03-20-2012 BOA MIN • SPECIAL MEETING OF THE ELK RIVER BOARD OF ADJUSTMENTS HELD AT ELK RIVER CITY HALL TUESDAY, MARCH 20, 2012 Members Present: Vice Chair Westberg,Commissioners Anderson,Bell,Johnson,Keller and Konietzko Members Absent: None Staff Present: Planning Manager Jeremy Barnhart and Recording Secretary Debbie Huebner 1. Call Meeting To Order Pursuant to due call and notice thereof,the special meeting of the Elk River Board of Adjustments was called to order at 6:30 p.m. by Vice Chair Westberg. 2. Consider Agenda MOTION BY COMMISSIONER JOHNSON AND SECONDED BY COMMISSIONER ANDERSON TO APPROVED THE AGENDA FOR THE MARCH 20, 2012 BOARD OF ADJUSTMENTS SPECIAL MEETING. MOTION CARRIED 6-0. • 3. Oath of Office—Mike Keller Mike Keller was sworn in as Planning Commissioner at this time. 4. Request by Elk River Lutheran Church for Variance to the City's Land Use Regulations, Section 30-2025 (2) —Stormwater Management for 728 Main Street Property, Case No.V 12-01,Public Hearing Jeremy Barnhart reviewed the staff report. He stated that approval of the variance would allow 43 percent of the site to be covered by impervious materials (concrete,roof,asphalt). Staff recommends approval of the variance with the condition that the new sidewalk be constructed with pervious pavers or an approved equal material. Vice Chair Westberg opened the public hearing. No comments were received and the public hearing was closed. Commissioner Anderson stated that he did not recall having a condition placed on a variance. Mr.Barnhart stated that the condition helps to ensure the intent for the pavers. Commissioner Anderson stated that he is not in favor of having a church in the downtown. Commissioner Bell stated that he supported the variance, since any business that would try to locate on the site would also need a variance. Commissioners Johnson and Konietzko stated they were also in favor of the variance. • MOVED BY COMMISSIONER BELL AND SECONDED BY COMMISSIONER JOHNSON TO APPROVE THE REQUEST BY ELK RIVER Board of Adjustments Minutes Page 2 March 20,2012 LUTHERAN CHURCH FOR A VARIANCE TO THE CITY'S LAND USE • REGULATIONS SECTION 30-2025 (2) - STORMWATER MANAGEMENT, SPECIFIC STANDARDS REGARDING STORMWATER DISCHARGE RATES, CASE NO. V 12-01. MOTION CARRIED 5-1. Commissioner Anderson opposed. 5. General Business -None 6. Adjournment There being no further business,Vice Chair Westberg adjourned the meeting.
