SUBJECT: Consider Amendment to Animal Ordinance relating to Kennels
REOUEST
Staff is requesting an amendment to Section 502 of the City Code relating to kennel licenses.
BACKGROUND
The reason for the amendment is to clear up an area of confusion relating to the number of
animals required for a kennel license. The existing ordinance indicates that a person can have
'~ dogs or cats"before a kennel license is required. The question always comes up as to
whether this means 3 dogs and 3 cats or a total of 3 animals.
Staff's interpretation of the ordinance is that a kennel license is required if there is more than
3 animals total. The exception is for landowners of 10 acres or more, who may then have 3
dogs and up to 10 cats. The attached ordinance amendment reflects staff's interpretation.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 502 OF THE CITY CODE OF ORDINANCES
"DOGS AND OTHER ANIMALS"
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 502.00 titled, Definitions - Private Kennel, of the City
of Elk River Code of Ordinances shah be amended read as follows:
KENNEL, PRIVATE: Any premises where more than three (3) dogs, cats, or a
combination thereof, over the age of six (6) months are harbored or kept, except for
a commercial kennel, and except that up to ten (10) cats over the age of six (6)
months may be located on a premises of ten (10) acres or more, as long as the cats
have been spayed or neutered and documentation of that fact is provided.
Section 2. Section 502.36 titled Permits for Commercial and Private
Kennels, of the City of Elk River Code of Ordinances shall be amended to read as
follows:
1. No person shall own, harbor, or keep upon his premises more than three (3)
dogs, cats, or a combination thereof, over the age of six (6) months, unless in a
commercial or private kennel duly permitted under this section. If the premises is
ten (10) acres or more, said person may own, keep, or harbor up to three (3) dogs
and ten (10) cats over the age of six (6) months, as long as the cats have been
spayed, neutered, and documentation of that fact is provided.
Section 3. That this ordinance shall take effect upon publication as
provided by law.
Passed and adopted by the City Council of the City of Elk River this 10th day of
June, 2002.
