Plan/ 171s`Focused Area Study The use of the property for auto sales is appropriate based on the Comprehensive Plan and the 171st Focused Area Study. The Focused Area Study anticipates that changes to Highway 10 access may impact businesses that rely on direct or nearly direct access off of 10. This is one of those businesses. Transportation/ Circulation Access to the site will be via driveways off of 173rd from the north and 171st from the south. Accesses off of Highway 10 were closed by the applicant in 2006. It is important to note that when access off of Highway 10 shifts, the Chrysler and Kia will be furthest from the likely primary entrance, at 171st, coming from the east. Utilities No changes to the utilities are proposed. Landscaping Landscaping was proposed as part of the 2006 submittal. No changes are suggested, although a site inspection will be completed to ensure all trees are still living in the spring. Rooftop units In the review of the application, staff had noted that a number of roof mounted units are not screened, clearly visible from the adjacent Highway 10,in particular from the south. Roof top units are to be screened from adjacent public ways as viewed at the property line. The city requires improvements to developments that do not meet the present day standards in scale with the level of their improvement. After review, staff determined that screening the southern portion of the building would be inconsistent with the scaled improvements; these units do not need to be screened, although staff continues to recommend that to the property owner, as these improvements detract from the high quality brand they are developing. Some changes have occurred and city staff asked that we clarify some issues. Exterior Materials KIA Entrance KIA has started a"Branding Program"and they have their own entrance and exterior look, something all franchises are doing. When we originally designed the KIA entrance (south elevation),they did not have their branding look in place. Since we have already obained KIA's approval of the original entrance we don't have to modify it,but we have elected to do it so it is not an issue with them in the future. A colored picture of the KIA branded entrance is included. It consists of off white architectural metal panels and architectural glass. A floor plan is attached showing where various materials will be on the exterior of our proposed addition. Chrysler Entrance Chrysler's exterior branding consists of gray architectural metal panels with architectural glass and what they call a Millennium Arch connected entrance. Our architect wrongly labeled this entrance and the Ford entrance as free standing signage. A colored picture of the Chrysler look has been provided. Ford Entrance The Ford entrance is a connected swept arch made of metallic silver architectural panels and architectural glass. A colored picture of the Ford look has been provided. We feel that the Ford architectural panels will blend nicely against our existing siding. East Elevation The only portion of our proposed addition not restricted by franchise branding requirements is the east elevation. This wall will be an off white Eifs. We originally planned to tie the three franchises designs together with natural limestone accents, but the change to the KIA entrance makes this difficult and results in a"busy" look. Roof Top Units The mechanical roof top units for the proposed addition will either be positioned away from the edge of the roof or screened so they can't be view from adjacent property. We hadn't planned on screening our existing roof top units. Signage Currently we have three separate businesses housed in one building. This will eventually be four businesses, if and when Mahindra is made available in America. Architecturally we are required to incorporate the various franchises' look or branding into our proposed expansion. Similarly, each franchise has its' required signage. Through previous approvals we have all of their freestanding signage requirements met. Existing Freestanding Siznage Chrysler Sign 150sf Ford Sign 130sf • KIA 92sf Mahindra 114sf(approved but not erected) Message Center 200sf Monument 64sf Ford Truck Osf(removed) Total 750sf(no change to our freestanding signage is proposed) The following table lists our existing wall signage and proposed wall signage to meet franchise requirements. One 28sf name plate has been added since the original 9/24/12 memo due to KIA's branding requirements. The number of wall signs we are requesting is not allowed by city code, so we are requesting a variance. We have recently removed the"Mercury"name plate from our building and the "Mahindra"name plate may or may not happen. In addition, four large"Elk River Ford Dodge Jeep" signs will be removed when we expand. We contend that with the amount of wall space we are adding our requested wall signage is not excessive. Building elevations showing the proposed wall signage are attached. We also feel that we are in a unique situation with four businesses in one building, each with a set of requirements that needs to be met to keep their franchise. This plat consists of three lots. One lot will accommodate our expansion and the other two will be outlots that will be developed into two commercial lots each in the future. Outlot A will be owned by Cornerstone and Outlot B will be owned by LeFebvre's. We are requesting a renewal of Conditional Use Permit to enlarge our facility located at 17219 Highway 10, Elk River, Minnesota. The purpose of our proposed expansion is to accommodate the needs of our customers and the requirements of the four vehicle franchises (Ford, Chrysler, KIA and Mahindra) housed in our facility. We are also requesting a variance regarding the amount of wall signage, which is discussed later in this memo under"Wall Signage". We first gained approval for our expansion in 2006. At that time we anticipated doing the project in phases, which included: 1. a redesign of our parking lot 2. a carwash/detail center 3. an expansion to our showroom/office area 4. an expansion to our parts area 5. an expansion to our service lane 6. an expansion to our service area. The original Conditional Use Permit (CUP) gave us until 2010 to complete all phases of this project. To date, numbers one and two on the list have been accomplished, but for various reasons the other items have not. In the spring of 2013, we would like to expand our showroom/office area. The footprint of our expansion has been reduced from what we were originally approved in 2006. We are no longer anticipating expanding our service lane and the adjacent office areas will not be built. The timeframe for expanding our service and parts areas will depend on need. Drainage and parking on the site have already been accomplished. The only additional landscaping will be used for screening our showroom from the parts area and grass and some trees adjacent to the new showroom floor. Detailed plans of our proposed expansion are attached. Hours of Operation We are not proposing to change our hours of operation. Our hours are currently: 7:00 am to 8:00 pm Monday through Thursday 7:00 am to 6:00 pm Fridays 8:00 am to 5:00 pm Saturdays closed on Sundays. Number of Employees We currently employ about 120 full time and part time employees. Parking Now After Expansion Customer 56 56 Employee 123 123 Service 85 85 Sales Display 679 679 Car Wash 21 21 (customer, vacuum, and vehicle drying) Total 964 964 Exterior Building Materials The office/showroom and service lane additions will be limestone on the bottom of the walls and some columns, stucco above, and architectural glass. The stucco will be buff colored and the trim brushed bronze. These materials will be used on the sides of the 2 building facing 171st Avenue, Highway 10 and 173`d Avenue. The addition to our parts area will be architectural concrete tip-up panels similar to the carwash on the campus. No decision has yet been made regarding the outside materials for the service addition. Entrances The showroom will have three separate and distinct entrances to reflect the "Branding" of KIA, Chrysler and Ford. There is a delay with our forth franchise, Mahindra, becoming available in the United States. No exterior changes are anticipated with this last franchise with the exception of one wall sign. Exhibit A shows the typical swept entrance Ford is now requiring. Exhibit B shows Chrysler's required Millennium Arch design for their entrance. KIA's entrance can be noted on the building elevations submitted. The limestone, stucco, glazing and trim will be used to tie the three entrances together. Signage Freestanding Signs We will have five freestanding signs after our Mahindra sign is erected. These five signs have already been in front of the Elk River City Council and approved. Wall Signage The existing tower with the "Ford" emblem on it is proposed to be razed. Each manufacturer has their required wall badges (wall signs). We are requesting the following walls signs: Chrysler requires four wall badges, one for each make of vehicle: Chrysler, Dodge, Jeep and Ram. When Chrysler reviews our plans they will dictate the size and positioning of the wall badges. The maximum size for Chrysler wall badges is the 17 series shown on Exhibit C. The combined total of these four wall badges is 234 square feet. Exhibit D shows how these wall badges are typically placed on a building. Ford requires two wall badges. They are the Ford Blue Ovals; one of which will be placed over the Ford entrance and one will be over the showroom windows for Ford, similar to how they appear on Exhibit A. We are not a Lincoln dealer and Mercury is no longer being made so no wall badges for these brands will be required. The maximum Blue Oval size is 9 foot 7 inches by 4 foot 2 inches or approximately 40 square feet; therefore, these two signs will be a maximum of 80 square feet. KIA requires one wall badge which is currently attached to our building. Exhibit E shows the dimensions of this wall badge, which is approximately 42 square feet. Sorry we don't have a color version to show you, but the border and letters are red and the background is white. Mahindra requires two signs, a wall badge and a nameplate below it. The size of the two signs combined measure approximately 66 square feet. Exhibit F shows the dimensions of the Mahindra wall badge and nameplate. In this case the oval is red and the lettering is black, both on a white background. 3 Name plates In addition to wall badges, Ford and Chrysler require the dealership name adjacent to their entrances. Exhibit G depicts a nameplate from another of our dealerships, but it is the size we are proposing for this location. We are requesting two nameplates that state, "CornerStone". They measure 28 square feet each for a combined total of 56 square feet. The City's Ordinance allows up to three walls signs per occupant. Our four franchises: Ford, Chrysler, KIA and Mahindra truly are four separate businesses with definite signage requirements. We exceed the frontage needed to have 300 square feet of wall signage per business or 1,200 square feet of combined wall signage for the four franchises and 12 wall signs. Our combined request is for 10 wall signs for a total of 478 square feet. The only issue is Chrysler requiring 4 wall badges. A letter from Chrysler (Exhibit H) emphasizing the importance of having all four Chrysler wall badges is attached. Five Criteria for Granting a Variance 1) The purpose for the C-3 Highway Commercial District is to recognize the need for commercial establishments on or serving with immediate access to major highways. We feel that having the requested wall signage visible from Highway 10 meets this purpose. If you can't advertise what major brands you have you can't serve your customers. 2) The Elk River Comprehensive Plan anticipates our location being highway business. Highway businesses have unique signage needs in order to serve on a major highway with major highway traffic speeds. We feel our request is consistent with the City's Comprehensive Plan. 3) Our intended use of our property is consistent with the City's Zoning Ordinance. The amount of wall signage requested is beyond what is typically allowed, but it is a reasonable request considering the size of building and the fact that there are four businesses located in it. 4) Our request for additional wall signage is to meet the requirements of our franchise (in this case Chrysler), which affords us the ability to sell their products. It is not a case of us merely wanting more signage. 5) After the expansion, we will have a large building on an even larger lot and the amount of wall signage will seem small in comparison. It will not alter the essential character of the locality. Exhibit I shows the wall badges discussed above to scale on our proposed building. 4 Outside Storage The only outside storage proposed will be adjacent to the parts loading area. Overnight deliveries of heavier items such as transmissions and motor blocks will be left outside until the next morning. 5 E X F-I I B i r A Y+f p a -t XH I BIT B BY : Principle Group M,: n tr x'r, {l, W y , r i. , ,,, ..e' t 3 r v , TM Y i 1 tT` f ',. i''i 1 i y 4 a t µr .,.1'..:,-, '.-.4.11Y rar. Customer Approval Side View Side View Date EXHIE31-1- H 111.1 111.1 Chrysler Group LLC Denver Business Center August 18, 2011 Mr. Scott Powell Elk River Chrysler Incorporated Elk River, MN 55330 Subject: Signage Dear Mr. Powell. I enjoyed meeting with you and Mr. Rohlf on August 10, 2011. It is exciting to see your plans for the new facility that will represent our Chrysler, Dodge, Jeep, and Ram brands extremely well to your customers and the community! Your dedication to providing an excellent facility and dedication to customer service is admirable. I know you have been involved in the community for a long time and have an excellent reputation. The purpose of this letter is to communicate the critical nature of having our corporate signage prominently displayed at your dealership in Elk River. Per your dealer agreement, it is required that you have corporate signage displayed that includes both a brand sign and badges on the building. As with all manufacturers, the proper signage is extremely important to the customers that you serve as a franchised dealer to let them know in a very clear, easy to observe way that you are in business to serve them. Without proper signage, the franchised dealer can suffer from severe hardship, lost service, and be put in a competitive disadvantage. The customers have a difficult time finding the place of business and are also inconvenienced. Chrysler also has a Dealer Standards program that rewards dealers that have remodeled their facilities to better serve their customers and have a better presence in the community. Without the correct signage, Elk River would suffer financially by being penalized in this program due to unacceptable signage. With the required signage, they will be able to earn significant financial rewards that will allow them to be a stronger and more viable business in the community. My understanding is that the city of Elk River wants you to have three of our four brands represented with the badges on the budding. While we certainly repect their ordinances, etc., we are simply asking for a reasonable approach to this issue. We and you as a business owner have the right to display the franchises that you represent. In the fourteen states that we represent out of our Business Center, I have never had a request to display three of our four brands. We have four franchises on our brand sign (Chrysler, Dodge, Jeep, and Ram). Putting three of the four brands on the building would not be acceptable and would not be approved. The requirements for size of our signage, etc. can be obtained through our sign company (Principle Sign Company). 1 know Steve Rohlf has all of their contact information. Please let me know if I can assist you any further. Please relay this information to the city so we can get this issue resolved. Thank you. Sincerely. John A.
