BACKGROUND /DISCUSSION
Annually, the City Council reviews proposed fees for the upcoming year. Proposed changes are noted in
red in the attached fee schedule ordinance. Fees are adjusted to cover the cost of providing services to
customers.
Items to note include:
Licensing Late Fee (page 1)
At the June 18, 2012, Council meeting, Councilmember Motin questioned whether late fees were in place
for licenses and the item was to be brought forward with the next fee schedule review. Staff suggests
charging 10% of the total licensing fee or $25, whichever is greater.
Special Event Fee for Private Events on Public Property (Page 2)
This was the fee that was set when the Hudson wedding was approved for utilizing the downtown
parking lot in April of 2012.
Commercial Fertilizer License Fee (page 3)
The city required licensing before the state -wide ban on phosphorus. Companies are now required to be
licensed through the state. The Environmental Division will bring an ordinance amendment to eliminate
this license from City Code.
Micro Loan Program /Tax Increment Financing /Tax Abatement (page 5)
Fees for these programs have been in place but were not previously listed in the fee schedule.

Fee increased to more accurately reflect actual costs.
Sanitary Sewer User Fee and Sewer Access Charge (SAC) (page 6)
These fees were reviewed by the Council during budget review of the Sanitary Sewer Fund. The fee is
proposed to increase by 2% and the Sewer Access Charge is proposed to increase by 2 %.
Surface Water Management Impact Fee (page 6)
Increases 3% annually per Council Resolution 94 -110.
Tax Abatement and Tax Increment Financing (page 6)
Fees for these programs have been in place but were not previously listed in the fee schedule.
Fire Extinguisher Drop- off /Recharge Service (page 7)
The Fire Division has provided this service at no charge other than the vendor cost to recharge the
extinguishers. A $5 handling fee has been added to cover the city's costs in facilitating and processing the
service requests between the customer and the vendor.
Fireworks (page 8)
Fee increased to more accurately reflect actual costs.
Rental Dwelling License (page 8)
The rental dwelling license fee is combining the license and inspection fee into one to simplify processes
and decrease confusion. There is no fee increase for a single- family home. The apartment building fee
increases slightly to keep up with the cost of time spent on these buildings during the inspection process.
As an example, a 20 -unit apartment would pay $385.
A grace period on the double fee for rentals taking place before licensure wouldn't take effect until July 1,
2013, in order to allow staff to communicate this to the community. This item is similar to the fee for
construction work that begins without a permit.
Driver's License Fee (page 8)
Fee is removed as residents must go to the state for this request.
The Elk River Municipal Utilities Commission approved their fees on October 11, 2011. The city
attorney had recommended the fees be listed in the master fee schedule ordinance.
FINANCIAL IMPACT
Staff asks for adoption of a resolution authorizing summary publication of the ordinance in order to save
publishing costs.

A RESOLUTION APPROVING NOTICE OF
SUMMARY PUBLICATION OF ORDINANCE #13-
AN ORDINANCE ADOPTING THE 2013 MASTER FEE SCHEDULE
WHEREAS, on January 22, 2013 the Elk River City Council adopted Ordinance 13
approving the 2013 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the
City Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2013 Master Fee Schedule lists fees and charges for Administrative,
Financial, Environmental, Planning, Development, Building, Parks and
Recreation, Fire, Police, and Elk River Municipal Utility services along with
code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono Parkway,
during regular business hours — 8:00 a.m. to 4:30 p.m., Monday through
Friday; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council, by at least four - fifths
vote, authorizes the publication of the tide and summary of Ordinance 13 -_
and that Ordinance 13 -_ shall become effective on January 23, 2013.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER ADOPTING
THE 2013 MASTER FEE SCHEDULE
The City Council of the City of Elk River does hereby ordain as follows:
Section 1.
1. Policy and Purpose: By the enactment of this Ordinance, the City Council
intends to establish fees and charges required by the City Code for the year 2013
and to comply with Minnesota Statutes, 462.353, sub. 4.
2. Fees and Charges: The fees and charges for the city for the year 2013 are as set
forth on attached Exhibit A.
3. Application: Where a direct conflict exists between the amount of a fee or charge
set by any provision of the City Code and a fee or charge set by this Ordinance,
the fee or charge set by this Ordinance applies.
Section 2. This ordinance shall become effective January 23, 2013.
Passed and adopted by the City Council of the City of Elk River this 22nd day of January,
2013.
