MEETING OF THE ELK RIVER PLANNING COMMISSION
HELD AT ELK RIVER CITY HALL
TUESDAY,JANUARY 8, 2013

Staff Present: Council Liaison Barbara Burandt,Jeremy Barnhart,Planning Manager;

1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission
was called to order at 7:15 p.m. by Chair Anderson.
2. Consider 1/8/13 Planning Commission Agenda
MOVED BY COMMISSIONER JOHNSON AND SECONDED BY
COMMISSIONER KELLER TO APPROVE THE AGENDA. MOTION
CARRIED 6-0.
3. Consider 11/13/12 Planning Commission Minutes
MOVED BY COMMISSIONER JOHNSON AND SECONDED BY
COMMISSIONER KONIETZKO TO APPROVE THE NOVEMBER 13,2012
MINUTES. MOTION CARRIED 6-0.
4. Request by Cornerstone Auto Resource for Conditional Use Permit for Motor Vehicle
Specialty Shop at 17219 US Highway 10,NW,Public Hearing,Case No. CU 13-01
Mr.Barnhart presented the staff report.
Chair Anderson opened the public hearing.
Steve Rohlf,representing Cornerstone Auto Resources—Questioned if it is staffs
interpretation that the applicant is grandfathered in with their existing car wash sign,
referring to the Board of Adjustments meeting held prior to this meeting.
Mr.Barnhart stated he could respond to the applicant after this meeting.
Chair Anderson stated the applicant can have up to 272 square feet of signage and can
choose how best to utilize it.He further noted the Commission made its recommendation
and the City Council will be reviewing the variance at their next meeting.
Mr.Barnhart stated he staff believes the signage is non-conforming.He discussed the
applicants'options for the current request being discussed.

Mr.Rohlf stated he wanted to continue to move forward. He stated he has an issue with the
Condition#4 that requires him to record the record the plat prior to issuance of building
permit because he won't have full financing until he does their expansion.
Chair closed the public hearing.
Commissioner Konietzko questioned if there was an option for changing Condition#4.
Mr.Barnhart stated Condition#4 is recommended in order to try an address issues with this
plat since it was approved in 2006. He stated the city acted in good faith but can't keep
pushing the payment and recording off. He further stated the plat needs to be recorded so
there is no confusion about plat, such as lots,access,etc.
MOVED BY COMMISSIONER JOHNSON AND SECONDED BY
COMMISSIONER KONIETKO TO APPROVE CONDITIONAL USE PERMIT,
CASE NO. CU 13-01 AS ILLUSTRATED ON DRAWINGS DATED AND TITLED
"FLOOR PLAN DATED NOVEMBER 26,2012"WITH THE FOLLOWING
CONDITIONS:
1. AS A CONDITIONAL USE PERMIT IS NOT A BUILDING PERMIT,THE
APPLICANT SHALL APPLY FOR ALL REQUIRED PERMITS.
2. THE DEVELOPMENT SHALL MEET ALL APPLICABLE FIRE CODES.
THE FIRE CHIEF SHALL VERIFY THE LOCATION OF ALL FIRE
HYDRANTS,AND MAY REQUIRE ADDITIONAL HYDRANTS
NECESSARY TO PRESERVE THE HEALTH AND SAFETY.
3. A SIGN PACKAGE IS NOT APPROVED.
4. THE PLAT SHALL BE RECORDED AND FEES PAID PRIOR TO
RELEASE OF THE BUILDING PERMIT.

Term Expirations
Mr.Barnhart stated terms for chair/vice chair will come in February or March.
Ordinance Review
Mr. Barnhart stated he would like to spend time at the February workshop meeting
reviewing city zoning ordinances and he asked the Commission to let staff know of items in
the ordinances they think should be discussed and reviewed.
