No change to the flood plain is permitted. In addition to these 4 conditions, staff suggests the two following conditions: 5. No parking shall be permitted within the County Road 12 Right-of-Way without County approval. 6. This Conditional Use Permit shall terminate with the termination of the Conditional Use Permit for Spectrum High School at 17791 Industrial Circle. BACKGROUND/DISCUSSION Spectrum Charter school seeks Conditional Use Permit approval to improve the approximately 39 acres at 10129 181st Avenue into an athletic complex featuring a softball,a baseball,and two multi-use fields. One of the multiple-use fields will be lit in phase two of the improvements. Other improvements include grading,landscaping,renovation of the storm shelter into restrooms, shelter,and storage,and parking lot improvements,including lighting. The issues in summary: Floodplain: Much of the property is impacted by the recently amended flood regulations. The applicant has developed a plan acceptable to the Environmental Administrator and the Department of Natural Resources as having no measurable impact to the flood levels upstream. Lighting: The parking lot lights comply with City Code. City Code does not expressly regulate field lighting. Although there is no light glare, light will be visible at the property lines. The applicant proses hooded lights to minimize impact of the field lighting. Parking: Based on the seating capacity of the bleachers, 84 parking spaces are required. The existing parking lot will provide 73 spaces. Room for an additional 110 spaces (overflow/proof of parking) is provided. Landscaping: Landscaping based on the portion of the parcel south of Trott Brook. Since no development is occurring north of Trott Brook,all landscaping and credits are applied to landscaping in the area of development,leaving the natural areas natural,which staff believes is the intent of the ordinance. Planning Commission Comments Planning Commissioners held their public hearing on November 13,2012. Commissioners discussed the lighting,parking on County Road 12, and overflow versus improved parking. The Commission agreed with staffs recommended 4 conditions. Staff added the last two conditions to memorialize comments made at the meeting. Public Hearing Comments No comments for or against the proposal have been received. FINANCIAL IMPACT None. OVERVIEW Spectrum Charter school is seeking a Conditional Use Permit to develop the approximately 39-acre parcel on County Road 12 into a sports athletic complex accessory to their school at 17791 Industrial Circle. Staff has classified the use as institutional, due to its ties to the Spectrum School. Institutional is a conditional use in the R-1d zoning district. The property will be used primarily by Spectrum School for their after-school athletic programs,including practices and games. The property will be used throughout the late summer through October, and again in the spring through early summer,by the school. The school may elect to allow additional parties,including the city and youth organizations, to use the complex, although no agreements are yet in place. The improvements include grading of the property for four fields,including fields for softball,baseball, and two multi use fields, one of which is proposed to be lit. Other improvements include landscaping, modifications to the existing storm shelter building into restrooms, and improvements to the parking lot. ra E R E R .1 NATURE Case File:CU 12-21 Spectrum sports complex Page 2 The existing 73 space parking lot will serve the complex and will be improved with curbed landscape islands. Spectrum plans a field house in the future,generally south of the existing storm shelter building. Because details on the field house have yet to be determined, the field house will require an amendment to the CUP,and likely additional parking. Access to the parking lot will come off of County Road 12;the County has indicated their comfort with this proposal. BACKGROUND/PRECEDENT Spectrum High School was granted Conditional Use Permit approval in December 2010 to locate their business at 17791 Industrial Circle. That site offers limited opportunity for outdoor activities,including zero opportunity for baseball or softball, and with the recently approved expansion, full size soccer and football. The proposal satisfies these needs and provides opportunity for expansion with a future field house. APPLICABLE REGULATIONS Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of otherpropery in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the dy. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacantpropery. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. 5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be detrimental to any persons orpropery because of excessive traffic, noise, smoke,fumes,glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for CUP as outlined,it appears that the request is consistent with all of these standards. ANALYSIS The proposal includes plans for separate baseball, softball, football, and soccer fields. The soccer/ football fields are multi-use, and could be programmed for other events. The larger of the two fields is lit, and includes bleachers. Spectrum has indicated their plans to move the bleachers around, to accommodate seasonal activities. The area will need to be graded to maintain the necessary"flat" surface for sports fields. Much of the property is located within the flood fringe, and the applicant must prove there is no increase to the flood elevations. Staff and the DNR have reviewed the application documents, and are comfortable with the proposal. A formal NPDES permit will need to be approved because the impacted are is larger than 1 acre. Parking Parking for assembly,including sports arenas,is based on one parking stall per 3 seats at design capacity. The plans include six 42-seat movable bleachers,generating 252 seats,requiring 84 parking stalls. Because there are a number of activities proposed for the athletic complex, staff applied the parking demand of the single highest user,which is likely to be football. In addition to the 73 parking spaces, Spectrum provides 110 proof of parking/ overflow spaces, exceeding the requirement. In summary, the facility provides 73 of the required 84 spaces,plus an additional 110 spacing in the overflow area. Lighting The site improvements include additional parking lot lighting, and in phase II, field lighting. Lighting levels have been provided for both the parking lot and the field. Parking lot lighting The parking lot lights meet the lighting requirements of the ordinance, although it is unclear how high the poles are. Field lighting Phase II of the project is the lighting of the main athletic field. There is no timetable to add the lights. Four 70 foot high poles are proposed,with hooded fixtures. The lighting plan shows light directed at the field;at the adjacent property lines (measured three feet above ground level), the foot-candles measure no higher than .04. At this level, the nearest home site, according to the Kliever Lake Fields East plat,is 150 feet away. The nearest home is 460 feet to the east, and 490 feet to the south. Field lighting is not regulated specifically by the Zoning Ordinance. In these situations, the Planning Commission should look to the standards for granting a Conditional Use Permit, determining if these standards are satisfied. Generally, the largest issue associated with field lighting is impact to adjacent property owners. Staff comments have been centered on the reach of the lighting on adjacent county roads and residential property. While the lights are designed to minimize light spill (confirmed by the light photometric plan), a neighbor will still see illumination in the night sky. While this illumination cannot be blocked, the landscaping plan was designed to create a vegetative buffer on the south property line, to help mitigate the impacts. Landscaping The ordinance requires landscaping at a ratio of 3 trees,plus one tree per 40 feet of perimeter of the `described area'. Spectrum has developed a landscaping plan that is based the number of trees on the perimeter of the lot south of Trott Brook,which is supported by staff. Staff believes this is the intent of the ordnance,preserving natural areas while adding trees to the building environment. The plan requires 95 trees on the property. Applying the credits for existing trees and existing oversized trees and for natural grass areas, (all south of Trott Brook) the plan provides 63 trees and 49 shrubs. These trees are provided primarily along the south property line. Existing stands of trees along the west and east property line are being preserved. C&P Properties of Elk River is the property owner. The purpose of the CUP will be to construct athletic fields for football, soccer,and other programs. Spectrum High School is a public charter school located in Elk River,MN. We are currently in our 7th year and have an enrollment of 500 students. This is our second year in a new building which includes a double gymnasium. We remain committed to academic excellence with a focus on college preparatory curriculum, high behavior standards,the integration of technology into our curriculum, and service learning projects throughout the community. It has been exciting to see the growth at Spectrum extend throughout music,theater, and athletic programs. We currently offer 14 varsity sports for boys and girls. As with all extra-curricular activities, athletics is an extension of our classroom. Having our own athletic fields will improve the efficiency of extracurricular activities and enhance the entire education experience for students. It will also add additional athletic and recreation resources to the city. The location of the land is 10129 1815`Ave.NW is the site of our former school when Spectrum was housed in modular units. The 18 acres is ideally suited for athletic fields and already has the necessary infrastructure including a storm building,parking lot, and city services(sewer,water, and electricity). The land is a short 5 minute activity bus ride from the school building. The initial plan is to build a large multi-purpose athletic field that may be divided into two adjacent soccer/football fields in the fall and used for baseball in the spring. One of the football/soccer fields will include bleachers, a scoreboard, and possibly light poles in the future. A separate softball field will be constructed just north of the existing storm water pond. Since the land is located on a flood plain(outside of the flood way); structures will not be constructed that would impede water in the event of a 100 year flood. This means that the bleachers, scoreboard poles, light poles,backstop, and any fencing would allow water to pass. There will not be any baseball dugouts or building structures constructed in the flood plain next to the athletic fields. The existing storm building will be remodeled to include heat,restrooms,and storage. The building will continue to also serve as an on-site storm shelter. The long range facility plan may include the addition of a field house and a classroom building.The field house would attach to the existing storm building and provide space for wrestling, cheerleading, dance team, and other recreation and athletic programs.
