Staff and the Planning Commission recommend approval of the Interim Use Permit extension to
December 31,2015.
BACKGROUND/DISCUSSION
LeFebvre Properties LLC was issued an interim use permit to install a temporary office structure near
their office building at 10895 - 171'Avenue NW in 2006.
This extension will allow their market to stabilize,allowing them time to seek a long-term solution that
best suits their needs. At the conclusion of this extension in 2015,the office structure will be located on
the property for nine years.

ACTION REQUESTED
Staff is recommending that the Planning Commission recommend approval of a 3-year extension of
Interim Use Permit CU 06-22 for LeFebvre Properties, 10895 171"Avenue NW,issued in August 2006.
The 1st extension to the original Interim Use Permit,issued in 2009,is slated to expire December 31,
2012. Staff recommends approval of the Interim Use Permit and site plan dated July 7,2006, subject to
the following conditions:
1. THE INTERIM USE PERMIT SHALL EXPIRE DECEMBER 31,2015.
2. ALL FIRE AND BUILDING CODE REQUIREMENTS SHALL BE ADDRESSED.
3. IF THE APPLICANT DESIRES THE TEMPORARY CUP TO BE EXTENDED
BEYOND DATE ABOVE,THE INTERIM USE PERMIT SHALL BE AMENDED
FOLLOWING REVIEW BY THE PLANNING COMMISSION AND CITY COUNCIL.
BACKGROUND/DISCUSSION
The original Interim Use Permit was issued on August 21, 2006 that permitted the use of a temporary
office trailer for office needs. The extension is necessary because, although they need office space, they
have seen a major decrease in their business, making them hesitant to invest additional capital until
business improves.
There are no changes to the original approved site plan proposed.
The original Interim Use Permit extension is attached for reference.

Dear City Council,
The purpose of this letter is to formally request a three year extension on our Interim Use
Permit for LeFebvre Properties LLP, from December 31, 2012 until December 31, 2015
This permit was originally approved by the City Council at their September 21,2009
City Council meeting. The permit in question is set to expire on December 31,2012
A soft economy has caused a major decrease in our business which is the hauling of
concrete products around the upper mid west.
This forces us to delay plans to build, remodel, or expand our existing facility located at
10895 171st Ave.NW. Elk River, MN
However,the need for this additional office space provided in the temporary trailer still
exists,
The office trailer complies with all codes for wind loads,tie down, and handicapped
accessibility. It is painted to match the buildings and landscaping blends it nicely into
it's surroundings.

extension prior to its expiration. A Conditional Use permit authorizes only the use specified in the.

due to the fact that it's near the commuter rail. He feels a market rate rental would be a
better way of handling this property.

Ms.Mehelich presented the staff report.
Councilmember Motin asked if the purpose of the grant is for economic development,
affordable housing,or both.
Ms.Mehelich stated that MHFA works closely with DEED on housing projects that meet
their goals.
Councilmember Motin asked if it is required that the project provides affordable housing.
He stated he is not in support of this concept.
Mr.Duffy stated it was their intent to run these two applications together and probably
wouldn't go ahead with the development if they didn't receive support of the City to apply
for federal tax credits.
